Supreme Court

Nixon Resigns – Then and Today

After the flood of lying, cheating, whining, denying, abandoning of his criminally loyal co-conspirators and all the rest of the cover up deceit, we at last learned for certain that Nixon had lied when he declared, “I am not a crook.” His “opening of China” might have been a good thing in itself and it might have been useful to make him look like he was a world statesman, but he lied. He lied about everything, especially the crook part.

It took a lot to get to that camel-load collapse to resignation, the final straw of which was the Supreme Court deciding against his hording of evidence. He was begging and pleading that the subpoena for his secret tapes be quashed because of some imagined presidential right to keep the incriminating materials out of the hands of Congress. “Nope,” the Justices unanimously said. The president has no privilege when the items in question are part of a criminal cover up.

Poof! Nixon’s protection from the disclosure of his wrongdoing dissolved with just a few signatures. All of it, except for the magically missing 18 minutes of recording that his ever faithful secretary, Rose Mary Woods, erased via gymnastic contortions. Choose your own description of what key evidence disappeared through her supposed abuse of her transcription device.

But with that Supreme Court decision it just wasn’t tenable for Republicans to stand by their felon, so Sen. Barry Goldwater and a few more Republican senators paid a visit to the Oval Office. They made it clear that they would vote to convict Nixon in an impeachment trial. The headline above is what happened next. Nixon got out of Dodge just ahead of the jury.

We can imagine that those senators were imbued with fine, upstanding moral convictions. It may be that they saw their duty to the Constitution and to their constituents and uprightly insisted upon honoring that duty.

And we can also look at the pragmatics of the situation and recognize that the vast majority of Americans were sick of the demoralizing spectacle of inane presidential excuses and the plodding pace of Congress in the face of his obvious criminality. We wanted Nixon gone.

Failure of the senators to make that happen by continuing to support Nixon was just not a good re-election strategy for Republican legislators who craved re-election, so they were forced to tell Nixon the truth: they would dump him in a public vote. I suspect that the dumping was less an exercise in doing the right thing and more an exercise in self-preservation. Voters have a way of making the path to lose an election quite clear.

Here’s the connective tissue to today.

We have over 6 years of elected Republicans succumbing to a plague of self-deception. It’s a near certainty that most of them know better, but they refuse to speak out against Trump and extremism, and they do so for practical reasons.

We’ve seen that those who did speak out lost their primary races to radical candidates, so staying mum about Trump or any extremist is a fine primary election strategy for Republicans with Wimpy Spine Syndrome. After all, it’s the extremist voters who show up in Republican primaries. Moral rectitude has no place there, it seems.

It was the voters, We The People, who at last forced the stalwart Nixon supporters to do the right thing 50 years ago.

And it is the voters, We The People, who, conversely, haven’t turned out to vote in big enough numbers to defeat the crazies and to ensure that our rights, our democracy and our Constitution are protected and defended. It is our failure to vote that has kept a minority of extremists in power over all of us.

Yes, it’s pleasing to blame and castigate Trump and his wild-eyed, angry sycophants worshiping at the Shrine of Hatred, but we are the ones who put them in a place to harm us all. The remedy for this terrible disease is as plain to see as it can be.

Today is a good day to be the light.

Hatred, Christian Nationalists & The Supreme Court

An Open Letter to Christian Haters

Did you go to Sunday School when you were a kid? Or at least attend a church service now and then? Here’s what you did with that.

They told you the stories and the lessons from long ago, like to be kind to strangers. They said to be generous to others, especially those less fortunate than you. You remember that stuff, right?

Do you remember the day they told you what Jesus said about hatred? I’m pretty sure they said that Jesus instructed, “Don’t hate,” although they wrapped a lot more words around the message. You sat in your chair and you heard the words.

Then you walked out of the building and said to yourself, “No way, man. I’m gonna do whatever I want, whatever makes me feel good and powerful and in control.” Whatever message or teaching or directive Jesus had for you was cast aside, forgotten, crushed under your heel. In that moment you rejected Jesus completely.

And you’ve been living without Jesus ever since.

Oh, you put up a Christmas tree and you do the other performative stuff and claim you’re a Christian, but you don’t follow the rules. You live under only your own rules and who cares about what those ancient guys said? You like to hate others. It makes you feel good.

This nation has been hating non-Whites for over 400 years. Asians are squarely in the center of the bulls eye again and antisemitism is up 34 percent (seven incidents per day), according to the most recent data a year ago. The count of those acts of hatred is almost certainly higher now. So, with all that hatred infecting people, tell me again how this is a Christian nation.

Bible thumpers, holier than thou types, those wearing beatific masks, please don’t even imagine you’re fooling anyone. There is a universe of issues on which you try to paint your non-Semitic image of Jesus, but it’s just your ongoing dishonesty.

When you invade a prayer meeting at a Black church and shoot the people there, when you blast away the congregants in a synagogue, when you make death threats and distribute hate literature, when you make laws that crush your out-group, you’re refusing, denying and even giving the finger to Jesus.

That’s your truth that you hide from. But know this: we see you for what you are. So, don’t tell us you want this to be a Christian Nationalist country, because you wouldn’t be allowed to live there.

The Constitution

Now that I’ve inflamed a lot of people, let’s take this one step further.

The Articles in The Constitution primarily describe how our government is intended to work. The Amendments primarily define the rights we have as citizens. Here’s a link so that you can review all The Amendments to understand your rights. And everyone else’s, too.

What neither the Articles nor the Amendments offers is an opportunity to check a box next to the parts you like and ignore the rest.

So, if you are an ardent believer that the Second Amendment gives you the unlimited right to own and carry whatever guns or other armament you like, you would surely check the box next to that Amendment. But in calling yourself patriotic, a true American, you also have to check the box next to the First Amendment, which gives everyone, even the people you hate, the right of freedom of religion. That precludes the possibility of this becoming a Christian Nationalist nation. This country was never meant to be that. Get over it.

The First Amendment also gives us the right of freedom of speech. That means that the people you hate can say what they like, just as you can. And they can publish what they want, even if it goes against your rigid principles. There are limits to what anyone can say, but the limits have nothing to do with whether you like what they’re saying.

The First Amendment also gives us freedom of the press, the right of peaceful assembly and the right to petition the government for redress of grievances. These are for everyone, not just for you. Nobody gets to pick and choose those rights or deny them to anyone else.

We have senators and representatives who rail every day against the Bill of Rights, the first ten Amendments. They want to leave some of those imaginary boxes unchecked because it’s inconvenient or annoying that others whom they hate have the same rights as they have. The same goes for millions of ordinary citizens.

Show me the patriotism in that. Show me how demanding that this be a Christian Nationalist country comports with our founding document.

Right. You can’t.

So, Just For You .  .  .
.

Question Of The Week

Since we’re talking about hatred, the Supreme Court consistently decides cases in ways that negatively impact Americans. They call themselves conservatives, but I’m wondering what they’re conserving. Think:

Citizens United – gave corporations and rich people the right to distort our elections in their favor and against yours

Dodd v. Jackson Women’s Health – killed abortion rights. And don’t even think of imputing your supposed Christian judgments on that – see the last paragraph below.

Various gun safety laws like Heller and MacDonald – effectively made it easier for haters to kill others

A swamp of voter suppression laws (e.g. closing polling places, eliminating ballot drop boxes, gerrymandering, removing voters’ registrations) and they all seem to be decided in favor of the haters

So, our Question Of The Week is,

Why do the so-called conservatives on the Supreme Court hate Americans?

Supreme Court Fallout

If you’re a woman, they stole your reproductive rights. If you’re a man, they stole those rights from your wife, your sister, your daughter, all the females in your neighborhood, extending from sea to shining sea plus you know where else. Almost as bad, that theft of rights is being imputed into other organizations, driven by far right pressure.

Take Walgreen’s, for instance. They just announced that they will no longer sell Mifepristone, the abortion pill. Not just in states where they’ve been outlawed, but in states where it is still quite legal to sell them. They have allowed themselves to be intimidated by far right big money pressure and they’re caving in.

I’m wondering if enough pressure can be applied the other way by we consumers, who have choices. We can explain to Walgreen’s that those choices include CVS, Rite-Aid and the rest.

Here’s a plea from an activist friend:

We hope you will take five minutes today to contact Walgreen’s headquarters at (800) 925-4733 (press 5 at the prompt) to make clear that those who want to strip away women’s fundamental rights are in the minority.

Women make 85% of all consumer purchases in the US (Forbes), and drive 70-80% of spending among consumers (Entrepreneur, Mar 19, 2021). We demand that our medical decisions be respected. We will not spend our dollars at institutions that do not protect us.

I’ll add that right-to-choose voters poll over the falsely named pro-life voters (the guys who hate abortion but love the death penalty) by 24 percentage points. Seems like we Americans like our rights.

Go call Walgreen’s.

Today is a good day to be the light.

Final Comments of President Biden’s State of the Union Address, February 7, 2023

“And finally, to my Republican partners I say – and this is from the heart – no joke: cut the crap.

“Stop the brinkmanship over the debt ceiling. Not even you are dumb enough to pull that stupid default stunt again. I hope. Besides, Americans are locked and loaded to blame you for the consequences if you dummy this up.

“You want to talk policy? Great. Let’s go. We need to talk about spending and taxes. We need to talk about immigration. We need to talk about education and global warming and national defense. We need to find the best solutions to these issues and more so that we deliver for the American people.

“But if instead of developing policy that will help our nation and our people, all you want to do is to spread hatred, to demonize and to stoke culture wars – you know: the malignancies you grow – you’re no partner at all. In fact, you’re an enemy of the American people.

“But you don’t have to be.

“Choose whose side you’re on. I’ll be pulling for you to choose the side of America and Americans. Here’s a good way to show you’re on the right side.

“The Founders declared this to be a democracy. So, put on your originalist hat and reverse all your voter suppression crap. All of it. Pass laws that make that happen all across this land. And no, we’re not going to negotiate that.

“Oh, and that balloon thing. We couldn’t have learned anything about its capabilities, what it surveilled or how it worked if we had blasted it out of the sky as soon as it crossed into our airspace, making it crash on land. It would have become an unintelligible pile of junk. That’s why we shot it down over water. We want the counter-intelligence. Get it? So, get a grip, join Team National Security and cut the tough guy bombastic crap.

“We have big challenges to tackle and big opportunities to champion. And there is nothing, nothing beyond our capacity if we do it together.

You believe that, right?

“May God bless America and God bless our troops.”

Democracy

There are many zealots on the right, especially the far right, who attack the fundamentals of our democracy. Some openly promote autocracy. They assault our institutions that are designed to protect this experiment in self-rule and, in doing so, they establish themselves as the enemies of democracy. Yet we have to look at this as a system.

Can this be a democracy when in 2010 the Supreme Court, through gross manipulation of the Citizens United case, gave unlimited power to corporations and wealthy people? The Court has allowed and even encouraged them to have dramatic influence on our elections. Those big money spenders have vastly more power than you do. So much for one person, one vote.

Can this be a democracy when state legislatures practice and the Supreme Court encourages gross gerrymandering, such that elections aren’t elections at all? Those gerrymandered districts take the vote right out of your hands. They take away your voice and your power.

Can this be a democracy when before every election more and more citizens are cast off voting roles so that only the voters chosen by those in power are allowed to vote?

Can this be a democracy when polling places and early voting ballot drop boxes are located in such inconvenient locations that some people, chosen by those in power, are physically unable to vote?

Can this be a democracy when formerly incarcerated people are told they can vote, but they can’t exercise that right until they pay fines and fees they can’t afford? Note that the Constitution doesn’t make the right to vote contingent upon one’s state of freedom or the payment of fines or fees. The franchise is wholly independent from such restrictions.

Can this be a democracy when a political party has, at best, made itself subservient to White supremacy and at worst has promoted hatred so as to intimidate our citizens to keep them from voting or working in election related positions?

This list could be longer, but surely you get the point that we have institutionalized the practice of limiting who gets to vote and selecting who gets outsized election influence. We have thereby predetermined who has power and who does not. That’s our system. It’s as heinous as poll taxes or a jelly bean jar at a Jim Crow polling place.

Democracy is a lovely idea. Maybe we should try it.

Quotations

Abba Eban, Israeli statesman and ambassador, addressed the United Nations in June, 1967, saying,

” .  .  .  men and nations do behave wisely once they have exhausted all other alternatives.”

Often attributed to Winston Churchill,

“You can always count on Americans to do the right thing – after they’ve tried everything else.”

Perhaps we have at last tried enough failed paths and can resume the originally intended course.

Theocracy Is Just A Tool

What do you think about the Framers, the guys who hammered out the Constitution in a locked room with windows nailed shut and, obviously, no air conditioning, this over the course of the very hot Philadelphia summer of 1787? Are they the forebears of all national bedrock, the seers with the ability to establish the true way for whatever might come over the course of centuries? Or were they just normal men, each with his own foibles, stumbling along just as you and I do, simply doing the best they could do to conjure the needs of a new nation?

If you think the former, then you’ll surely align in some measure with the so-called “originalists” on the Supreme Court, who imagine they can see into the minds of the Founders and that we should adhere to what these justices see. That isn’t entirely unsupported, as the Federalist Papers contain a wealth of insight into their intentions, as do the the letters and other writings of some of the Founders.

If you think the latter, then you likely believe that the Constitution was intended as a series of guideposts and was intentionally left incomplete and subject to modification. The amendment process supports that view, as does the obvious fact that nobody in 1787 could have envisioned many, perhaps most, of the inventions, world changes and societal needs that have arisen over the course of the intervening 236 years.

Now, though, we are at a terrible crossroads, where many are openly denying reality, some are committing violence and a screeching minority is doing its best every day to eliminate the very democracy envisioned by the Founders. Worse, some of the howlers have their hands on the reigns of power and, worst, some howlers sit on the Supreme Court. That puts us in danger of losing what the vast majority of We the People want and believe in. The demand that this country should adopt Christian nationalism is a prime example of the danger we face, and that’s just a smoke screen for what the howlers really want.

Whatever one’s individual beliefs and practices regarding religion or God, we are intended to be a secular country. The Founders wrote about that and the First Amendment is its legal foundation, as it says,

Congress shall make no law respecting an establishment of religion or prohibiting its free exercise thereof; [emphasis mine]

The courts have established that the First Amendment also intends that we have freedom from religion. It’s a right, as in: guaranteed. But we haven’t been completely faithful to refraining from wedging religious beliefs into our public rules.

“Under God” was inserted into the Pledge of Allegiance in 1954. “In God We Trust” has been on every piece of our currency since 1957. We were in the Cold War then and had to differentiate ourselves from the godless commies to show that we were the good guys. Clearly, those insertions meant that God was on our side.

So, since 1957, every time we pay a buck for goods or services we’re confirming that we believe in and trust in God. That’s quite unfair to a lot of our people and is a self-evident violation of the intent of the First Amendment.

We violate the First Amendment every time we give public money to religious organizations. George W. Bush called them “Faith-based institutions” and doled out taxpayer cash to them. Issuing school vouchers to redirect money from public education to private schools, many parochial, is another example. More on that in a minute. There’s something very hinky about those freedom of and from religion violations, but there they stand, wearing the imprimaturs of our laws and of the Supreme Court. The drafters of the First Amendment would be baffled by that. It appears the some justices aren’t the originalists they claim to be. That malleability goes further.

In Jessica Mason Pieklo’s piece, How Conservative Justices Are Driving Us Toward Theocracy, she writes of the Court,

First, they have responded in kind to the Republican Party’s lurch to the far-right and open embrace of anti-democratic principles by issuing more and more substantive decisions on its shadow docket. Second, the Court’s conservatives, led by Justices Samuel Alito and Clarence Thomas, have started actively rewriting decades of legal precedent to help pave the path for even more regressive anti-democratic policies to emerge from states that are held in conservative gerrymandered capture.

She goes on to make the point that efforts to establish this country as a Christian nationalist theocracy are a giant step toward eliminating democracy altogether and to the establishment of autocracy – religious fascism.

Katherine Stewart was quite direct in making this point in her op-ed in the New York Times, posted on the heels of the Supreme Court stomping on our rights in its Dobbs v. Jackson Women’s Health Organization opinion:

Breaking American democracy isn’t an unintended side effect of Christian nationalism. It is the point of the project. … Its purpose is to hollow out democracy until nothing is left but a thin cover for rule by a supposedly right-thinking elite, bubble-wrapped in sanctimony and insulated from any real democratic check on its power.

The democracy attackers use many means to warp our country. A favorite is the aforementioned de-funding of public education, as by vouchers. They use these to transfer public cash to private schools, including the funding of religious schools. Perversely, they then attack the very pubic education system they have then under-funded, saying it is failing, claiming privatization is the cure. That’s your tax money transferred to religion and to very rich guys.

Postmaster General Louis DeJoy is doing the same thing to the Postal service by having trashed all the high speed sorting machines and hobbled mail delivery. The theocracy thumpers now claim that The Postal Service should be privatized because it doesn’t work properly. I’m guessing that these guys think God is on their side and that a theocracy would deliver the mail on time. Regardless, privatization would deliver the cash to rich guys. Even without full privatization, the logistics (i.e. delivery) company DeJoy used to run has been paid over $286 million by the Postal Service, and he still has a 30% stake in the company.

Snap your brain onto the most important issue: the point of all the sanctimonious Christian nationalism talk isn’t about Jesus. Indeed, the point of killing Roe and threatening to ban contraception isn’t about religion or pro-life.

They’re tools for ending our democracy for the benefit of rich and powerful people and for those who baffle themselves with their own BS, believing they’ll be sitting at the Big Kids’ table.

Back to the opening question about your belief in what the Founders intended.

If you think of yourself as an originalist, you’re forced to believe in democracy and a secular country, because the Framers specifically wrote the framework for democracy and excluded the possibility of Christian nationalism.

If you think of yourself as believing in choice number two, working to conjure the needs of our nation within the Constitutional framework, begin your thinking with the clarity that we Americans don’t like having others’ views jammed down our throats.

Either way, it’s clear that this is supposed to be a secular democracy. We the People really do believe as Thoreau advised,

“If a man does not keep pace with his companions, perhaps it is because he hears a different drummer. Let him step to the music which he hears, however measured or far away.”

That pretty well cautions against destruction of our democracy or establishment of a Christian or any other theocratic nationalism forced on We the People. Indeed, the Framers specifically didn’t want any part of that, having escaped the yoke of King George III and the Anglican Church.

In the acts of primitive rage of our extremists, they make it clear that they want to establish Christian nationalism and destroy democracy. Well, you know,

.  .  .  when you talk about destruction
Don’t you know you can count me out

– Revolution, John Lennon

To sin by silence when we should protest makes cowards out of men.

Ella Wheeler Wilcox

Special Tuesday Post – Read This First

The case is from North Carolina, Moore v. Harper, and it is perhaps the most threatening challenge to our freedom and to our way of life in our nation’s entire history. It will be heard in the Supreme Court oin December 7. We better hope that it doesn’t become a day of infamy.

This state bill is a brazen step to undermine the fundamental principle of checks and balances and to destroy election integrity by vesting all election power in state legislators, not We The People. It would prohibit all state court and executive review of legislative tampering with our rights, regardless of how outrageous and democracy crushing a legislature is.

This travesty of a bill would allow state legislators to:

– end early voting and vote-by-mail

– close polling places to make it difficult for opposition voters to vote

– rig voting maps to favor one party and keep them in power forever (gerrymandering)

– bring back Jim Crow voting laws

  • THIS BILL WOULD ALLOW STATE LEGISLATORS TO COMPLETELY IGNORE THE WILL OF THE VOTERS!

This is cheating-by-substitute-electors on steroids. In contrast to Trump’s lying, his  “stop the steal” fraud, these legislatures would actually have the power to steal elections. We know that’s true, because doing so is the entire intent of this heinous bill. It is an effort to make legal what Trump, John Eastman and their cult of thieves tried to do on January 6.

Follow this link to Vox’s description of this seditious North Carolina bill and read about it in Sheila Markin’s explainer.

It’s as clear as can be that this North Carolina perversion is an effort to end elections altogether and to vest all power in the legislators of one party – NOT WE THE PEOPLE. That’s how Russia, China, Hungary, Iran, North Korea and all authoritarian countries operate. If the Court enshrines this nuclear bomb into our democracy, all swing states (predominantly Republican) will pass identical laws and our experiment in self-rule will be over. Dead. Your voice will be silenced permanently.

I wrote “clear as can be,” but it may not be clear enough for six far right Supreme Court Justices, who have their religion and their extremist rationalizations blinding their eyes. Should they decide in favor of the petitioners (the North Carolina state legislators), they will claim their conservative bona fides, but there is nothing conservative about disenfranchising all voters in the state, nor of ending the safety of checks and balances.

What’s really odd and so deeply troubling is that the Supreme Court decided to hear this case at all. It’s so plainly anti-Constitution that they should have refused it immediately.

These justices have proven their immunity to public opinion (see Dobbs or ask that raped, 10-year-old Ohio girl), and I’m not at all clear what we can do to stop this Constitution killing machine, the Supreme Court.

During the Senate confirmation hearings on John Roberts, Neil Gorsuch, Samuel Alito, Brett Kavanaugh and Amy Coney Barrett, they all assured us of their belief in stare decisis – to leave Supreme Court precedent unmolested – and that Roe was settled law.

So-called “moderate” Sen. Susan Collins (R-ME) was the deciding vote on the Kavanaugh confirmation and she declared that in a private meeting he had given her his assurance about Roe. She believed him, too, just as the Senate believed all 6 extremist justices.

Where did Collins’ common sense go? How did she allow her BS detector to become inoperative? For that matter, how did senators fail to believe Anita Hill and instead they believed Clarence Thomas and his “high-tech lynching” deception?

Now these extremists are in a position to end our democracy. Once it’s gone, it’s gone forever. There will never be a chance to vote it back. That’s why this is perhaps the most threatening challenge to our freedom and to our way of life in our nation’s entire history.

NOTE: For best clarity about this case you must read Sheila Markin’s post. She has the legal bona fides to analyze what’s at stake and she puts it in plain English for us.

Meanwhile, you can join Common Cause-Ohio’s listening party for the oral arguments in this case at 8:45 – 10:15 AM CST tomorrow, or listen on the Supreme Court web site.

For the Dreamers

    • “The work goes on, the cause endures, the hope still lives and the dream shall never die.”
    • – Sen. Edward Kennedy (D-MA), Democratic National Convention, August 12, 1980

The Republicans have taken  control of the House – barely – and the overall election outcome should trigger waves of consternation and gnashing of teeth over how so many screwed up for so long and in such creatively self-destructive ways in so many types of races.

Republicans fielded hateful, brain-free candidates and We The People didn’t like them. The geniuses at the RNC had to have been expert sleuths in order to find so many unqualified candidates. Herschel Walker? Seriously?

There were some impressive Democrat performances, too, for which there aren’t yet words to describe, like how Democrats managed to lose four House races in upstate New York.

How come the DNC couldn’t send the desperately needed funding to Tim Ryan in Ohio and Beto O’Rourke in Texas? Those guys are the ones who have the character and ability to be the fighters we’ll need over the next decades, the people with the moxie to defeat the authoritarians, but the DNC largely abandoned them.

There will be lots of time for licking wounds and I fervently hope there’s a lot of introspection and forehead slapping. And please, DNC, have the courage to admit what everyone knows: your communication and messaging sucks. Maybe there exists a self-help organization called Sucky-Talkers Anonymous.

Bob: “Hi. I’m Bob and I suck at messaging.”

Group: “Hi, Bob. Yes, you do.”

Of course, there were wins, some found even in losses, like Adam Frisch’s challenge to “bubble-headed woman who should never be allowed near any dangerous implement, like a microphone,” Lauren Boebert. They’re reporting that 99% of the votes are counted, with the candidates separated by just 554 votes. Kudos to Frisch in this deeply red district.

It’s odd human being stuff that people fall for a pretty face, like Boebert, Kari Lake, Sarah Palin and Scott Brown without investigating whether there’s any sign of intelligent life behind the face.

There are two obvious and significant things to expect over the next two years. In the Senate, President Biden will continue to be able to staff the 80-plus federal judiciary benches awaiting newbies. Invoking the words of Joe Biden when speaking to President Obama on the passage of the ACA – “Obamacare” – and while too close to an open microphone, “This is a big f***ing deal.”

Even better, if a vacancy or two should come about on the Supreme Court, Biden will provide nominees to the Senate and the Republicans will not be able to stymie the process with fabricated new rules of obstruction. It sure would be lovely if Clarence Thomas and Samuel Alito were to suddenly contract cases of Incipient Mortality Awareness Despair Over Probable Ending (“IMADOPE”) and they decided to spend more time with their families. One could hope.

Thanks go to Jim Nathan for this piece

The other thing to expect will occur in the House, where the Republican circus will have all three rings set up, with nothing but sense-defying acts taking place.

For example, we can expect Jim “The Flame Throwing Ignoramus” Jordan (R-OH) to chair the judiciary committee and hold a protracted, pointless hearing into Hunter Biden. After that there will be more pointless hearings focused on Biden and his laptop. Following that will be hearings into Biden’s involvement in the kidnapping of the Lindbergh baby and in the assassinations of Presidents Lincoln, Garfield and Kennedy.

In the end, we will have spent many millions of dollars investigating anything Hunter Biden has thought, done or could spell for the entire duration of his life. The hearings will be continuous until the 2024 election in order for the Republicans to make Democrats look dirty. The official report will be 800 pages long and will say nothing – just like the report from the Benghazi hearings Committee on Stupid, Darryl Issa (R-CA), Chairman.

And that kind of stupidity and cruelty by Republicans is what we can expect from this new Republican controlled House. Indeed, they’re already gathering firewood for the witch burning pits.

Republicans have declared that they intend to impeach President Biden, Vice President Harris, Anthony Fauci and Alejandro Mayorkas, Director of Homeland Security. They have no charges against any of them. There isn’t even a whiff of wrongdoing to investigate. Most Republicans in Congress don’t even know who Mayorkas is. No matter. These hearings leading to impeachment votes are solely to get back at Democrats for the two impeachments of the orange president. Yes, they’re as infantile as that.

And while those hearings and impeachments are going on there will be no people’s business conducted. There will be little to no problems solved, no solutions found. The only accomplishment will be the performance of a Republican temper tantrum.

You can also expect push-back from the Republican House against our support for Ukraine. The fascist extreme wouldn’t want to do anything to upset their role model, Vladimir Putin. And Ukraine as a sovereign nation, it’s people wanting democracy and freedom? “Who cares?” say the Republicans.

Because that’s what Republicans do. They are all about demonizing, hating and legalized cruelty. To see this clearly, all you need to examine are all the racist and antisemitic spewings by Republicans. Unlike Democrats, they never police their own.

Together, Republicans comprise a national version of White Citizens Councils. That “Make America Great Again” mantra refers to when America’s domestic power was bed sheet white and sub-humans of color were controlled by their White betters.

But such unconscionable domination is already beginning to come to a close, as our White majority is becoming the White minority. Indeed, that’s the driver of so much of the repression. People don’t give up power willingly.

MAGA rallies cannot push back the tide, which triggers fear in those who want to return to the early 1950s. You know: before Brown v Board of Education; the 1964 Civil Rights Act; the 1965 Voting Rights Act and the rest of what allows non-Whites to be full citizens.

What White supremacists are left with is fear, hatred, violence and pitiful attempts at appearing to be something they are not. Recall Trump saying at a 2016 rally, “There’s my African-American.” Singular. Pick that apart any way you like, including empathy for that guy for his being so dreadfully duped.

To be clear, there are victories from our multi-week election day, most notably for what did not happen: a red wave. Plus, there were both new and re-elected blue governors, secretaries of state and more. These are people who trust in the Constitution and the will of We The People, so they don’t threaten to reverse our elections in order to suit themselves and their extremist overlords.

Insane factoid: Isn’t it crazy that times are so upside down that we celebrate that no election workers or voters were harmed by vigilante idiots? Here’s to the judges who prohibited the vigilantes from vigilante-ing!

So, this election was a mixed bag. Read Thomas Friedman’s post, America Dodged An Arrow for more on that.

Hope still lives and the dream is still alive – and it will be so as long as we keep it alive. That opens the door to what we’ll do to make 2024 what we need it to be. The starter’s pistol for that race has already fired.

PS

Merrick, there is a difference between: 1. Doing things right while doing the right things, as well as sweating the details; and, 2. Refusing to make a decision.

We’re 22 months down the road. It’s time to make a decision based on the painfully obvious evidence. Tell Jack Smith I said so.

I Don’t Know Whether to Believe Justice Clarence Thomas

Now it’s your turn.

Friend, activist, Witness at the Border reporter and founder of Peaceful Communities, Lee Goodman, has a facility for clarity. While I’ve been beating the drum for center-and-left-thinking people to vote for quite a while, Lee’s recent essay is the best I’ve seen to communicate what’s at stake. Here it is as a Guest Essay. All emphasis is his except the last sentence of his post. That emphasis is mine.  JA

I’ve sprinkled throughout this guest essay pics from the White House Fact Sheet on what today’s Republicans want to do to you. This looks mostly at health related issues, but the same kind of Republican “screw you” attitude applies to infrastructure rebuilding, re-shoring of manufacturing and all the great jobs re-shoring will create and more. They offer only cutting anything that will help ordinary Americans and cutting taxes on rich guys. You know: trickle down economics that hasn’t trickled down for over 42 years. This is why you can’t vote for any Republican.

During oral arguments on a case challenging affirmative action, Justice Thomas said he didn’t “have a clue” what “diversity” means. Could he really be that stupid? Former President Trump’s behavior demonstrates that he has no idea what “decency” means. The campaign literature I have been receiving in the mail leads me to suspect that a whole lot of Republican candidates have no idea what “honesty” is. Leaders of the Republican party have shown that they don’t know what “civilization” means. The new owner of Twitter, who has given the green light to hateful incitement, doesn’t care what “responsibility” is all about. An entire political party that says it is “conservative” clearly doesn’t remember what that word means.

The right wing has discarded the vocabulary of normal human relations. It is rewriting the dictionary of political thought. Things that are not “people” are, to them, people. Intimidating folks by carrying assault rifles is peaceful demonstration. Riotous insurrection is free speech. Making it difficult to vote is democracy. Refusing to accept the results of elections is patriotic. Truthful reporting is “fake” news, while nonsensical conspiracy theories are revelation.

See the footnote* below.

Can so many people be out of their minds? Are we surrounded by idiots, oafs, and lunatics? Can it really be that our the Supreme Court is determined to eliminate fundamental rights and freedoms?

It was hard enough to accept over the years that there were places in our country that were behind the times, populated by intolerant religious zealots and ignorant bigots. It is harder to accept that their worldview may now have the support of the majority.

We are not just squandering our national heritage of accomplishment. We are engaged in dissembling our country.

Actually, they want to be able to eliminate those benefits EVERY YEAR.

I have never been more worried about an election. As in all prior elections, large numbers of registered voters will not vote. Those uncast ballots will decide who wins, just as much as the ballots that are counted. On the news last evening, I heard people say they would not vote because they don’t feel that the people in power are listening to them. I can’t think of a better way to guarantee that you won’t be listened to than to not say anything.

Our country is not alone. Demagogues and dictators are plentiful. Repressive regimes are thriving. People are fleeing danger in their homelands and are being expelled from the places where they seek refuge. The upbeat stories at the end of evening newscasts of firemen giving firetruck rides to sick children do not balance out the reports of drought, floods, famine, war, and other misery.

Despite what Clarence Thomas, Elon Musk, Mitch McConnell, Ron DeSantis, Gregg Abbott, Mike Pence, Alex Jones, Rudy, the pillow guy, and the rest of the Fox News alternative universe say, there is something called “reality.” There must be “dignity.” We cannot let greed, hypocrisy, hate, jealousy, and fear-induced fantasy destroy hope.

If you haven’t decided yet whether to vote, assume that the people you don’t want running your life already have.

“Don’t boo. VOTE!” – President Barack Obama

“Voting is what you’re going to do [this] Tuesday.” – JA

———————————–

*As he was headed out of Congress in 2004, 12-term congressman Billy Tauzin (R-LA) inserted a little addendum into George W. Bush’s thousands-of-pages-long Medicare Part D plan (which nobody read). It said that the government – Medicare – was prohibited from negotiating drug prices with pharmaceutical companies. Tauzin then left Congress and took a new job as president of PhRMA, the lobbying organization for Big Pharma. That gave him an increase in pay of 7,110% and ensured the highest cost of healthcare for seniors.

Friend Mardy Grothe publishes a weekly offering focused primarily on literature and language, always including memorable quotations. One offered today is from Scotty Reston of the New York Times that captures our solvable problem today:

“All politics is based on the indifference of the majority.”

Indifference simply isn’t an option today.

Dracula Today

Now it’s your turn.

Bad Moon

John Fogarty and Credence Clearwater Revival sang about it decades ago, perhaps prescient about the dangers that surround us today.

I see a bad moon rising
I see trouble on the way
I see earthquakes and lightning
I see bad times today

Don't go around tonight
'Cause it's bound to take your life
There's a bad moon on the rise

I always needed an interpreter to understand Fogarty’s words. For example, I thought he said that there’s a bad moon “on the right,” not “on the rise.” If he had sung it the way I heard it, he’d be exactly right for today’s America, although his way is pretty accurate, too.

That bad moon on the right brings hatred, lies, hypocrisy, lost integrity and an imminent threat to our very democracy and threats of violence and death to our fellow citizens. But you know that, just as Fogarty seems to have known it in my misinterpretation of that line in his song.

We have 6 days left to stop that bad moon on the right and make the difference that must be made.

American Psychosis

Yes, of course we’re psychotic. That’s what explains all the reality denial and our pronounced sociopathy, like that self-deluded thug smashing Paul Pelosi’s head with a hammer. We’ve been down this Alice in Wonderland rabbit hole many times and somehow we’ve survived it. All we had to do was to tolerate the death and destruction and voilà! everything was just fine again.

Like the Civil War, when half the country violated its sacred word, violated its oath and attacked the other half of our country. We only had to tolerate over 600,000 dead and many times that number wounded, hobbled, disfigured for life or insane.

Like over 86 years of Jim Crow lynchings – 4,743 of them according to the NAACP – and those are just the documented lynchings. And, of course, there was the terrorizing of millions.

Like the hatred and violence unleashed on various immigrant groups, like the Catholics, Irish, Italian, Chinese and Jews.

That’s just some of what we’ve tolerated.

See Note 5 and the final graphic below.

In David Corn’s book American Psychosis he recounts the cruelty and flagrant dishonesty of America’s alcoholic senator, Eugene McCarthy (R-WI). A fellow senator, Millard Tydings (D-MD), described McCarthy’s claim about the State Department being infested with communists, saying his charges were “a hoax perpetuated on . . . the American people” and “perhaps the most nefarious campaign of half-truths and untruth in the history of the Republic.”

Nevertheless, Republicans back then “viewed McCarthy as a potent weapon to deploy against Democrats.” McCarthy supported “a popular revolt against the upper classes,” and “accused the Truman administration and Democrats of being traitors to America. He had no evidence, only accusations.” Put a bookmark in that: no evidence, only accusations.

Gen. Dwight Eisenhower was campaigning for the presidency in 1952 and was to give a speech in Milwaukee. Included was a paragraph excoriating fellow Republican McCarthy, the insanity of McCarthyism and the spinelessness of the followers of his hatred. That paragraph said that to believe McCarthy was to believe that the government was being run by “men whose very brains were confused buy the opiate of this deceit,” meaning the deceit of McCarthy.

But Eisenhower needed Wisconsin votes, so he never spoke those words in public. In fact, even as he deplored McCarthy, he remained silent for years about McCarthy’s hypocrisy and the cruelty he set upon good Americans and the very fabric of American values. Even the Supreme Court took a swing at what we profess to be our values by ruling that the First Amendment did not cover communists. Surely you’re seeing the parallels to today.

Trump is our McCarthy, the liar, the manipulator, the hatred spewer, the accuser of wild conspiracies without evidence. So, too, are his imitators, suck-ups and opportunists for votes who are doing the same thing, just as happened in the 1950s.

Were Sen. Tydings alive today we surely could show him what a real hoax on the American People can look like. He’d have a new take on “perhaps the most nefarious campaign of half-truths and untruth in the history of the Republic,” the Nazi-MAGA scourge.

Like the Civil War, lynchings and McCarthyism, our present psychosis – our blood sucking Dracula, in Halloween-speak – will not go away on its own. We’ve already tolerated too much death and destruction and America’s Dracula will continue to attack us and suck the life out of this republic until we take action.

This national vampire must be fought into a coffin and a stake driven through its foul heart so that it can’t drain all the blood from America. That’s what you’re going to do next Tuesday.

From Rep. Adam Kinzinger (R-IL) yesterday:

But I’m also sad this violence [against Paul and Nancy Pelosi] isn’t more surprising — just as I wasn’t surprised by January 6th.  This is what happens when we’re taught that those who disagree with us are existential threats to our survival; when we label our own tribe good and the other evil; when we fail to call out the bad behavior of our own “side” out of loyalty or denial.

We’re hearing calls of sympathy, empathy and caring for the Pelosi’s from Democrats. The Republicans are made of other stuff and prominent individuals are making up horrible conspiracy stories, they’re blaming the victim and refusing even a hint of concern for the Pelosi’s. Likewise, they haven’t concern for any of the Democrats or their families who receive a near constant stream of death threats prompted by Republicans’ dreadful demonizing. Republican politicians can’t even muster a, “Sorry that happened to you.”

Think about that when you go to vote on Tuesday. Think, “A stake through its heart.”

Inside President Biden’s Head

Page 1: Conjuring

He has not invited me into his head, nor has he shared his inner politician or inner President with me. He and I have had no Vulcan mind meld, nor any spooky transmissions. But there’s stuff going on in President Biden’s brain and, blurt-prone though he may be, not everything he thinks gets spewed publicly. We’re left to conjure his intentions.

And conjure, I do! About things like our blatantly political and extremist (did I mention radical?) Supreme Court as an arm of the Republican Party, exactly what the Founders thought they were protecting us from.

People were calling for Biden to expand the Court with centrists and center-leftists even before he was inaugurated, afraid that the things we feared would come about – things like yet more voter disenfranchisement, the end of Roe, more onerous gerrymandering, preventing the EPA from regulating the emission of greenhouse gases, defeating efforts to keep guns out of public places, tearing more bricks from the wall separating church and state and the flood of corporate cash into our politics (what did I miss?). Our fears have been realized, as all of these things have come about.

The bad news from the Court may not be done. On the docket now is a case to decide if state legislatures can take away your vote – literally negate your citizenship (Harper v. Moore). That’s exactly what Republican controlled state legislatures are attempting to do. If they get their way via this radical Supreme Court, it will be a time stamped event that will mark the moment when democracy was permanently crushed and died. The decision is now in the hands of the Court, with oral arguments having been presented on October 4. If this doesn’t scare you, re-read this paragraph.

So, how come President Biden has been silent, not even speaking to something as simple and non-aggressive as imposing ethics rules on our Supreme Court justices – rules like those on judges in other courts? Or establishing term limits so that we can shed grumpy and radical old men? And how come he has refused comment on expanding the court to 13? Two reasons.

First, attempting any of that before the mid-term election would likely produce an overwhelming wave of Republicans in Congress, at which point all progress would grind to a halt and a Republican would win the White House in 2024. Trying to do any reform would be a near-perfect strategy for losing.

That could change following the mid-term election because Biden has Captain Kangaroo pockets full of major legislative wins. But that’s not likely, which leads us to the second reason Biden has been silent.

He doesn’t like any of those ideas. His refusal to so much as have a conversation about any effort to moderate this radical Court tells you all you need to know about what’s in his head. Expect reform of the Supreme Court in about half a century. Maybe a full century. If we still have courts and if we still have a democracy.

That’s what I conjure about Biden’s conjuring about the Supreme Court. I really want to be wrong about this and fear that I won’t be.

Page 2: Hurricane Ian and President Biden

From former colleague Nora Paller:

Community In Action

Watching the scary, dangerous, horribly damaging Hurricane Ian devastate Florida and beyond was tragic. Many people will never be able to come back financially [or] from the emotional trauma of this event. The only good thing was to see all the people who reached out to help – to see community in action. Pulling together to face a larger threat can bring people at odds with each other to let it go and work together. All of sudden, DeSantis wants to talk to Biden. Instead of wasting Florida’s money sending asylum seekers to Massachusetts [link is mine], he is doing something direct[ly] for the people of Florida. Could we stop all this nonsense and work together? Turns out they could and we can.

President Biden, you can lead a Community In Action parade with just your words. Here’s hoping that’s in your head, because the people of Puerto Rico, Florida and the Carolinas need a parade right now.

Page 3: What Is In President Biden’s Head

Securing solid majorities in both houses of Congress is in the front of President Biden’s frontal lobe, because all progress depends on that. Absent those majorities, hateful fools like Republican Joe Kent will get their way and obstruction is all that will happen.

We had eight years of The Party Of No when President Obama was in office and people like Speaker of the House John Boehner and Tea Party Republicans were pledged to Mitch McConnell’s hateful commitment to “Make Obama a one-term president.” True to their word, that’s all – that’s everything – they attempted to do. The Republicans opposed everything Obama proposed in goose-stepping, moronic uniformity. They were and are The Party Of No.

And that’s what we’ll get again unless there are solid BLUE majorities elected next month. That’s in President Biden’s head for sure. He knows that. You know that, too.

Any Representative Democracy . . .

Freshman wing of Marjorie Stoneman Douglas High School – still a crime scene. Click to read the story

.  .  .  should be representative of the people.

Ours isn’t.

Well north of 80% of us want far greater regulation of guns than we got with the recent milquetoast bill. And even that weenie bill required accumulating hundreds of thousands of murdered people to sufficiently motivate legislators captured by the gun industry to find the courage to stand up for little school kids. Not representative.

Emma Gonzalez: “We call B.S.” Don’t you? Click the pic

BTW – Canada just banned the importation of handguns. They are taking substantive steps to make their country safer. Tell me again why we can’t take strong measures to stop, oh, say, school shootings. Note that the words “school shootings” is a sanitized version of what actually happens. The reality is children are ripped to pieces by bullets from assault weapons. Read the linked article.

Memo from the Supreme Court: “Did you remember to set your clocks back 400 years?”

Nearly 70% of us want abortion to be legal, but the Supreme Court killed that at the federal level, this in a Bible thumping tantrum. You can download the 15th century based majority opinion written by Justice Alito here, although I warn you that it is 79 pages of drivel.

At the same time, half the states are in the process of making abortion illegal at that level. Ref: Kansas, where the state legislators are thumping their Bibles to end abortion, but the people just deep-sixed the proposed amendment to their state constitution that would have done just that. But the self-righteous zealots in Topeka have promised to be back to thwart the will of the people. Not representative.

The vast majority of We the People want democracy. Nevertheless, the Republican Party is doing everything it can to destroy the democracy the majority of us want, as legislators raise fists, lie and pass laws to steal elections from – guess who? – We the People. Not representative.

It used to be unthinkable for a political candidate to declare before an election that if they win it was a free and fair election, but if they lose that the election was stolen by massive voter fraud. Heads I win; tails you cheated. There are a bunch of Republicans claiming that now, before the upcoming mid-term election. 26% of Americans actually believe that deceit, but the majority of We the People see the dishonesty and manipulation and say no. Still, that’s what the autocrat wannabees are saying to us. They’re unrepresentative.

Orbán the Terrible Beware the jaws that bite, the jaws that catch.

Viktor Orbán, the dictator of Hungary, was the keynoter of the Conservative Political Action Committee (CPAC). He spouted racist, anti-Semitic hatred and immigrant slurs, “a pure Nazi speech worthy of Goebbels”. The rabid attendees cheered him wildly. Why are Republicans celebrating dictators like Orbán and Putin?

All this and more would not have been possible just a short time ago. Can you imagine Republicans as autocrats trashing democracy during the Cold War? Or during Reagan’s presidency? Unthinkable. And it would have been unrepresentative.

To be fair, we’ve always had a minority population of Christian nationalism zealots who want the United States to be a theocracy. That’s an autocracy with a religious text as its constitution, full of sufficiently vaguely worded rules, ripe for interpretation in any way desired by the autocrats. The only theocracies these despot lovers criticize and even hate are Muslim theocracies in Iran, Afghanistan and elsewhere. Be clear, though, that the inevitable result of the “My theocracy is better than your theocracy” insanity is a new Crusades.

Wait! That’s it! Let’s send drones and a bunch of Navy Seals dressed as palmers and knights to all those Muslim countries to force them to change to our pure Christian nationalism ways. Forced conversion always works so well.

“There be monsters here!”

And we can apply that same technique to our coastal elites to change their colors to bloody red. This is shaping up to be a joyous global spectacle of outrage and murder on an exponential scale that might satisfy even the apocalyptic world enders. Of course, we’ll need world maps to be redrawn showing both that the Earth ia flat and that there be monsters off the edges. O’ the glory of the age of darkness we’ll create with our country run by unrepresentative autocrats!
