Definitions
IED:
An improvised explosive device (IED) attack is the use of a “homemade bomb and/or destructive device to destroy, incapacitate, harass, or distract.” IEDs are used by criminals, vandals, terrorists, suicide bombers, and insurgents.
Judicial IED:
A Judicial IED (J-IED) is a judicial decision that is a Constitutionally unmoored attack, a “court-made bomb and/or accountability ravaging decision designed to destroy, incapacitate, harass, or distract the rule of law.” J-IEDs are used by judges and justices to eliminate equal justice under law and are aided and abetted by lawyers, extremist activists, politicians, insurgents and demagogues, often to support, allow or encourage illegal activity and/or the elimination of rights and freedom.

J-IEDs

Embedded in the Trump stay-out-of-jail-free Court decision guaranteeing immunity from prosecution for his breaking the law while president is a provision saying that in “dividing official from unofficial conduct, courts may not inquire into the President’s motives.” In other words, in any action against Trump for presidential criminality, like sending SEAL Team 6 to murder his opponents, Trump’s motives for his criminal action cannot be examined. Effectively, that prevents prosecution for nearly every obvious crime. Very handy for a presidential felon to make our legal constraints go

And there’s more.

Trump-appointed Judge  Aileen “Sitting on the Scales of Justice” Cannon dismissed the case against Trump for his refusing a subpoena, lying to federal agents, theft of classified documents, showing them to unauthorized persons and other various and obvious violations of the Espionage Act.

Lemming

Judge Cannon lemmingly agreed with Trump’s lawyers in their claim that Jack Smith was improperly appointed, saying that means that he has no power to indict. Claims like this have repeatedly been thrown out of court, but that didn’t deter plucky Judge Cannon from jabbing a stick in the spokes of justice.

BOOM!

The case is dissolved for now and Trump gets away with it – temporarily. He didn’t even need the immunity thing. Stand by for Jack Smith’s appeal and a reprise of the 11th Circuit Court of Appeal’s smack down of incompetent Judge Cannon.* That will then be appealed to the Supreme Court by Trump’s lawyers, where obstructionist Chief Justice Roberts will sit on it until next summer.

That’s in follow up to the six black robed, black-hearted, Republican appointed justices conspiring to declare that Trump has immunity from justice for the crimes he committed as president. It’s great to be the king where “above the law” has real meaning. For the rest of us it’s

Now Trump can get away with anything and escape accountability, just as he’s done for most of his grifting life.

Do you see the pattern? Trump appoints judges. Trump commits crimes. The Trump judges stop prosecutions or delay them forever. Your country – your democracy your freedom and your rights – are being stolen from you and the crime is happening in plain sight.

The Future Looks Bright For Presidential Criminality

Trump asked for immunity via his lawsuit, Trump v. United States, his un-American bid to become The Orange Tyrant King, a despot, and he got it. That fascism generating decision will be the legal foundation for the Project 2025 authoritarian take down of our democracy (see this post) if Trump is re-elected. It will be the beginning of officially sanctioned tyranny in America. Watch Chris Hayes’ explanation of this Supreme Court July 1 take down of our democracy here.

This Court’s encouragement to Trump and his extremist right wing to pursue criminality stands and will continue to stand until Congress does something to erase it, a process which will require a Democrat in the White House and Democratic majorities in both the House and Senate and with fascists nowhere. We will all be at terrible risk if we don’t send Trump and all Republican extremists packing on November 5, because they will do the criminal things Trump has said he’ll do – and worse. IEDs blow up more than Humvees. They blow up your rights, your freedom and the Constitution. They kill people and they kill nations.

Apathy

There is a reason why I and so many others come back to a message urging voting and activist support. It is because we live in a nation beset by apathy over serious things.

We’re full of passion for our sports teams, the backyard barbecue and the next Netflix series. But for about 40% of us our eyes glaze over when the subject is how we decide to be governed and what we’ll tolerate.

Our government is legitimized only through the consent of the governed** – you and me. When we sit out the big game in November or tolerate the intolerable, we tacitly forfeit our voice, our hopes and dreams, and even our values to those who will not “protect and defend our Constitution and strengthen our Democracy.” Instead, they will steal everything from you and me and our apathy will have made us complicit in the theft.

The reason you and I will vote and get active to inspire others to vote is because we need to make sure nothing else goes

Preventing Tyranny


First Things First
.

CONGRATULATIONS OHIOANS!

You defeated Issue 1, an attempt by a cruel cabal of democracy haters to take away your freedom, your rights, your voice and your power. And you did it with a 13% margin.

You stood up for democracy. You told the world that you will not cave in to the cruel minority of politicians and special interest power grabbers who want to take away your rights.

You told them in no uncertain terms,

NOT ON MY WATCH!
.

That is how tyranny is prevented.

So, good on you, Ohio! Well done!

And In the Senate

An essay by Luis Martinez in Foreign Affairs entitled How to Spot an Autocrat’s Economic Lies focuses on the manipulations of autocracies, like China and the former Soviet Union. I’ve taken the liberty of replacing “government” with “party” or “Republican Party” in Martinez’s opening. I think you’ll see why.

Winston Smith, the protagonist of George Orwell’s 1984, spends his days as an employee at the Ministry of Truth adjusting documents to conform to the fluctuating political needs of Big Brother’s regime. “Who controls the past controls the future, who controls the present controls the past,” Orwell wrote, drawing a connection between a party’s ability to influence what the public perceives as the truth and that party’s political survival. Although he leaned to the political left, Orwell was deeply wary of the tyranny coalescing in the Republican Party, which sought to bend reality to its needs.

This is what tyrannies do, whether in Stalin’s Soviet Union or Trump’s Republican Party. Self-serving lies replace truth specifically for the purpose of manipulating and controlling the public for the power that delivers to the Party and its manipulators.

This, of course, is not news. What’s useful is seeing the obvious parallel of autocratic China and the tyrannical Soviet Union to today’s Republican Party. The Republicans could hang a banner with a motto, perhaps expressed in Latin to give it gravitas, “Lies and Deception.” That piece of truth would be refreshing, but don’t look for it anywhere anytime soon – except here.

Right now Republicans in the Senate are engaged in an internal attack on our national security. Senator Tommy Tuberville (R-AL) has been filibustering all Senate confirmations of our top military posts for 8 months. That includes two posts on the Joint Chiefs of Staff, with two more retirements coming before the end of September. That leaves us weaker and less able to deal with the challenges to our nation. That also undermines our diplomatic efforts.

BTW – George W. Bush knee capped our diplomacy and our entire Department of State. So did Trump. What is it with Republicans that they don’t believe in diplomacy but they do believe in swagger and ham-fisted militarism?

Tuberville’s behavior is made more curious by his liking to say, “There is no one more military than me.” Oh wait. I forgot that this self-described “more military” blowhard was never in the military. Maybe that drives his imbecilic hobbling of our military readiness. Maybe he just doesn’t get it. Or maybe he just doesn’t care about the harm he does to our military, to our diplomatic efforts and personnel or to our nation.

Senator Rand Paul (R-KY), never one to miss an opportunity to gain attention and to display faux patriotism, at last lifted his long filibuster on diplomatic appointments. Of course, that was too late for us to have an ambassador in place able to have influence on the anti-democracy uprisings in Niger or the ongoing threat from Iran, like their seizing of merchant ships in the Strait of Hormuz.

Both Tuberville and Paul filed their filibusters for reasons having nothing to do with our diplomacy, national defense or any external affair. Paul was having a manipulation fit because he wanted confidential documentation pertaining to COVID released. Clearly, his desire for power is more important than our international affairs and our safety.

And Tuberville is hobbling our military and intelligence capabilities because he wants to change our military’s consideration for women who have to travel to a different state in order to access abortion services. Clearly, Tuberville’s opinions on women’s healthcare are more important than our defense readiness or our intelligence capabilities.

I’m sorry that these men feel they have to revert to getting attention in nationally destructive ways. But my sorry for them just can’t compete with the sorry for what they are doing to our country.

That these two men can paralyze our national and international affairs is abhorrent. That the rest of the Republicans in the Senate stand by in silence, tacitly condoning such harm to our nation, is reprehensible cowardice. All of them are tools of Big Brother Trump and are turncoats to our country.

Worse yet, We The People voted for this, either through the moronic, goose-stepping votes of our extremists supporting the madness provocateurs or through the apathy and failure of too many of us to vote against the America wreckers .

We know how to fix this. It will look a lot like the glorious win for democracy in Ohio yesterday. It will take ALL OF US stepping up.

That is how tyranny is prevented.

Emergency: The Assault on Stare Decisis

You already know about the Supreme Court decision striking down Roe and it’s important to put that decision into context.

Be clear that this decision will result in Daisy, raped at age 13 by her father, having to take that incest-caused pregnancy to term. It means that Maryanne, raped in a laundromat by an unknown thug, will have to carry that baby, too. And 53 year old, diabetic Lucy will have to carry her surprise  pregnancy all the way to the point that it kills her. None of these women or any other woman is in charge of her own body any longer. The Supreme Court has established government mandated pregnancy, putting politicians in control women’s bodies.

Clearly, women no longer have autonomy of themselves or full citizenship.

At least since John Roberts was being vetted by the Senate Judiciary Committee in 2003, he and all subsequent candidates have been questioned about their views regarding Supreme Court precedent. Every candidate has declared their belief in stare decisis – to stand by things decided – which directs that settled law should not be re-litigated. And every candidate has given clear enough indication that they believed that Roe is settled law. But it turns out that their most serious declarations of fidelity to settled Supreme Court decisions just weren’t true.

And the Republican controlled Senate has consistently allowed that dishonesty.

Roe was decided in 1973 by a 7-2 vote and was unsuccessfully challenged many times (see this ACLU Timeline). The Court repeatedly upheld Roe. That’s a lot of settled law, a lot of precedent, but that was of no consequence to the liars now on the court. Roe is gone.

Also this week, the Supreme Court overturned a 109 year old law that prohibits carrying guns in public in the State of New York. It’s yet another example of extremist Justices ignoring precedent – violating stare decisis, which they claimed they adhered to – and moving us backward to a far more dangerous time.

Keep monitoring your shock response, as more decisions come down criminalizing all aspects of abortion. That includes criminal penalties for an Uber driver who brings a woman to a clinic; against friends who lend her money for an abortion; and against supportive husbands and boyfriends. Expect criminal penalties heaped upon women who live in states banning abortion and who travel to a state that allows abortion. Bear in mind that Texas has already empowered vigilantes to spy on neighbors – really, on anyone – and report them to the Texas Gestapo to collect bounties and for the state to levy fines and pile on criminal prosecution.

Expect challenges to Griswold, which will result in the outlawing of birth control. Justice Clarence Thomas, he of the “high-tech lynching,” has already invited such challenges. And don’t be the least bit surprised as this extremist Supreme Court attacks same-sex marriage by overturning Obergefell; or bans inter-racial marriage by overturning Loving; or even bans private consensual sexual activities; encourages more gun violence; and incrementally inserts religion into yet more government arenas.

One exception to that: Loving probably won’t be overturned, because Thomas is in an inter-racial marriage. He wouldn’t want to penalize himself. Penalties are for other people, so expect to hear a proud shout out for stare decisis on that one, as that expected primitive attack on freedom is defeated. Just that one shout out to precedent. It’s personal to Clarence.

Bear in mind that roughly 80% of Americans did not want Roe reversed. This Court is all about minority-enabled bullying of the rest of us, so don’t be surprised at the loss of yet more rights.

The true context and diabolical meaning of the overturning of Roe is the elimination of stare decisis, which opens the floodgates to Republican Party extremist and Supreme Court attack on our freedoms, protections and traditions. Credit for that goes to the decades-long efforts of Republicans to return us to the very worst of American Puritanical, “insecure male” tyranny, accompanied by the continuous drone of self-righteous Bible thumping and the strutting of loud, little men.

The Chicago Protest

Rage was in the air. The fury driven by the theft of rights and a very personal betrayal dominated the Federal Plaza in Chicago on Friday, June 24. It was a day that will be remembered for a very long time, with a permanent distrust of the Supreme Court its lasting legacy. The perfidy of the Republican Party, the cheats who crafted this vehicle for betrayal, will be long remembered as well.

Here are pics of some of the signs from that demonstration. The more foul messages have been excluded, but don’t imagine even for a moment that anger didn’t dominate the event. So did the commitment to vote and to support others in abortion ban states.

There Is No Difference


We’re told that there was fraud in every state, every county, every precinct and behind every tree. They tell us bad people brought boxes and suitcases full of fraudulent ballots to vote counting centers and that they destroyed legitimate ballots for Trump. People are righteously incensed at what they believe is a theft of our democracy and of their victory and they’re demanding that we “Stop the steal!” They pay no attention to the total lack of evidence of fraud. Well, there was a small handful of perps casting ballots for Trump in the name of dead relatives (here, and here), but not nearly enough to make a difference in any election outcome anywhere.

Gen. Jack D. Ripper – “Precious bodily fluids”

Right wing pundits, cable and radio blabbers and unhinged, googly-eyed senators and representatives are proclaiming that Democrats are forcing socialism on America. They rant that we are destroying our democracy and capitalism and that the Build Back Better plan is Marxism and it’s polluting our American precious bodily fluids. Okay, that “precious bodily fluids” thing is from the 1964 movie Dr. Strangelove, but the lunacy is parallel. The ranters aren’t even a little subtle in accusing Democrats of being communists.

They decry Democrats as part of an evil cabal running this country. They say Democrats are child sex traffickers and that they kill children for their blood in order to extend their own lives.

Surely, you remember the insane right wing conspiracy claim that Hillary Clinton was running a child sex trafficking ring run out of the basement of a DC pizza shop – “Pizzagate.” A North Carolina man traveled to DC to free those children. He was going to be a hero. In his rescue attempt he even fired a couple of bullets through the floor of the pizza shop – no clue why he would do that if he thought there were innocent children down there.

He would have been a hero, by golly, except that there were no children in the basement. There wasn’t even a basement.

Pizzagate Boy and millions of others had been fed that horrid story of child abduction, trafficking and murder and he believed it, as did many others.

Then there is the Jewish space laser thing. According to this piece of absurd hate mongering the wild fires from California to Colorado last year were started by – and I’m not making this up – an orbiting laser owned by Jews. Except there is no Jewish space laser. To the best of anyone’s knowledge, nobody has a laser in space that could even light a match. But people peddled this idiocy and millions believed it – some still do.

I’ve heard many interviews with Stop the Steal people being asked about their beliefs. To a person they puff up with righteous indignation and certainty, declaring that the election was stolen from Trump. When asked what evidence they have of that, the best they can do is to either repeat their assertion or declare that it’s obvious and everybody knows. They’re unable to cite even a single fact to support their certainties. To be fair, some have repeated ridiculous lies about bogus ballots. They have no interest in the near-perfect record of Trump court losses, wherein he claimed election fraud and was laughed out of court because all he had were wild accusations and no evidence. None.

There is no evidence of voting fraud beyond just a handful of idiots, most of them stuffing ballot boxes for Trump. It’s clear why some people peddle this lie. What isn’t as clear is why so many believe it. They truly believe what they have been fed by self-serving liars. They are certain that they are patriots standing up for truth, justice and the American way. And their certainty is as simplistic as Superman TV fiction for children.

So,

  1. Why would millions of people abandon their critical thinking and believe outrageous, baseless claims – like Pizzagate Boy did?
  2. Why would people believe physically impossible things or cruel, vicious allegations – like the Jewish space laser gullibles do?
  3. How did it come about that accusation is now the same as conviction? No evidence or proof is required – just a repeated accusation.
  4. How come working White guys have shifted in huge numbers to the Republican conspiracy Party, such that it’s now 90% White?

Rebecca Solnit took up these questions and wrote in part, “Distinctions between believable and unbelievable, true and false are not relevant for people who have found that taking up outrageous and disprovable ideas is instead an admission ticket to a community or an identity.” [emphasis mine]

Facts? Reality? Who cares, as long as I can be in a group with my peeps who validate me! And nothing drives us together like the passion of hatred of “others,” especially when we do it in a mob. It feels so good to blame and I feel so big when I make others small!

You don’t suppose all of that is somehow connected to our having elected a Black man as President of the United States, do you? You don’t think that privileged Whites harboring centuries of bigotry felt shaken when power went to the one who they think was born in Kenya, do you? Or that they were sure they were being displaced by less-thans? You don’t suppose that what they called the illegitimate president annihilated their sense of privilege and security, such that they’re eager to join in the choruses of snarling anger and hatred, do you?

Last weekend I was a judge at the junior high school science fair. One 8th grader’s entry sought to determine if the stress of peer pressure had more influence on introverts or extroverts. Interesting study. Would that this student scientist could have had a few million MAGA hatters to test. The peer pressure to chant “Stop the steal!” must be overwhelming, just like Hitler’s Nuremberg Rally chants. And it turns out that,

There is no difference between “Stop the steal!” and “Seig Heil!
.

None.

It’s so easy to manipulate people into hate and violence. The fallout from this stuff is nuclear waste. It’s poison. It’s deadly. And it’s now American red, white and blue.

We’ve seen this movie before and we know how it ends.

The announcement of Justice Stephen Breyer’s retirement wasn’t even 24 hours old when Republicans started bashing President Biden’s not-yet-picked replacement. Gosh, that’s so surprising.

Do You Smell What I Smell?


In another effort to quash the will of the majority of its citizens, the state of Texas passed a draconian anti-abortion law that effectively outsources law enforcement to vigilantes. The Supreme Court refused to issue an injunction to stop the law from taking effect before a full review of its breathtakingly unconstitutional provisions could be examined.* Effectively, abortion has been criminalized in Texas and enforcement of the law has been handed to bounty hunters, who have been offered cash prizes for spying on neighbors.

Historian and Professor Heather Cox Richardson puts it this way:

“The Republican Party is empowering vigilantes to enforce their beliefs against their neighbors.”

Ordinary citizens with nothing more than greed, strong opinions and with no training are now allowed to file lawsuits against anyone even remotely associated with an abortion, even those just having a conversation with a woman who may be thinking about it. They don’t even have to show harm to themselves to have standing to sue others for $10,000 or more, others who are doing Constitutionally protected things, even just having a conversation. That effectively makes these vigilantes the Thought Police** and trashes the First Amendment.

Regardless of how you feel about abortion, the worst part of this law is not that, even as harmful to women as this Texas hypocrisy is. It is about empowering vigilantes to perform the duties of the state in order for the state to avoid judicial review. Now, think about what that could mean.

Texas could enact another law that outsources collecting tax penalties to vigilantes, that encourages armed, ignorant citizens to pursue those they imagine have broken the law, that can allow extremists to sue journalists and news organizations to penalize their adverse reporting of politicians. The state can just turn everything over to crazed vigilantes and effectively do an end run around the courts.

You know, like in Germany in the 1930s and 40s. Like in the communist Soviet Union. Like in all repressive states. Neighbors turning on neighbors.

We already know what mobs of impassioned, self-important people can and will do. We saw that on January 6 at our Capitol Building. Now imagine such people up close and personal. They’re delusional about their patriotism and notions of godliness. They’re untrained and uninformed greedy bounty hunters rampaging through your neighborhood pretending they’re trained police officers and looking for you to sue you into bankruptcy.

Perhaps the worst part of this is that the extremist Republican Supreme Court justices could have stopped this plainly unconstitutional lunacy with an injunction, but they refused to do so. They allowed this law to go into effect without even having heard the case against it, which is coming before the court soon. They have abandoned the rule of law. Clearly, something needs to be done about this extremist court, because they aren’t done “legislating their ideology from the bench.”

Another Texas law makes it legal for gun toting vigilantes to roam around polling places – inside – and intimidate voters. The Texas hits just keep on coming.

These laws are sure to be copied by other minority rule, extremist Republican controlled states and we’ll have Wild West, blatantly unconstitutional actions all across our nation.

Let’s see: The Republicans have given us legally sanctioned vigilantism; minority rule; measures to encourage the infection of citizens with a deadly disease; horrific voter suppression; abandonment of the rule of law; refusal to hold cops accountable; refusal to extend healthcare to poor people; encouragement of insurrection; concealed carry and stand your ground laws that make murder legal; lies and cruel fictions replacing facts and truth; a rejection of science and a celebration of ignorance; bloated enrichment of the already wealthy and the impoverishing of our poor and middle class citizens; the destruction of trust in our electoral system; the teaching of religion in our public schools; the promotion of White supremacy and the glorification of racism; the denial of global warming in favor of enriching their wealthy donors. What else?

In the 2020 general election campaign the Republican Party had no platform. They offered a single page of rah-rah. That’s it. They offered no declaration of what they were about or of their vision for America. Sadly, now we know what they’re about. Now we know their dystopian vision for the destruction of our democracy.

I smell tyranny. I smell authoritarianism and dictatorship. I smell fascism and it stinks.

Wanna Fight This Insanity? Here’s How

Sheila Markin is a friend, the publisher of The Markin Report and she smells what’s burning, just as you do. If you haven’t yet subscribed to her posts, you truly need to. She just emailed me with news about a couple of Zooms I’m certain you’ll want to attend.

As you can see from the destructive laws being enacted in Texas and elsewhere to assault our rights and our democracy, there’s much we have to learn and much we have to do. To that end, Sheila has put together two educational 1-hour Zooms for us. These are being offered at no cost and there will be no requirement to donate. This is about making a critical difference. Here is the schedule.

September 17 at 2:00PM CDT – Media Matters will help us understand how they fight disinformation. Did you ever imagine that there would be a need to fight a constant tsunami of disinformation? Well, there is and you’ve known it for a while. We need to get smart about dealing with that.

September 24 at 2:00PM CDT – The 314 Project will explain how they are working to get doctors and scientists elected to Congress, as well as to state and local positions of leadership. Take just a moment to consider what it would be like if doctors had legislative input on medical issues and if scientists had input on issues of science, instead of such things being handled by self-serving, ignorance-loving, know-nothing  politicians. Breathtaking!
