Another Effort to Understand

I sent out a notification to about 50 of my neighbors to alert them to the opportunity to make a statement with Lights for Liberty this Friday evening. This is in protest of the treatment of detainees in horrible conditions in ICE/CBP camps. (Scan to the bottom of their website to find a location near you.) Aware that I was taking a chance because I don’t know the political views of most of my neighbors, I invited all recipients of my email to advise me if my outreach was unwelcome and I’d send them nothing further. I received one response to my invitation.

The email read,

Sorry, I guess I’m on the other side. The parents/adults should not be using them [children] as pawns for illegal immigration moves. It is a sad situation, but the legal US residents should not have to pay and fix this. They should be stopped at the border and turned away unless they go through the current legal process. Unfortunately, we do not have a Congress that will address this and open borders is not the way to go. This was easy to see coming and obvious who does not want to address it.

Slow down any urge to “yeah, but” this and instead give an effort to understand.

In fact, we have been told that hapless children are being used as pawns to enter the U.S. and it is unsurprising that some believe that to be true. In fact, while I see such claims as just another Trump lie, I have no data to support that, any more than the author of that email has data to support their view.

The writer acknowledges that the situation is sad, but like millions of Americans doesn’t think we should be paying to fix the situation. I’m pretty sure that’s a common conservative view and in line with believing that we shouldn’t be footing the bill for everything that needs fixing around the world.

The writer is correct in claiming that we don’t have a Congress that will address this issue. That’s been true at least since the early days of George W. Bush’s first administration in 2001. And I agree that open borders is not the way to go.

The current legal process truly is a mess. Seeing it as “obvious who does not want to address it” makes sense in the context of the polarizing name calling and unending propaganda we’re subjected to.* The price of propaganda is very, very high. Look for more on that in this Sunday’s post.

All of this is to say that it’s not that difficult to understand a contrary view of the border mess or, really, any of the messes we have on our hands. In part, at least, we’re dealing with different realities – mutually exclusive “facts” – which makes it easy for honest people to both disagree and fail to understand one another.

Plus, everybody’s talking and pretty much nobody is listening.

This Isn’t About Trump – It’s About What’s Important

Trump politicized the Fourth of July.

There were M1A2 Army tanks and Bradley armored vehicles in front of the Lincoln Memorial.

Not content with just stationary vehicles, Trump ordered the military to have airplanes and helicopters pass overhead, saving the Battle Hymn of the Republic to blare over the loudspeakers as the Navy Blue Angles did a fly-by.

The military was there because Trump won’t get his military parade to one-up President Macron of France. Such a massive show of hardware would rip up Pennsylvania Avenue and cost more than he could scam through Congress. And they were there because the violent machines of war make him feel powerful and self-important.

He gave a speech written by others which included concepts he doesn’t understand, interspersed with self-serving grandiosity. He anchored it to the military because his base would thrill to that; but of course that was only a fraud to justify focus on himself.

“It’ll be like no other – it will be special  .  .  . ” Trump had promised of his spectacle. Of course, that turned out to be true – it was like no other. But not in the way he meant. (Just for fun you can review his speech here.)

For this Trump “look-at-me” event using our military for political purposes, only big Republican donors and pols were offered tickets. No Democrats were invited. He refused to disclose how much the event actually cost, but we already know that he robbed $2.5 million from our national parks as partial payment.

And all of that is the problem.

Trump made our national birthday party all about Trump instead of all about America. It is the perfect exemplar of what has happened to our country since the craziness began, as foreign affairs, immigration, trade policies, the wall, threats of war, healthcare, taxation and all the rest are solely about Trump, not about America.

That is why we have to do absolutely everything necessary to get the hands of this dangerous person off the levers of government. Because it’s not supposed to be about Trump; it’s supposed to be about you and me and 320 million of our country-men and -women.

I’m not an “all Democrats all the time” guy. I am a democracy guy full time and it matters that a huge percentage of our democracy has been demolished by this would-be tyrant. It needs to be rebuilt before we lose it all. I’ve written about that in many ways, including how We The People aren’t getting what we want. A part of what submarines rule by the people is a Republican Congress that is dedicated to chest-thumping fictions and obstruction.

The Republican mantra for the last two Democratic presidents – that’s 16 years of government – has been opposition to everything those presidents promoted. That was true regardless of how sensible the policies were and even if Republicans had supported those policies before there was a Democrat in the White House.

That produced hyper-partisan warfare and gridlock. It’s why we don’t have even a plan to rebuild our infrastructure, yet politicians tell us in every election cycle that they’re going to fix it. It’s why we don’t have common sense gun laws, even as over 90% of us demand them. It’s why Roe v. Wade continues to be attacked, while 76% of Americans want it left alone as settled law.

The same is true about healthcare, education, the DACA kids, global warming, Putin’s invasion of America and so many other issues. We aren’t getting what we want and our pride as Americans continues to slip almost entirely due to – let’s call it displeasure – with our politics.

We need to put the building blocks of democracy back in place and the only way to get beyond the Congressional gridlock of the past 30 years is unitary government, at least for a time.

Yes, I know that the very vocal Democrat far left is off-putting to independents and traditional Republicans and even to centrist Democrats. Read Nick Kristoff’s piece for more on that. I suspect that there will be a strong moderating force, should the Dems take over Congress, especially if Nancy Pelosi is in charge of the House. I, for one, will be lobbying for that moderation.

And I will be lobbying for democracy and for for clarity about what We The People want and the best ways to deliver that. Join me now in two ways.

First, support candidates who will create the change you want to see. Right now there’s about an 85% chance they’re Democrats, especially if they’re opposing one of the spineless Republicans who hasn’t the moral courage to stand up to Trump.

I really don’t care if you’ve never voted for a Democrat, because your predisposition to oppose Ds has no place in our teetering democracy.

The second way may appear to be just for fun, but it isn’t.

Confucius tells us that the beginning of wisdom is to call things by their proper name. We certainly need more wisdom in America right now. If Trump is to be removed from power in 2020 so that we can restore our democracy, we must properly name him with unmistakable clarity so that We The People make sensible choices.

BTW – Senate Majority Leader Mitch McConnell tweeted a happy Fourth of July message on Thursday morning that included a picture of the Betsy Ross 13-star flag. White supremacist and other hate groups have been using that flag to promote themselves and spread hate, likely because slavery was the law of the land when Ross made that flag. Click through and read McConnell’s tweet; then read the comments below it. They are stunning in their rebuke of him. Indeed, pass along the link to your friends in Kentucky so that they will remove this democracy killing “Grim Reaper” – that’s how he describes himself – from the Senate.

Porky Pig

To quote Porky Pig: “Ah-bi-dee, ah-bi-dee, that’s all, folks!”

The Supreme Court has just handed down its most blatantly political decision in a long time, or at least since the democracy killing Citizens United decision in 2010. Their stupefyingly bone-headed refusal to knock down blatantly obvious discrimination by North Carolina’s legislature will have a destructive impact that will echo across the nation.

This case was about gerrymandering designed to strip voting rights and legislative power from the poor and from minorities. The Supreme Court has opened the door for unending, unearned political control by a diminishing white majority. Its decision will have devastating impact on millions of Americans for years to come and is truly the New Jim Crow.

To the 5 justices who made this happen, I have some snark: Your mothers must be very proud.

BTW, the Times is not failing, as Emperor Trump would have you believe. It’s having some of its best years ever. They’re focused on stuff happening here on planet Earth, a concept of reality that doesn’t seem to penetrate the information-proof walls of the East Wing living quarters, which serve as Trump’s Twitter bunker. #FailingPresident.

How Did We Get Here? and “The Wag”

  • How did we get to the point:

– where ripping babies from their mothers’ arms is tolerated?

– where we refuse those kidnapped kids soap and a toothbrush and there isn’t universal outrage?

– where disrespecting our allies and cozying up to adversaries is thought to be good foreign policy?

– where allowing fossil fuel exploration in Monument Valley is considered a good idea?

– where pulling out of the Paris Climate Agreement is deemed sound policy for our children and grandchildren?

– where there could be a discriminatory citizenship question on the national census? The Constitution calls for no such thing.

– where Russia could invade and disrupt our national election and the president refuses to confront, much less punish the offender?

– where the president refuses to do anything to stop further cyber assault on our country and even invites it – and somehow we aren’t all enraged?

– where we yawn when yet another Cabinet Secretary resigns in disgrace?

– where birthright citizenship – you know, the 14th Amendment – would be under attack? Note: The 14th Amendment is probably why you are a United States citizen.

– where we tolerate reversing EPA standards, such that fossil fuel extractors no longer have to report or reduce methane emissions? Methane is 84 times more powerful at global warming than carbon dioxide.

– where picking fights with other countries is considered a good negotiating strategy?

– where a continuing presidential attack on freedom of the press is somehow held to be patriotic?

– where defying subpoenas is in any way a debatable thing?

– where arbitrary tariffs slapped on friends is tolerated?

– Where witnesses before Congressional committees can avoid testifying by claiming “absolute immunity,” an immunity that doesn’t exist in law?

This list could be far longer and likely you can add to it.

We’ve always had divided government, with impassioned politicians at times saying stupid stuff.* This isn’t about that. This is about the amazing reality that we got to the point where, for example, ripping babies from their mamas as a tool to discourage immigration is open for debate.

KEY POINT: Not one of the items on this list is a whine about Trump being crude, disrespectful, ignorant and an assault on decency. They aren’t even a complaint about his well over 10,000 lies since taking office. And every one of them has substantive impact on Americans – like you – and on our nation as a whole.

KEY OTHER POINT: It’s so very easy to pin all that on Trump, but he only has the power to do those things because of a supportive – or at least compliant – citizenry and, correspondingly, a meek and cowardly Republican Congress.

KEY QUESTION: In order to get out of this craziness we have to be able to both define it and identify what brought us here. What’s your notion? Post it in the Comments block and we’ll help one another learn.

FUN FACT: Roughly 63 million people voted for Trump (or they voted against Hillary) in 2016. On that same day, over 90 million voting age Americans stayed home.

FUN FACT QUESTION: Can you think of something you can do so there isn’t a repeat of that in 2020? I knew you could.

Late Addition

I’ve warned repeatedly (here and here, for example) that we are at risk of Donald Trump pulling a “wag the dog” scam to ensure he gets reelected. Now it appears that he’s doing it.

He has backed Iran into a corner with enough sanctions to hobble its economy and withdrawn from the JCPOA. Then Trump complained because Iran said that it would restart its uranium enrichment program, the very thing the JCPOA prevented.

So, he sent a carrier group and 2,500 troops to the area. Then on Thursday he ordered military strikes on Iran in response to Iran having downed a U.S. reconnaissance drone. He called off the attack before damage was done, claiming that killing 150 people with his attacks wouldn’t be a proportional response. We don’t know if that cancellation was actually just a stunt to make Trump seem to be a humanitarian, but since Trump is all about the theater of things, it very well could have been just that.

Recognize that Trump is constantly opaque in his dealings, leaving everyone wondering about his motives and goals, and almost certainly he sees the situation with Iran as a pissing contest that he has to win. A lot of his supporters like his kind of brainless muscular response, which drives the danger meter pointer closer to catastrophe.

You better make sure your senators and Congress people stand up to what looks like the newest Gulf of Tonkin fraud, or we’ll get involved in yet another unending middle east war and a lot of people will die.

*Stupid stuff is the blatantly obvious false or misleading statement. It’s the filibustering of a reporter to avoid his/her question. It’s the whataboutism that is designed to avoid having to deal with the truth or to denigrate an opponent. It’s the whole cloth fabrication that comes in a small throwaway line or a sweeping, dramatic denial of reality. Stupid stuff.

Focus

It’s been quite a month – all just this week! – as the outrageous deluge from 1600 Pennsylvania Avenue goes on. It’s been this way with Trump since way before the 2015 escalator “Look at ME!” stunt, when he announced with his customary ignorant certainty what he had just fabricated, claiming Mexico was sending us rapists and murderers.

He had spent years fomenting Birtherism. And he had bought the back page of section 1 of the New York Times and called for the execution of the Central Park Five. He did this after they had been cleared by DNA evidence. Yet in customary Trumpian doubling down of his boneheaded statements, he continued to call for the execution of these men.

Just this week Trump declared that he would/wouldn’t contact the FBI if a foreign government or individual offered dirt on a political opponent. For sure he’d “have a look,” he told us.

The point is that accepting anything even just to “have a look” is the crime, not the value of the information to a campaign. He also told us that Iran was behind the attack on two oil tankers, offering no evidence but his expansive declaration while ignoring evidence to the contrary. He took credit for various healthcare pluses, like reductions in the cost of prescription drugs, which hasn’t happened. All of that and far more was just Thursday and Friday.

The point is that Trump is the master of garnering attention by saying and doing outrageous things. He is the P. T. Barnum of our time.

We all love the sensational. It’s why the local news motto is “If it bleeds, it leads.” It’s why when you click on The Weather Channel you’re smacked in the face with multiple sensational pictures and headlines and it’s why supermarket tabloids sell.

We’re suckers for clickbait. Trump provides it 24/7 and the world watches. The trick is to ignore the merely outrageous and pay attention to the dangerous and the cruel:

– Like his saying it’s okay for political campaigns to accept anything of value from foreign sources. Yes, I know it’s just words, but this matters to our upcoming election, because it’s another “Russia, if you’re listening” invitation.

– Like fabricating a run up to war with Iran.

– Like putting yet more children in cages.

– Like defending Kellyanne Conway over her dozens of obvious violations of the Hatch Act – this because “she’s loyal.”

– Like ordering all agencies to cut scientific advisory boards by at least one-third.

– Like hosting a conference of climate science deniers at the Trump International Hotel.

I had breakfast recently with a couple of highly educated, highly accomplished women who each declared that they don’t watch the news. They are the latest in a continuing string of intelligent people I have heard say the same thing.

They are weary of the continuous barrage of political warfare and the painful to watch Trumpian cruelties and stupidities. They are way past overload from political bickering and lying, so they’ve tuned out. And that’s a problem for them and for America.

In some measure, many of us have become numb to the continuing outrage, which leaves us vulnerable to the dangerous things slipping past us.

This isn’t a circus freak show that we can ignore; it’s our country.

So our job is to let the outrageous and freaky stuff go. Focus on the things that can hurt us and damage our democracy.

Fake President – and Memorial Day

The Fake President Part

He says “fake news” daily, but it isn’t about fake news, as the president and his drones would have you believe. It never was. Same for his attacks on our other institutions.

They want you to believe whatever they say that effectively undermines our sharing of power – our democracy – and I can prove it with just a few things that happened last week.

From the AP:

“WASHINGTON (AP) — President Donald Trump on Thursday granted Attorney General William Barr new powers to review and potentially release classified information related to the origins of the Russia investigation, a move aimed at accelerating Barr’s inquiry into whether U.S. officials improperly surveilled Trump’s 2016 campaign.”

At root, this isn’t about an investigation. There is no improper surveillance or corrupt FBI, because investigating is what the FBI does – it’s in its name – and it’s what they do to identify and catch bad guys.

Recall that our nation was cyber-attacked by a hostile foreign power solely to benefit the candidacy of Donald Trump. We’d have to be idiots not to look into a possible conspiracy.

So, this new power to declassify that Trump has given to Barr (and which has never before been delegated by a president) is actually about giving Barr the power to selectively release documents, to dis-empower our intelligence agencies and invalidate conspiracy investigations. It’s about trying to make Trump’s election win appear to be earned, even as we all know it’s phony. It’s about making the FBI look corrupt. Doing so is an effort to sabotage public confidence in the FBI in particular and government in general. That’s what fascist autocrats do – they demean government so that citizen loyalty gets shifted to the leader. Buy and read this book and you’ll understand.

From the New York Times:

“WASHINGTON — Julian Assange, the WikiLeaks leader, has been indicted on 17 counts of violating the Espionage Act for his role in obtaining and publishing secret military and diplomatic documents in 2010, the Justice Department announced on Thursday — a novel case that raises profound First Amendment issues.”

The First Amendment ensures several rights and freedom of the press is one of them. It is the only thing that ensures public accountability of government officials. It is the primary bulwark against totalitarianism. And our president has thrown tantrums for years about our national press, demeaning it by calling it “fake news”. Now he’s trying to cut the legs out from under our investigative reporters.

Trump’s fake news charge isn’t about the accuracy of reporting and it isn’t made solely out of pique; it is made to decrease your confidence in the press, to make you so skeptical that you’ll only listen to one person: the president. That’s what fascist autocrats do – they demean the press so that citizen loyalty gets shifted to the leader. Buy and read this book and you’ll understand.

Trump has the distinction of having such a profound absence of good judgment, that he posted this video. It is a doctored video of Nancy Pelosi, clearly an attempt to make her look old, enfeebled, perhaps mentally challenged.

This video is so transparently altered that we have to wonder why the President of the United States would have anything to do with it.

His current spat with Nancy Pelosi can be reduced to its playground bully essence, “I’m rubber, you’re glue. Everything you say bounces off me and sticks to you.”

The real dynamic, though, is that Trump is trying to undermine your confidence in both the Speaker of the House and the entire Congress, leaving the president as the only one for citizens to follow. That’s what fascist autocrats do.

In contrast, here’s the truth.

The FBI and its over 35,000 people are dedicated to protecting us from bad guys. They put their lives on the line for us every day. They’re the real deal.

Our mainstream press is the real deal, too, as they dig to separate truth from propaganda and lies and hold government officials accountable.

Congress surely is more complicated, but it is the branch of government that most closely represents We The People.

Trump is working every day toward the goal of becoming an autocrat, a dictator, like his bromance buddy Vladimir Putin, whom he believes blindly and more so than our entire intelligence community. He is attempting to undermine the pillars of our government and of our democracy itself, leaving only him to follow.

Despite Donald Trump’s inane and self-important proclamations, there is no corrupt FBI or brain-addled Speaker of the House or fake news. There’s just a fake president.

The Memorial Day Part

This is Memorial Day weekend. Sadly, our president scheduled a trip to Japan. So, instead of visiting Arlington National Cemetery to lay a wreath at the tomb of the unknown soldier on Memorial Day as representative of all of us paying our respects, he’s going to have a press conference with Prime Minister Shinzō Abe.

You and I can do better than that.

This is the day we set aside to honor our war dead, those who, in Lincoln’s words, gave their last full measure of devotion. They are among the heroes who made it possible for us to live the lives we do, so it’s fitting that we honor them.

So, display your flag – half-mast until noon, then at the top for the rest of the day. Go to the ceremony in your town and remove your cap as the bugler plays Taps. Thank the veteran sitting next to you for having had his buddy’s back. Stand and be grateful to these people. We owe them more than we will ever be able to repay.

The Indispensable Nation

It’s time to take a break from talk of impeachment, contempt of Congess citations, subpoenas, obstruction of justice, picking a fight with Iran and the unending daily tsunami of outrageous behavior – not because those things aren’t important, but because there are other critically important things to consider that are easy to overlook because of our continuing self-inflicted reign of terror. A 50,000 foot view is one of those things.

George Packer wrote a piece for The Atlantic this month entitled “Elegy for the American Century: A report On The Decay of Pax Americana.” I confess that reading it brought into full light my ignorance of the complexities of the Balkan war, the complicated rivalries and borders, the centuries old grievances. More than that, though, it brought greater clarity to how we – the United States – have ceased to be the indispensable nation and have become globally unreliable.

– We now disrespect and even insult our allies

– We now embrace brutal dictators, the very people whom our allies worry about and because they have looked to us for leadership

– We renege on treaties and agreements

– We focus enmity on defenseless people

– We allow buffoonery to go unchecked, making us the object of international mockery and scorn

– We foment divisiveness and hate within our own country, showing people in other countries that we can’t be relied upon because we simply don’t have it together

The United States was the only major power with an intact industrial base following WW II and we created a new world order. The Soviet Union was our continuing enemy, but they could only affect world order through military oppression. We had the goods, as well as the strength to stand up to the bad guys and western democracy flourished. That’s all changed now, though, because we have told the world that we can no longer be counted on.

Angela Merkel just told Europeans that the post-war world order is over and called for Europe to stand up to China, Russia and the US! Something has radically changed and it very clearly isn’t for the better.

Below is an excerpt from Packer’s piece focusing on this very thing.

“If you ask me when America’s long decline began, I might point to 1998. We were flabby, smug, and self-absorbed. Imagine a president careless enough to stumble into his enemies’ trap and expend his power on a blue dress. Imagine a superpower so confident of perpetual peace and prosperity that it felt able to waste a whole year on Oval Office [sex]. Not even al-Qaeda, which blew up two American embassies in East Africa that August, could get our serious attention—Clinton’s response, a barrage of cruise missiles, was derided left and right for following the script of Wag the Dog. The Republicans decided that destroying the president was more urgent than the national interest, and they attacked his every move at home and abroad. Our leaders believed they had the luxury to start tearing one another apart, and they’ve never stopped. Did any country ever combine so much power with so little responsibility? Slowly, imperceptibly at first, we lost that essential faith in ourselves.

“The American century ended in Baghdad and Helmand, in Aleppo and Odessa, and in Beijing. It also ended in Wisconsin and in Silicon Valley and, maybe above all, in Washington, D.C. It ended from overreach and exhaustion, rising competition, the rapid changes and broken promises of globalization, and the failure of our own middle-class democracy, which, when it was thriving, gave us an influence that exceeded even our power.

“Another place where the American century ended was Bosnia.

Something about the people at Donald Trump’s rallies was deeply familiar to Aida—their clothes, their faces, their teeth, the men’s mustaches, the women’s hair and makeup, the illogic of their grievances, their rage, their need for an enemy .  .  .  Moments in the American campaign brought up uncanny counterparts from those years in the Balkans. Late one night, during the Republican National Convention, Aida suddenly heard the voices of 1 million Serbs in the streets of Belgrade shouting for the head of a Kosovar leader—“Arrest Vllasi! Arrest Vllasi!”—while Milošević cupped his ear and goaded them: “I can’t hear you!” In Cleveland they were chanting “Lock her up! Lock her up!”

“After the Cold War, grand strategists proposed various scenarios for the future of the world: liberal capitalist triumph, the clash of civilizations, great-power rivalry, borderless anarchy. Nationalism didn’t make the short list.

“The warlords turned out to be ahead of their time. Kurt Bassuener, an American expert on Bosnia, calls Trump “America’s first Balkan president.” His public performances sound like translations from the Serbian. For Aida, Trump’s rule told her that Bosnia no longer has anyone to count on. Europe ceased being a noble idea when populist demagogues put up razor-wire fences to keep out refugees. Now the American idea is gone, too. [Said Aida,] ‘After the United States’ values collapsed, who’s there to look up to?'” [all emphasis mine]

Pounding and Flip-Flopping

It’s a fundamental courtroom practice:

If the facts are on your side, pound on the facts.

If they aren’t on your side, pound on the law.

If the law isn’t on your side, pound on the table.

The House Judiciary Committee met last week to debate issuing a citation of contempt of Congress to Attorney General William Barr for his failure to produce an unredacted version of the Mueller Report and the underlying evidentiary materials, as well as for his failure to appear before the committee. Of course, the debate was bifurcated along party lines and what I found most interesting is what the Republicans did to make their case against contempt citations.

They brought up all manner of what they decried are unfair or unethical issues, including Hillary Clinton’s emails, FBI leadership, FBI spying and investigating (isn’t that what they’re supposed to do?), Barr’s courage to obey a law that actually doesn’t apply to the contempt of Congress issue, the Steele Dossier (none of which has been disproven), Christopher Steele’s having talked with Russians, various officials lying under oath, James Comey’s perfidy and other real or fantasy offenses.

NONE OF THAT HAS ANYTHING TO DO WITH WILLIAM BARR FAILING TO RESPOND TO CONGRESSIONAL SUBPOENAS. IT’S ALL WHATABOUTISM.

That’s what people do when they don’t have a leg to stand on.

Don’t let their passion or the intensity of their fatuous bloviating or the panoply of unrelated issues distract you. This is solely about obeying the law. That sounds very conservative, don’t you think? How come the Republicans don’t like it? Try this.

The Republican members of the House Judiciary Committee likely feel duty bound to protect the Republican administration, regardless of what some individuals in that administration have done. That’s one of the more odious parts of party politics and it’s one of the things that causes voters’ blood to boil or drives them to simply tune out, believing, “They’re all crooks.”

Here’s what’s at stake in this subpoena/contempt citation case:

The important thing: The oversight function of Congress is impossible to conduct without the necessary information. The purpose of a subpoena is to elicit that information from reluctant witnesses. Which is to say, it doesn’t matter whether the president or his lapdog attorney general like it; Barr has to obey the subpoena and the law in order for our system to work.

The critical thing: What is at stake is the rule of law itself! If Barr and Trump get away with refusing subpoenas, then our rule of law is finished. So is justice in America, because it will be clear that obeying the law no longer matters. Say hello to tyranny.

Here’s the current reality:

Those Republican committee members don’t have the facts on their side. Barr has plainly and obviously stonewalled his subpoenas. That’s a punishable no-no. So they can’t pound on the facts.

Those committee members also don’t have the law on their side. The law is clear that citizens must obey a subpoena. So, those representatives can’t pound on the law.

All they have left is pounding on the table. And that’s what they did during the House Judiciary Committee contempt citation hearings and what they’re doing still.

You can expect the same behavior from Republican senators if a resolution of impeachment arrives in their chamber. That’s pretty much what we saw during the blizzard of filibusters the Republicans mounted to fight anything Obama promoted. They didn’t have the facts and they didn’t have the law, so they pounded on the table.

Critical note to Democrats: if positions were reversed, we’d see the same behavior from Congressional Democrats, although they’d probably smile more and be ever-so empathetic. Nevertheless, forget about feeling smug and disdainful about the other guys. This is party politics S.O.P.

Impeachment update  .  .  .

In 2017 I had the simple clarity that Trump should be impeached because he is a criminal, that he’s obviously guilty of violating the Emoluments Clause, obstruction of justice and possibly of treason for conspiracy with the Russians and for his refusal to take any action to prevent ongoing attacks by Russia. Then I considered what a President Pence might do and I wasn’t so sure that impeachment was best.

The first thing Pence would do is pull a Gerald Ford and pardon Trump and his entire crime family for felonies they have or may have committed. It’s unthinkable that they might get away with their self-aggrandizing criminality, so I changed my mind on impeachment. Now, though, there’s another worry.

Trump has started a march to war with Iran. Separating out his wag-the-dog gambit, starting that war will result in a lot of people dying and suffering and it likely will be a war that will last for many years, just like those in Iraq and Afghanistan, because there’s no way out. It appears that the only way to prevent that is to remove Trump from office before he can fire the first shot. That calls for impeachment, so back we go.

One price of doing that, though, is the probability of angering a lot of Americans who will see Trump as a victim and will vote in a Congress that might continue to dismantle the things we care about, a Congress which will deny climate warming. They will continue the assault on Roe v. Wade, on voting rights and will enact yet more wealth inequality measures. All of that and more are existential threats to liberal democracy and to our entire planet. That price is so large that it augers for leaving Trump in office until the end of his term in order to prevent a backlash Congress, even knowing that he will issue anticipatory pardons to all his co-conspirators.

Yes, I realize that I’m flip-flopping on the issue of impeachment and I don’t like it any more than you do.

This impeachment business is more complicated and has more consequences than I want it to have. I believe in the rule of law and apologize not one bit for being a Boy Scout about my horror over the assault on our moral character that we continue to endure.  But frustrating as it would be to refrain from stopping the subversive criminal in the Oval Office, preempting Trump with impeachment might do more harm than good. Clearly, this is a hold your nose moment in American history.

Danger From All Directions

Here are some news chunks that at first may seem to be unrelated, yet they really are connected.

“The FDA won’t ban a type of breast implant that has been linked to cancer, the agency announced Thursday. Textured breast implants have been tied to a form of cancer known as anaplastic large-cell lymphoma and have been banned in many other countries.”

“A Kaiser Family Foundation poll of 1,200 adults finds that a majority do not favor the Trump administration’s proposed changes [drastic cuts] to Title X, the program that provides funding for family planning and other services to low-income people.”

“He lied to Congress. He lied to Congress… If anybody else did that, it would be considered a crime. Nobody is above the law — not the president of the United States, not the attorney general.”

“Speaker Nancy Pelosi blasted Attorney General William Barr at a press conference Thursday, saying that part of previous testimony Barr gave Congress on April 9th was a lie. The attorney general then denied knowledge of concerns raised by Special Counsel Robert Mueller’s team over Barr’s four-page summary of the Mueller report. By March 28, Barr had already received a formal letter from Mueller that conveyed the special counsel’s concerns and spoken with him about it over the phone.”

It’s the “emBARRassment” of Barr. Thanks AS for that.

“Trump at war with Democrats: ‘We’re fighting all the subpoenas’

“Washington (CNN)President Donald Trump vowed on Wednesday to fight “all the subpoenas” issued by House Democrats investigating his administration, reinforcing his administration’s increasingly combative posture toward congressional oversight.”

Trump-Putin (Again): President Donald Trump said he discussed Special Counsel Robert Mueller’s report with Russian President Vladimir Putin in an hour-long phone call today. However, Trump says he didn’t warn Putin not to meddle in the upcoming 2020 elections: “We didn’t discuss that,” he told reporters.

On a small stage these can be seen as disconnected actions of the incompetent. With a wider focus, these can be seen as manifestations of a continuing Trump-led national march to authoritarianism and the formal abandonment of We the People. These are actions both small and large that undermine our rights, our safety, our security, our freedom and democracy itself, while at the same time aggregating power to Trump, he who cannot be indicted for his crimes.

Further, that inevitably leads to our loss of leadership in the world – it’s already happening – which will further undermine our security. Read the piece in The Atlantic by Rep. Adam Schiff (D-CA) to get a perspective on the extensive and self-destructive reach of authoritarianism that is upending the hard-won battles, both in war and in debate, the work to build democracy.

The task before us right now is the same task that President Lincoln set before the nation in closing his remarks at Gettysburg on November 19, 1863:

“It is rather for us to be here dedicated to the great task remaining before us — that from these honored dead we take increased devotion to that cause for which they gave the last full measure of devotion — that we here highly resolve that these dead shall not have died in vain — that this nation, under God, shall have a new birth of freedom — and that government of the people, by the people, for the people, shall not perish from the earth.“

Were the 51,112 casualties at Gettysburg for nothing?

We are faced with that same question about the hundreds of thousands who have died and the millions who suffered in all of our conflicts in order to protect our democracy. Because if we now allow authoritarianism to undermine what we declare we hold dear, then we will have betrayed them and they will have suffered and died in vain. And government of the people, by the people and for the people will perish from the earth.

It’s time to see what is happening right in front of our eyes. That it is not masked doesn’t make it any less dangerous and it is just as disloyal to our country. Metaphorically, it doesn’t matter if you saw the poisonous snake before it bit you. You’re dying just the same.

It falls to us to keep faith with those who have protected our democracy. This is our time to rally to Lincoln’s call. Read his words again and let them seep into your bones.

Your Lyin’ Eyes and Impeachment

The Mueller Report is out and I haven’t had time to go through all 448 pages, although you can do that yourself by getting the PDF from the DOJ website here. Click on the 4th line beginning “Report on the Investigation” for the download. Or if you prefer you can get an indexed and searchable version here.

There is big stuff in that report, including that the lack of indictments of the president is due to the Justice Department guideline that a sitting president can’t be indicted. Also, because so many documents were destroyed by various perps.

Nevertheless, Mueller let us know that he was unable to declare that the President of the United States isn’t a criminal. Stunning! My more chilling takeaway, though, is about Attorney General William Barr.

Barr was promoted as a legal institutionalist, even after his unsolicited, 19-page job application that made it clear that he believed that, metaphorically speaking, a president really could get away with shooting someone on 5th Avenue. That view works for Trump and Barr got the attorney general post.

In each of his public appearances and writings as attorney general, Barr has gone out of his way to exonerate the president. His rhetoric vacillates between cherry-picked, out of context phrases to outright lies all in favor of President Trump. Did he think we wouldn’t notice? In listening to Barr I’m reminded of comedian Richard Pryor’s line, “Who you gonna believe: me or your lyin’ eyes?”

The scary part is that Barr sounds like the president’s defense counsel, instead of the attorney for the Constitution of the United States of America.

In his piece in New York Magazine entitled, “Congress Should Impeach William Barr,” Jonathan Chait wrote,

“The Justice Department is an awesome force that holds the power to enable the ruling party to commit crimes with impunity .  .  .”

We should have seen this coming.

Barr is the former attorney general for President George H.W. Bush. Barr recommended to Bush that he pardon the convicted Iran-Contra felons. Click through the link and scroll down to the Indictments section and you’ll see that these guys did a lot of really bad things, including thwarting the explicit will of Congress. You need to appreciate how significant that is.

Doing that is an attack on Congress itself, and it encourages an imperial presidency. William Barr cemented that by recommending those pardons. And now he’s defending this power grabbing, dictator wanna-be president.

If Barr is an institutionalist, exactly what institution does he serve?

And another thing .  .  .

Now that most of the Mueller Report is released, the talk of impeachment is spiraling upward. I’ve long called for the removal of this cheating, lying, fraudulent, self-aggrandizing, democracy damaging president, but now I have significant doubt about that notion.

President Gerald Ford set a woeful precedent by granting, “.  .  .   a full, free and absolute pardon unto Richard Nixon for all offenses against the United States which he, Richard Nixon, has committed or may have committed or taken part in .  .  .” Nixon got a free pass for his criminal wrongdoing and wasn’t held accountable in any way.

That is the precedent that Mike Pence will inherit should he become President. That means that our criminal president will likely be pardoned for any and all crimes which he may have committed (think: conspiring with the Russians to disrupt our 2016 election, obstruction of justice; money laundering; and fraud).

Further, if Trump were to be impeached, whether convicted in the Senate or not, he and the Republicans will wail about him being a poor victim, suffering unfair discrimination by the evil Democrats and the Washington swamp. That could lead to another Republican in the White House in 2021 and a Congress controlled by the same spineless legislators who are enabling Trump right now.

The solution that makes the most sense to me is to Benghazi Trump: just keep his wrongdoing in the public eye through November 3, 2020 with ongoing Congressional hearings.

I often have difficulty rationalizing the impact of the bypassing of punishment for wrongdoing in favor of some greater good, but this one looks obvious enough even for me.

No impeachment.
