It Begs the Question

The first real test of the [National Voter Rights Act of 1993] came in 2018, when Ohio’s Republican Secretary of State, John Husted, went on a voter-purge binge (that hit Black, student and elderly neighborhoods particularly hard) and was sued by the A. Phillip Randolph Institute for violating Ohio citizens’ right to vote.

In a bitter 5-4 decision, the conservative majority ruled in Husted v Randolph that purging voters because they failed to return a junk-mail-like postcard was entirely legal.

It’s a practice once called “caging” back when Karl Rove’s guy [George W. Bush] was allegedly doing it and it was illegal but that has, since that Court ruling, spread to pretty much every Republican-controlled state in the nation.

Justice Alito’s decision was particularly biting, asserting that the arguments made by the citizens who’d lost their right to vote were “worse than superfluous” and their argument that they shouldn’t have to regularly check  in with the Secretary of State’s office to stay on the voter rolls represented logic “no sensible person” could agree with.

Justice Alito’s comments fly in the face of the multiple declarations of the right to vote prominently displayed in the Constitution. That document doesn’t say anything about the need to send in a post card or “check in” with any government or agency in order to retain the right to vote. We just have to be citizens.

If Alito wants autocracy, minority rule and race and class oppression, he might consider moving to another country with just such a foundation. Maybe I missed something, but I thought that all justices took an oath to the Constitution of this country.

In acting to suppress the right of citizens to vote, Alito pushed back on democracy itself. Given that Alito’s Supreme Court vote and his comments are in opposition to both the Constitution and democracy, it begs the question of why he’s on the Supreme Court.

It Says Hope, But It Isn’t

The State of Florida continues on its path to become the place most intentionally disinterested in the welfare of its citizens. In the face of stiff competition from Texas, Arizona and several other states, Florida has codified its refusal to allow schools to protect students from Covid-19 and its variants by issuing an Emergency Rule.* Please download it. You’ll be amazed at the lengths to which the Florida Board of Education goes and the tortured un-reason it uses to attempt to make their prohibition of mask mandates sound like they’re delivering safety from this deadly virus.

Their logic is forehead-slappingly illogical, sort of like saying they are promoting good by ensuring bad.

Almost as shocking is that the state’s Board of Education offers an alternative to mask mandates. It invites students and public money to go to private schools. This smells very bad, like the public schools in the south in the 1950s and 60s that suffered because white students left for private, expensive (read: segregated) schools, as did the public money for education, leaving nearly nothing for Black kids.

And the Florida Board of Education is doing this under the banner “Hope.”

Here’s a startling headline from the Tallahassee Democrat on August 9 showing DeSantis’ disregard for Floridians:

I have no clue how that could be legal. It’s much like Texas Governor Greg Abbott declaring that he’s going to arrest the Democratic legislators who left the state to prevent horrid voter suppression laws from being enacted. He proudly boasted that he would arrest and hold these Democrats in the state capitol building In Austin for the duration of the special legislative session. That’s quite a statement from the Texas Governor, in that the Democrats have broken no laws and he has no power to incarcerate them in the capitol building or anywhere else.

Note that both of these governors are threatening opponents with exactly the same kind of king-of-the-hill bravado as despots and cruel dictators who imprison political opponents (think: Putin in Russia; Orbán in Hungary; Xi in China). The same goes for all the rest of the “I’ll show you!” tough guy governors and legislators. Tough guy stuff plays well with the alt-right, the MAGA hat wearers. Normally, that’s a “who-cares?” but in the face of Covid and civil unrest, it’s deadly.

Expect stupid litigation to follow DeSantis’ tough guy announcement. The reason that’s important is that we have an epidemic of people in power doing similarly anti-welfare-of-the-people things, as well as taking anti-democracy shots.

This Florida Board of Education Emergency Rule and DeSantis’ threat of withholding educators’ salaries are just the most recent actions that beg the question of why Gov. Ron DeSantis has been allowed to be anywhere near public office.

While DeSantis is the poster boy for selfishly bad governing, for our purposes he is a placeholder for all the governors, legislators and bloviators who chest thump and try to position themselves for more MAGA votes, even at the cost of the health and the lives of our fellow citizens. Future generations will look at our time with puzzlement and derision, because we voted for this. And that begs yet more questions.

Actual Hope

Dr. Chad Gestson, Supt. Phoenix Union High School District

A refreshing contrast to knuckle dragging governors like DeSantis and Abbott is Dr. Chad Gestson, Superintendent of the Phoenix Union High School District in Phoenix, AZ, with 32,000 students. He is a profile in courage, defying Gov. Doug Ducey’s “no mask mandates” order by requiring masks for students, teachers and staff in his schools. Apparently, the superintendent thinks the health of everyone in his schools is really important, a concept not comprehensible by certain elected officials.

What’s truly, self-destructively weird is that a teacher in his district is suing Gestson over his mask mandate, claiming it’s an infringement of his freedom to become infected, then infect others and finally to gasp and die (the sarcasm is mine – JA). Nevertheless, Gestson is standing strong. I bet he’d appreciate a note of support from you. [email protected]

Meanwhile, the Florida Board Of Education Emergency Rule, the various governors’ no-mask-mandate orders and the teacher’s lawsuit all beg the question of when self-serving temper tantrums replaced good sense.

What has happened to us and why did we let this craziness happen?

Where did our sense of civic duty go?

What happened to our caring for one another?

How did so many of us become so shockingly angry that our good sense has left us?

Why are we rationalizing so much avoidable suffering and death?

Why aren’t we shocked by a Covid death equivalent of the crash of a jumbo jet every day?

It begs these questions and so many more.

STATUS ALERT!

This is a proud JaxPolitix moment, as we have officially received our first vile, disgusting and politically inane troll message.

It started decades ago, but that was just laying the ground work for what has now happened. We pick up the story in the recent past.

When President Obama and his Justice Department decided not to prosecute for the torturing of prisoners done by the CIA or pursue the higher-ups who okayed and directed torture during the Bush II wars in Iraq and Afghanistan, something profound happened.

Obama avoided dispiriting and alienating the CIA. He avoided giving the far right lunatics an easy launch point for an all out assault on him. He prevented the law and order muscleheads from using their self-certain, righteous indignation to attack his administration. All that and more was true and accurate and it completely misses the most important and self-destructive point.

In refusing to prosecute obvious criminal behavior, Obama and his Justice Department became complicit in those crimes. Their hands were as dirty as those of the torturers and George W. Bush, his Attorney General Alberto Gonzalez and his law twisting accomplice, John Yoo, he of the “Torture Memo.” That memo gave cover for the U.S. to violate all the Geneva Conventions against torture of enemy combatants, the U.S. Constitution and our own Military Code of Conduct. That was a dozen years ago, but don’t imagine that kind of complicity is all in the past, because it’s happening right now.

Trump’s wrongdoing has been on public display for over four years and the list of his corruptions is so long that you may be forgiven for having forgotten most of it.

He started with various versions of his Muslim ban. Then he ripped babies from their mothers’ arms at our southern border. The Mueller Report lists at least 10 prosecutable instances of Trump’s obstruction of justice (see Section 2). He orchestrated his people to refuse subpoenas to testify at the impeachment hearings. He attempted bribery of the President of Ukraine. He led a conspiracy to defraud the United States in Post Office-gate. And there are all those campaign finance violations, multiple violations of the Hatch Act, federal tax fraud, violations of the Voting Rights Act and more. And President Biden and his Justice Department are doing nothing about any of it. They are even defending Trump against the defamation lawsuit filed against him by E. Jean Carroll.

When we look to the Democrats to restore norms, to play by the written rules and the spirit of those rules we are fooling ourselves, because their refusal to hold Republicans’ feet to the fire makes them complicit in their crimes. They’re colluding with the perps because they don’t have the political courage to do what needs to be done. What is even more frightening is that today’s Republican crimes are focused on destroying our democracy. And this is set up to get worse.

Trump is a buffoon, a carnival sideshow barker who’s good at fooling the rubes. That’s us. That his blatantly phony “stop the steal” campaign still has breath only means that those who want to be angry and vent their rage with violence feel justified. “Trump sent me,” is what they told us on January 6. But Trump will at last go away. What will not go away are those who would continue the attack on our democracy, the dismantling of what we say we hold dear.

The next megalomaniac won’t be a buffoon. The next guy – it won’t be a woman because these people are all about white male supremacy – will be smart and smooth and won’t make Trump’s stupid mistakes. The next guy will end our democracy because we will have refused to hold people accountable. We will have failed to protect and defend the Constitution against all enemies, both foreign and domestic. The Republicans will end our republic. Read Dahlia Lithwick’s piece in Slate, The Price of No Consequences for Trump.

There’s another chapter to this story.

We fought the Korean War in the same way we fought WW II, which made sense, in that we fought against a nation state backed by another nation state, both with standing armies. It was our uniforms versus theirs. But then Viet Nam came along, a guerilla civil war, peasant-versus-peasant, and our WW II tactics were all wrong. We intervened completely unprepared to fight such a war and the result was a disaster. We fought the last war instead of the present war.

And that is what Democrats are doing in Congress.

The Republicans are fighting a guerilla war, ignoring precedent, norms, the intent of the Constitution and even basic morality in order to gain power. The Democrats are using quaint, gentlemanly tactics, singing paeans to bipartisanship and are somehow surprised when they get steamrolled yet again.

That’s going to continue to happen (thanks, JN for the link), as we experience what President Biden has called “Jim Crow on steroids” and Republicans – Americans, mind you – eliminate majority rule, wipe out free, fair elections and they disempower the electorate. They’re conspiring to determine election results by fiat – their fiat –  instead of by the will of the people. That’s subversion. And they continue their anti-democratic march without being held to account and with just a limp-wristed fight by Democrats.

As Charles Blow put it, I’m, “not consumed by romantic, hagiographic* illusions of yesteryear,” nor should any of us be. There are literally millions of Americans who would crush our democracy right now and that’s what we must deal with.

In a recent Pew Research Center survey, “Two-thirds of Republicans and Republican leaners say voting is a privilege that can be limited .  .  .  compared with about half as many (32%) who say it is a fundamental right.” Even 21% of Democrats think voting isn’t a right. That’s neither liberal nor conservative ideology. It’s fascist. Pay no attention to the words of the Constitution. Nothing to see there. Move along.

So, good-bye, America. We loved you dearly and believed in you for a long time, but it’s almost over now because we let it be over.

Golden Calf


Trump’s endless string of lies at the July 2021 CPAC convention was not just boring; it was old news boring. New day, same old lies.

On the other hand, his supplicants applauded and made the proper guttural noises for him in response to his calls for adulation. They did the same for the rest of the lying and outraged victim presenters. All of that, though, was secondary to the February CPAC supplication.

That’s when the circle became complete, with people literally bowing down to an actual golden image of Trump. It is the ultimate Golden Calf of our time, today’s version of the biblical tale, this time focusing on our very own political debauchery and wilful human debasement.

The Evangelicals sold out for a promise of ending Roe, seating extreme conservative judges and having marriage strictly defined as between one man and one woman. They slimed their souls by tolerating the lying, cheating and moral degradation they actually got, and they did it with their eyes wide open. The irony for Evangelicals is just too crazy.

The White supremacists and hate groups sold out our country in the hope of moving their hate show to the main stage. They got that, and now everyone is clear that the haters are the real victims, poor babies, that it’s good and right to suppress the lowly “others” and that the haters are the meanest badasses in the country. In support of their sell out of our country and their beating of cops as they waved Blue Lives Matter flags is a human hot air balloon encouraging their wreaking national carnage.

The rest sold out for flimsier reasons, like, “I’ve always voted Republican and could never vote for a Democrat.”

And now all the sellouts have their very own golden idol to worship. Millions voted for him and continue to chant, “Stop the steal!”

So do the Republicans in Congress, even the ones who at first finger-shamed and blamed Trump for his January 6 treachery. But then they chickened out. Back pedaled. Re-instituted their sucking up. Revved up their inner jelly fish and puckered their lips to match Trump’s ass.

They lie about everything that isn’t self-serving and, most awful, are trying to whitewash the insurrection against our country, even as they know that doing so is the path to the destruction of our democracy. That’s what passes for the Republican Party today.

The Tiananmen Square student protests of 2001 in Beijing were an illustration of the constant human struggle for freedom, this time played out on the world stage. It was also a demonstration of the unbridled lengths to which those in power will go to crush opposition.

That’s what autocracies do.

As those bloody events unfolded, one student summoned the courage to stand in front of army tanks and speak truth to power. He would not be silenced by the brutality of leadership. He would not allow the lies and cruelty to go unnamed.

We’re still looking for Republicans with that same kind of courage. Okay, I’ll give you Liz Cheney and Adam Kinzinger. That’s two Republicans out of 263. Name another.

Strangely, we humans love to keep doing the same thing and then expect different results, but there are consequences to Einsteinian insanity. It’s time for Democrats to figure out that their opponents have been playing by different and draconian rules for decades, which is why Democrats have been overpowered in most state houses and governorships and manipulated into insignificance in Congress.

Play offense on legislation, focus on message discipline about “Delivering” Democratic solutions for American families, and employ similar discipline in defining R’s as “For Q and Not for You!”

Democrats, the traditionally tongue-tied, slogan challenged, inept communicators, better figure out a smarter, more effective way fast, because terrible Republican stuff is afoot.

I don’t anticipate divine intervention to halt Republican Golden Calf prostration and the killing of democracy it can cause, but there was that one time at the foot of Mt. Sinai  .  .  .

I’ve written many times to and about our vaccine refuseniks. I’ve answered their reasonable concerns, offered doses of truth to counter the disinformation and propaganda they’ve been fed, used patriotic duty persuasion, offered snarky comments and ridicule and I’ve also washed my hands of them. Still, they insist upon endangering themselves and others, especially our first responders who have to risk their own lives to treat them in hospitals. Many still proudly declare their right to be stupid and die, which they are doing at the rate of about 260 per day.

(Darwin Awards alert: We have some solid contenders in this bunch.)

I’ve come to the point where it’s clear that Emmanuel Macron, President of France, has it right. Read his comments that start this edition of The Markin Report. Then read the rest of the report. It’s time for plain talk, setting limits and accountability. The reason it’s time is because this is an immediate life and death issue that is on the way to becoming far more threatening.

Tennessee Update

As reported here, the Great State of Tennessee proudly announced its cancellation of all outreach to promote all vaccines for kids. Not just Covid; all vaccines. As reported by The Tennessean, after receiving pressure from national condemnation of that decision, Gov. Lee announced a reversal, with the exception of continuing to refuse to use social media to reach teens, where they might actually be able to connect with them and encourage them to be protected. Apparently, they’ve also decided not to eliminate the Tennessee Department of Health, which they had threatened to do.

The Covid vaccination rate in Tennessee is just 39% and new cases of Covid have quintupled in the past month. There is no word on whether they will attempt to rehire Michelle Fiscus, the state’s former top vaccine official, whom they fired when they caved to GOP pressure and had their health damning fit of insanity on July 13.

Bear in mind that Tennessee is the state that proudly attacked and denied science in the Scopes Monkey Trial in 1925.

What’s Going On?


First, Something Personal

Parkinson’s Disease is a miserable critter. It strikes famous people like Michael J. Fox, Linda Ronstadt and Neil Diamond and it hits we little folk as well. Nobody knows what causes it, so nobody knows how to prevent it. It’s progressive (it gets worse over time), so all that can be done now for those stricken with Parkinson’s is to manage symptoms. There’s no cure – yet.

There are ongoing medical trials and much research happening, so hope continues, The research and trials take a long time and are very expensive. That’s why son Scott and Wendy and the boys have dedicated their hike of the John Muir Trail this month to raising money for the cause. If you click on their picture you’ll find a donation page for The Michael J. Fox Foundation for Parkinson’s Research. Your joining in this battle in any amount will be greatly appreciated by my family, others who suffer from this disease now and for the millions in the future who will have more hope because of your help. Thanks.

Now, On To What’s Going On

I reported last Wednesday about the State of Texas proudly committing itself to denial of facts and reality and ever more firmly embracing Texas myths. The governor himself tweeted proudly that Texas children should be taught that those who died at the Alamo are heroes. No facts need be presented to impressionable minds about the real motivation of these men to fight. We wouldn’t want them to learn that Mexico prohibited slavery, so the actual (not mythical) truth about the battle at the Alamo was that Texas independence from Mexico meant free labor in Texas cotton fields.

And that’s why Texans wanted independence from Mexico. Now I get it!

But Governor Greg Abbott doesn’t want Texas school children to get it, so he’s stifling education. Pay no attention to the fact that those heroes were only heroes to slave owners. Ignore that this is the state that took two extra years to tell its slaves that they were free. Nothing to see here. Move along.

The governor also doesn’t want to allow today’s Texans to be free. He’s promised to arrest all the Democratic state legislators who left Texas to prevent a vote on his draconian voter suppression laws. There is no law that those Democrats have violated by leaving the state, but Abbott wants to arrest them anyway. He intends to incarcerate them in the state Capitol Building until the end of this special session of the legislature.

And he did more.

Abbott dictatorially vetoed funding for the legislature the first time Democrats fled his inquisition to prevent his voter suppression from becoming law. That stiffing of legislators is being challenged in court, but what can’t be challenged is that Abbott is a dictator wannabe. He thinks he’s a candidate for the presidency in 2024. If so, he’s heading the Anti-Democracy ticket.

This was part of the TN Department Of Health Covid vaccine promotion. It’s gone now.

“The Tennessee Department of Health will halt all adolescent vaccine outreach – not just for coronavirus, but for all diseases – amid pressure from Republican state lawmakers,” reports the Tennessean. The geniuses in the state legislature are also stopping all Covid-19 vaccine events on school property. Plus they’re ending mailed vaccination reminders to teens. All that and only 38% of Tennesseans have been vaccinated. What could possibly go wrong?

Oh, and they also fired Michelle Fiscus, the state’s top vaccination official. The hollow heads in Nashville are even talking about eliminating the state Department of Health altogether. Yes, really.

Halting outreach for ALL vaccines means that the State of Tennessee is now allowing – even encouraging – the elimination of vaccines for measles, chicken pox, smallpox, hepatitis, diphtheria, whooping cough, tetanus, polio, HPV  and more. Who cares about epidemics that maim and kill children? Apparently, not the Republicans in the Tennessee state house and in the governor’s mansion.*

Perhaps they think we should revert to the medicine practices of hundreds of years ago, like leeches, blood letting, driving out evil spirits and purification by fire. Remember, this is the state that refused to allow children to be taught evolution. It looks like they’re on the way back there again. Maybe they can burn some witches and thereby Make America Great Again.

As reported last Wednesday, the new members of the library board in Niles, IL want to cut back hours, programs and pay for librarians by 23%. I guess the Enlightenment is so far back in our rear view mirror that we can now ignore its teachings and proudly go back to mass ignorance. Maybe the new library trustees will burn books and smash printing presses. Then they can cut the library budget by 100%.

Tying It Together

All of this is being led by Republicans, who seem to be engaged in a frantic race for us to become mentally medieval. They are appealing to our most base animal instincts and would dumb us down to pounding drums in the forest. At the same time, they are scrambling for power in the most dishonest, anti-democracy ways possible. Here’s what happens when we put those two things together.

We get minority rule by autocrats – despots – dictators – leading an ignorant, uniformed public that can be manipulated into anything. We get theocracy and all its vile perversions, cruelties and suppression and a complete elimination of freedom. There has never been a theocracy that did not devolve into that and we have no reason to believe anything different will happen if the bible thumping, chest pounding, democracy smashing Republicans get their way.

Be clear that this isn’t about conservatism. There is nothing that today’s Republicans are doing that is even remotely conservative. They are anti-democracy radicals.

The actions in Texas and Tennessee and Niles, as well as children having been ripped from the arms of their parents at our southern border by the prior administration look cruel because they are, but John Pavlovitz cautions us that cruelty isn’t the point. Power is. And when some are grabbing and hoarding power, others are losing power. Others like us. Read David Frum’s Atlantic essay, There’s a Word for What Trumpism Is becoming.

The Founders didn’t have in mind that We the People should be ignorant peons enslaved by a cruel autocrat. Those conditions are exactly what led to our revolution. I sure as hell know those conditions are not what I have in mind for us and our country.

* I recently had a nightmare about Nazis. Being an early Boomer I was raised in the aftermath of WW II when Nazi atrocities, the capture of Adolph Eichmann and so much more were commonly discussed. It’s likely I’m not alone in occasional recollections or even nightmares of those things. When I awoke I wondered if people born, say, 20 years after me – the late Boomers and those born after them – have such dreams. It’s probable they have no memories of talk of Nazi terror during their childhoods.

That’s a kid’s head poking out of that machine – an “iron lung”. It’s doing his breathing for him, because he can’t breath on his own. This was a common sight in the 1950s during that awful polio epidemic. I wonder if that kid survived.

Then my head scratching latched onto the Tennessee Republicans and their actions to cripple medical protection for children. I’m guessing that these politicians are young enough to have no memory of children in iron lung machines, measles epidemics, whooping cough ravaging the nation and the rest. Perhaps the same can be said for our Covid-19 vaccination refusers who simply refuse to understand.

They can “OK, Boomer” all they want, but there is so much being done in our country that suggests that we’ve lost individual and collective memory of enormous suffering and death. It seems that all that is left is a knee-jerk reaction to any public policy that contacts rugged individual freedom. And it seems they now want to force their automatic rejections onto helpless others – children.

Very strange. And very dangerous.

Proper Names

Trump has gotten away with an enormous dung heap of wrongdoing. One of the reasons for his constantly skating from accountability is that before anyone can pin up his picture in the post office he’s done something else outrageous and likely illegal, so our attention is thus diverted and “poof!” goes the prior malfeasance.

Now we’ve found that he directed OUR Justice Department to snoop on Democrats and major news organizations. Under both of his Attorneys General, Sessions and Barr, investigations were conducted on those whom Trump saw as opponents. Emails and phone records were snatched and gag orders were issued so that Trump could dig for dirt on Eric Swalwell, Adam Schiff, their staffs, their families, The New York Times, The Washington Post, CNN, their reporters, someone’s underage kid and whoever else the Tantrum Tyrant wanted investigated. All are Democrats. Except for the president’s own lawyer, Don McGahn and his wife, on whom he also snooped.

Tweeted Jennifer Rubin of The Washington Post, “[G]ood God, they were running a police state. Barr needs to be hauled in and at the very least disbarred.” She’s right, and it shouldn’t stop with Bad Boy Barr.

This is truly horrible stuff, typical of Trump’s moral bankruptcy. It breaks yet more norms that are fundamental to a democracy. But what I have not heard yet are words like “illegal” or “felony” or even “misdemeanor.” Is anyone going to dig into these corrupt actions and bring charges?

So far we’ve seen nothing from Biden’s Attorney General Merrick Garland to indicate that he’s willing to bring wrongdoers to justice if they were a part of the prior administration. And what will happen  to the focus of the public, our news organizations and Congress when the next bright, shiny object of Trump’s unscrupulous weaseling is dangled before our eyes? How many prior wrongdoings will we forget?

The Biden administration is a mixed bag of resetting our values. It is blocking Congress in its efforts to unearth Trump’s manipulations to enrich himself at the Trump International Hotel, the DC facility he leased from the federal government. Biden’s Justice Department is asking the judge to dismiss lawsuits against Trump for violently clearing Lafayette Park of peaceful protesters. AG Garland is continuing what the former AG did to block the defamation lawsuit brought by E. Jean Carroll. One has to wonder why Biden would want to protect Trump from litigation.

This has huge implications for the future of our country. Allowing people in high office – like the President – to “get away with shooting someone on 5th Avenue,” like Nixon getting pardoned by Ford, like Reagan getting a pass on Iran-Contra, like Trump getting away with breathing while in office, which meant that he was doing something illegal, assures that future presidents will commit crimes, knowing that they will get away with them. They’ll leave office, skate free and recast themselves as statesmen, while We the People remain betrayed.

Do you want this to be a democracy? If so, then there’s a lot of bad news for you now, like this from Jewish Dems:

American democracy is in danger. Over half of Republicans believe the 2020 election was stolen because GOP leaders continue to exploit Donald Trump’s Big Lie, and they are now using it as an excuse to suppress the right to vote. Fourteen states have already enacted 22 voter suppression laws making it harder to vote, and hundreds more have been proposed. New data shows that voter suppression laws enacted in Georgia will have a disproportionate impact on Black voters.

Today’s Republicans have no interest in facts, truth, reality or integrity. They are solely interested in power and money. So, they recast the January 6 insurrection, the assault on our democracy, on the Capitol Police and on that symbolic building as (take your pick):

– a normal gathering of tourists

– a peaceful protest

– justifiable actions because the election had been stolen by (impossible to find) fraudulent votes

– something in the past – we should move on

And the lack of Republicans’ interest in facts, truth, reality or integrity allows them to claim they are protecting our national honor and the integrity of our elections, even as they viciously attack both.

Just be clear that your eyes tell you what you need to know and that “alternative facts” are just a rebranding of lying. But those who wallow in the pig slop of alternative facts have legislative power in two-thirds of the states and they are engineering voter suppression of such magnitude that they may well achieve anti-democracy minority rule that will last for decades. That’s insurrection without the street mobs.

From Confucius:

“The beginning of wisdom is to call things by their proper name.”

Mobs in the streets, mobs in the state legislatures and the elected Republican mob in the Capitol Building are all insurrectionists. Call them by their proper name.

Our democracy is already compromised and so far there hasn’t been even a hint of a light at the end of our long, dark insurrection tunnel. It’s time for Merrick Garland to break from the cowardly Justice Department he inherited and file five indictments against Trump for obstruction of justice. The details and the prosecutorial roadmap are all in Mueller’s report. Click here for a copy and focus on Section 2.

Now here are those promised rays of sunshine.

Last Friday Attorney General Merrick Garland addressed the entire Justice Department Civil Rights Division to drive a stake in the ground for voting rights. Here is some of what he declared:

  1. Because this is a huge battle, he will double the number of lawyers in the Civil Rights Division specifically in order to protect voting rights.
  2. The Criminal Division will prosecute all violations of civil rights laws.
  3. All lawful citizens will have the right to vote, will have equal access to the polls, their votes will be counted, they will have access to voting registration and they will be protected from voter intimidation.
  4. Early voting and voting by mail will be protected, as will the post-election integrity of ballots. (Arizona Republicans, brace yourselves.)
  5. Voting officials, poll workers and volunteers will be protected from efforts to intimidate them.

Just brave words so far, but it’s a good start. At last we have a warrior for democracy with the muscle to do something about it. And we have to hold him to his word.

Garland ended his presentation by quoting from John Lewis’ final address published just after his death.

“[Dr. King] said each of us has a moral obligation to stand up, speak up and speak out. When you see something that is not right, you must say something. You must do something. Democracy is not a state. It is an act, and each generation must do its part to help build what we called the Beloved Community, a nation and world society at peace with itself.”

Our country is calling on you and me to do that, to help clean house, hold accountable and name names. So, you and I must do more than just hope and vote. Obey the dictum of the bumper sticker:

Be the person your dog thinks you are.

The Speech I Wanted President Biden to Give Last Night


In The United States House of Representatives
Sergeant at Arms:

Madam Speaker: the President of the United States

President Joseph R. Biden, Jr.:

Speaker Pelosi, Vice-President Harris, Members of the Supreme Court, Senators, Representatives and guests, we’re here tonight for an accounting of the condition of the United States of America – something of a report card for our nation. It is well and fitting that we should do so after the most turbulent transfer of power in the history of our nation.

While we are gathered here in the presence of officials and luminaries, tonight I’m speaking directly the American people – all 331,400,000 of us – because you know the truth, that we are in a fix of our own making, putting us in peril.

On December 1, 1862 Abraham Lincoln sent a message to Congress in those dark days of Americans fighting and killing Americans. Our nation was being ripped apart as he spoke a truth they all knew:

“We shall nobly save, or meanly lose, the last best hope of Earth.”

These times are not so different in spirit and this is our peril. There is a rise of autocracy around the world. It is the very enemy of democracy and we are not so exceptional that we are immune to that danger. Indeed, it has set foot on our doorstep.

I love this country just as you do, so it’s time that we put all the cards on the table, time that we stop withholding the gritty truth so that we might begin to heal ourselves and meet our challenges – so that we save this last best hope of Earth.

Surely, you remember the comments of the last president about the events in Charlottesville that culminated in the murder of Heather Heyer. He said that there were “very fine people on both sides.”

But you know that there weren’t.

Because one side was made of people chanting hateful things, people who wore the emblems of Nazis, the enemy we fought and defeated at the cost of hundreds of thousands of American lives. Nazis like and want autocracy – dictatorship – not democracy. They are an enemy that wants to bring down our country. So, no, those were not fine people.

Here’s more gritty truth: Congress is not unlike that.

We have people in Congress who promoted insurrection, violence against our country and our countrymen and women. We have people here in Congress who know full well that Trump’s Big Lie about the election having been stolen is pure fiction. They know that claims of hundreds of thousands of fraudulent votes are pure fiction. They know that there is absolutely no evidence of fraud in our last election, which is why over 60 of Trump’s lawsuits were laughed out of court. They know that these are just another set of self-serving Trump lies. They will acknowledge that in the cloakrooms of the House and Senate and in other private places. They know the truth.

But in public, when it counts, they cower in fear of the megalomaniac and they toe the corrupt line for Trump and their party bosses. They mouth the Big Lie. When they do that they weaken our nation.

The Electoral College votes of all 50 states were certified, but 147 senators and representatives challenged some state counts and voted to overturn the election, even though they had no evidence of any election wrongdoing, nor any other factual reason to object. They were blindly promoting the Big Lie, even as they knew the truth, and they undermined our democracy. You elected them to be leaders, not followers, but they caved to party pressure. Here’s what that means to you:

They stand in opposition to any and every plan to make your life better and safer.

For decades they have voted against nearly every piece of legislation that would have had benefit for you. They voted in goose stepping unison to oppose the American Rescue Plan, our program that has led to the vaccination of over 200 million Americans, put money in your pocket and created hundreds of thousands of jobs. I say again: they voted against that. And they offer nothing to make things better for you.

They stand in unison against the proposed American Jobs Plan (the infrastructure bill), the John Lewis Voting Rights Bill and every other action proposed by Democrats designed to be of service to the American people. They stand against universal background checks before the transfer of firearms, even though 90% of Americans want that protection. They have no policy proposals and stand only for obstruction. They give no thought to you.

In short, they have sold you out.

That’s why I’m speaking directly to you. Because if you want anything good to happen, if you want government to work for you, you have to pressure your senators and congressperson to vote in favor of you. You have to tell them to stop the un-American, self-serving dance they do that focuses solely on themselves. Tell them to start working for you. Tell them to shape up or you will ship them out.

We are at a crossroads where we must decide which way to turn. One way leads to continuing division and anger and despair. It encourages more extremist violence like the awful attack on our nation on January 6. It has already generated state laws that dramatically attack your freedoms. It promises greater wealth for people who don’t need it and increasing poverty for everyone else.

A turn the other way leads to a better America – that shining city on the hill. It leads to greater prosperity for all Americans and keeps us the envy of the world. It restores our place among nations. It keeps faith with the Founders of our nation and the vision they gave to us of what we can be. It tells us that the American Dream is alive and well and it’s there for all of us, if only we have the courage to make the right choices and grab it.

So, call or write to your legislators both in Washington and in your own state. Tell them you want an end to their jiggering our country just to serve themselves. Tell them that you have a long memory when you’re double-crossed and you’ll surely remember their selling you out if they don’t start doing the right job for We the People, the job they were elected to do.

Look, there will be time to talk about programs we have developed and will be proposing. Right now what you need to know is that your voice is the one that must be heard if the self-serving obstructionists are to be stopped, so your job is to speak up. I’ll do my job of finding solutions that will work. Together we’ll get past our decades of self-defeat and restore our country to the path where we know it belongs.

Our Watch


The good news is that there are lots of people who are smarter than me and I need them, because I have a big bucket full of I Don’t Know.

For example, I don’t understand righties who not only want to have their way (that part is understandable, of course), but they want to “own the libs.” What’s with the implied meanness and even cruelty?

And what about all the anti-maskers and anti-vaxxers? I understand people younger than 65 years old saying they’re willing to take their chances with the coronavirus, because if they get sick it’s less likely they’ll become seriously ill or die. But they are the ones who are most likely to infect their parents and grandparents and those older people are far more likely to die. Instead of doing their part to protect our vulnerable, the anti-maskers and anti-vaxxers are having temper tantrums about their freedom to not wear a mask and to refuse vaccines, but those are the very things that will stem the tide of this pandemic and limit coronavirus deaths. I don’t know what happened to our sense of patriotism as  expressed through national willingness to sacrifice for one another and for the common good. I just don’t know.

Why were there thousands of our fellow citizens who stormed the Capitol Building looking to kill members of Congress and lynch the Vice President? Where did that rage and viciousness come from? I surely don’t know.

How did our society and our values devolve to such a point that these people would chant “USA! USA!”as though they were patriots, when they were at the same time vandalizing perhaps the most prominent symbol of our country? Why would they carry American and Blue Lives Matter flags and then beat the living daylights out of our Capitol Police with their flag poles? And how could they see themselves as true Christians when they were in search of legislators to wantonly kill? I don’t know that, either.

The Republican party has completely shifted its behavior over the last 40 years. For example, speaking of Republican efforts to undermine our last election, Sheila Markin writes, “Disinformation works to create mistrust of government. Currently, there is a campaign in [some] communities to create mistrust about the vaccine. General mistrust of government is the goal.” [emphasis mine] That is happening right now in plain sight. I don’t know why we just watch and remain immobilized.

More to the point, we’ve seen all of this coming for years, perhaps decades, and we’ve done nothing to stop the selfishness, the dishonesty, the fear, the hatred, the violence and now the insurrection. I don’t know how we let that happen.

We’ve never lived up to our democratic ideals, especially the “We hold these truths to be self-evident” claim. The Republican legislatures of 43 states are working frantically right now to prohibit poor people and people of any color but white from voting. As bad, the Republican bloc in the Senate is dedicated to making sure that Congress allows all that state crafted disenfranchisement to happen. Apparently, the truths we hold as self-evident aren’t exactly the same as those stated on that piece of 1776 parchment. How have we allowed that to go on for so long?

Nikita Khrushchev was First Secretary of the Communist Party in the former Soviet Union. We were in a cold war with the Soviets then and Khrushchev famously said, “We will bury you.” Indeed, in a moment of gleeful disparagement of capitalism he declared that they would sell us the rope that they would use to hang us. In a crazy twist of fate, he may have been right.

We have senators and congressmen/women openly spreading propaganda supplied by Vladimir Putin. What is the payoff they get for spreading Putin’s lies and misinformation to Americans and for undermining our trust in government and in ourselves? That sounds suspiciously like Putin is selling rope to these congressional fools and we are hanging ourselves with that rope. That seems treasonous to me and I don’t know why we tolerate the behavior of these congressional betrayers. I don’t know why we allow these people to be in government or have any power at all.

When it comes to adverse events, there is a useful and powerful declaration that comes from our military: Not on my watch. That means that I won’t let anything bad happen when it’s my turn to stand a post. You can feel safe when it’s my watch.

But this is our watch. You and I are standing a post and these bad things are happening right now.

We’re in charge and we’ve allowed ourselves to be lied into wars, we tolerate gun massacres and we stand by while hundreds of thousands of our compatriots suffer and die needlessly. All that and more has happened and continues to happen on our watch. I don’t know why we tolerate that. I can’t explain the pervasive silence.

FDB – Not a Typo


The Yungr Machine is a modification of the Wabac Machine.

Were I twenty years younger and living where there is a Republican senator or congressperson I would run for office in 2022. I’m licking my lips at the idea of running against any fool Republican who voted against the American Rescue Plan, which includes every Republican in Congress. By November 2022 it will be the single most positive and popular thing to impact the voting public in many decades and its popularity will climb as people get checks, vaccinations. jobs and their kids go back to school. Please, somebody, stuff me into the Yungr Machine so I can become a generation younger and run against an R in the mid-term election.

Passing the American Rescue Plan is a huge step in delivering what Americans want and desperately need. It has a 76% approval rating – over 60% of Republicans like it – and those numbers are going nowhere but up. It’s the kind of thing that makes people say, “Hey, this is pretty good stuff – these guys actually can deliver.” Some will say quite reasonably, “It’s about damn time,” and, of course, they’ll be right. We’ve dragged feet for decades on any kind of benefit package that actually helps working people and our most desperate.

This is so good that even stogy economists, like those at Goldman Sachs, as well as non-stogy Paul Krugman, are predicting 7.7% growth in GDP, and that’s nothing but good for everyone.

The key political play is for the Dems to keep the Plan properly framed and its benefits in front of voters for the next four years. That’s critical, because Trump will try to steal the glory by claiming that “only he” could have delivered Operation Warp Speed. Look for that BS coming soon to a communication near you.

Now imagine Biden delivering an infrastructure bill, a critically needed updating and rebuilding of our national foundation that politicians have been wagging tongues about and have steadfastly avoided tackling for at least 40 years. This will be a WPA-like package that puts millions more Americans to work with good wages and benefits and the self-respect that comes with that. That will be next on Biden’s playlist and, like the American Rescue Plan, it will be gigantically popular.

Big projects are what are needed for our big challenges. This is very much like the time of the Great Depression, in that there are big crises afoot, which opens a space for a strong leader with the right message to emerge and champion serving the people. Delivering on that opportunity will cement Biden as the right guy for our time and perhaps the cultural and economic successor to FDR; hence, the title, “FDB.”

Republicans know and fear this, so they especially want to oppose an infrastructure plan, because its popularity would likely portend 8 to 12 additional years of a Democrat in the White House and Democrats controlling Congress, too. That’s why they are scratching and clawing to keep the filibuster. They are desperate to prevent its modification so that they can continue to submarine every Democrat and every Biden effort. Their motto:

Obstruction Я Us

They are all about stopping anything that is good for We the People because that prevents Ds from having a win. They think that will put them in power. Too bad for you.

That is why Democrat efforts to de-fang the filibuster and prevent Republican obstructionism is so important to our nation. Read this to understand fully.

Republican legislators refuse to be responsive to the needs and desires of the American people, but they still want power. They ache for the appalling thrill of minority rule. They are unable to compete on policy, so they’re waging a war using cultural divisiveness, fantastical lying, gerrymandering and overt voter suppression. Sadly, in their complete absence of even a single idea of substance for We the People, they’re now using their lofty Congressional status to attack Dr. Seuss and Mr. Potato Head. Really.*

If you believe in majority rule, you better get into the fight to limit or eliminate the filibuster.

Fun Contest

There’s red wine, white wine and Republican whine, and they have already started their whining campaign about the American Rescue Plan. They are claiming that it’s full of “pork barrel spending.” They are wailing great cries of woe and rending their garments in anticipation of a fantasy mortal hog snort to our nation. This is exactly like Trump and Republican accusations of voting fraud in the 2020 election, in that in neither case are they able to point to even a single example of the horrible thing they decry. All they have are false accusations projected at spit-spewing volume.

Which brings to mind the title and key lyric of a fine blues tune:

Your Mind Is On Vacation (and Your Mouth Is Working Overtime)

Carlson said, “This is a free country. How dare you tell us who we can spend the Fourth of July with?” He’s quite good at indignation.

  • Okay, I accept your criticism that Tucker Carlson is anything but thoughtful. So, instead consider applying to him the blues tune title above.

The Playground Lessons

When I was a kid the grown ups let me know when I behaved improperly and the messages were always very clear and compelling. That didn’t mean that I never did whatever-it-was again, but it did mean that I knew the rules and did whatever-it-was less and less often. I saw other kids learning that same hard way, too. “Betcha grown ups don’t get in trouble that way,” I thought, because, well, they’re grown ups.

Wrong.

Some didn’t learn their lessons,

like the huge community of Trumpist liars who never quite got the message that it isn’t okay to lie.

like the self-certain conspiracy theory followers who use their self-righteousness to bully others, even though they were taught on the playground not to bully.

like the rule benders who victimize others with their barely legal discrimination and hateful suppression.

like the shameful cowards who don’t stand up for what they know is right and don’t stand against what they know is wrong.

There are lots more, of course, but the point is that becoming an adult doesn’t guarantee anyone will leave childhood wrongdoing behind, even though we all know that it should. Some carry around their brattiness like a badge of honor all their lives and hone their skills with pride. They refuse to learn their lessons and you can see that any day in Congress and hear it constantly from the mouths of political blatherers. They all wear adult bodies, but inside some are just bratty kids from the playground.

Go tell their moms on them. Then they’ll be in trouble.

The Government Lesson

President Ronald Reagan famously and repeatedly said, “Government isn’t the solution to the problem; government is the problem.” That was an odd thing to say for a guy wanting to run government.

Surely, Reagan found a useful campaign tool in making government a boogie man. He gave people something to blame for their problems. He stoked the fires of discontent for his own benefit and left the resulting carnage to others. We are living in that carnage right now.

In contrast, President Biden now has our vaccination program humming along at over 2 million poked arms per day. We’re rapidly on our way to beating this horrible virus and restoring our more normal lives, all because government is the solution.

There are some things that even rugged American individualists cannot do on their own. That’s why we have government. Government is why we’re able to roll up our shirtsleeves and get vaccinated. That’s why Biden is decisively proving Reagan wrong. Because it turns out that government wasn’t the problem; Reagan was.

The Texas Lesson

Governor Greg Abbott issued an imperial proclamation that mask wearing is no longer required and all businesses in Texas are free to open fully as of today. That’s more than odd, given that it’s obvious that we have not defeated the coronavirus pandemic.

Worse, there are multiple mutant strains of the virus that are accelerating infections across the nation. They are more efficient in their transmission, meaning that we infect one another with even less exposure than from the original coronavirus. Worse yet, they are more serious and perhaps more deadly to humans. Surely, Governor Abbott knows this. So, why would he put Texans at mortal risk? I think I know.

Abbott knows that eliminating the mask mandate and opening up the state for full interpersonal viral transmission will result in massive numbers of Texans becoming gravely ill and many will die. I’m guessing that will affect fewer Democrat voters, as they are likely to wear a mask, Abbott proclamation or not. His order, then, will result in fewer Republican voters, thus helping purple Texas go Democrat for years to come. I think Abbott is a Democrat in Republican clothing.

Well done, Governor Machiavelli!

E Pluribus Unum


Perhaps you heard that in the face of the Texas winter nightmare Republican Governor Greg Abbott blamed the breakdowns and suffering on the Green New Deal. Of course, the GND is only an idea; nothing has been done to create its physical reality, so Abbott’s pronouncements were most perplexing. Besides, the wind and solar renewables that have been in Texas for years kept working as the fossil fuel plants shut down. His gubernatorial leadership seemed rather QAnon-ish and unhelpful.

Former Republican Texas Governor and former head of the Department of Energy Rick Perry said that “Texans would be without electricity for longer than three days to keep the federal government out of their business.” He also said that the current disaster shows that we have to double down on burning natural gas.

Perry made these claims even as climate scientists explained that the jet stream was altered by global warming and that the resulting redirection drove the frigid air that far south, all the way to Texas and northern Mexico. It’s incontrovertible that burning more gas won’t prevent the next arctic blast and it’s unlikely Texans want to experience yet more days without power. Like Governor Abbott, former Governor Perry’s comments were detached from reality and notably unhelpful at a time when help was needed.

“Don’t mess with Texas” is an attitude of fierce independence and pride in the Lone Star state and those politicians have used that attitude as their political tool. But the experts have made it clear that this stand-alone bravado and a mania for deregulation are key drivers of the Texas lack of preparedness for cold weather and the suffering it spawned this month.

In the face of our obvious interdependence, neither Texas nor, indeed, any part our country can go it alone in facing our deepest, most difficult challenges. It’s time to get over our self-puffing swagger, our self-serving pronouncements and leave the failed policies and attitudes behind.

We cannot “burn natural gas” our way out of our power and climate messes. We cannot “deny medical care” our way to health. We cannot “austerity” ourselves out of poverty. We cannot bootstrap ourselves out of natural disasters. We cannot suppress our way to security. We cannot hate our way into patriotism. It’s time – really, long past time – to deal with reality.

One reality is that everyone likes the idea of small government and low taxes. The companion reality is that we like that first reality only until the moment when disaster hits and we have to pull together. It’s called government. The Commons. It’s how we band together to do the things we cannot do alone. It’s why impoverishing government ultimately doesn’t work for us.

Philosopher and heavyweight boxer Mike Tyson said, “Everybody has a plan until they get punched in the mouth.” That’s when the old plan shows its weaknesses and we realize that we are in a fight for our lives and that we’re in it together. That’s when we drop the pretenses and get about doing what we should have been doing all along.

Like aggressively fighting Covid-19.
Like rebuilding our infrastructure before everything falls apart.
Like admitting that we really need some things to be regulated.
Like standing up to bullies.
Like ending our ongoing un-civil war.
Like educating all of our young.
Like preparing for a tomorrow that is going to look very different from our yesterday.
Like acknowledging that not everything is a zero-sum game.
.

That means that we must be an E Pluribus Unum, because without it we are self-defeating. Just ask anyone on our Gulf Coast who has dealt with frequent and ever-more powerful hurricanes, or any former homeowner in the burned out wreckage of California, or survivors of the I-35W bridge collapse in Minneapolis in 2007 or most any Texan right now,

Our being composed of such large numbers of people today make the E Pluribus Unum part difficult, because we humans are more comfortable in small numbers. But we’ve solved that puzzle before, once at our beginning and at other times since then, and we can do it again.

All we have to do is to deal with reality like an E Pluribus Unum.

American Idolatry at CPAC

People are bowing before a golden image of Trump at CPAC. It is the ultimate graven image of our time, today’s Biblical-political tale of debauchery and willful human debasement. That kind of idol worship over the last 4 years got us January 6. And now these people have their real Golden Calf to worship. The irony for Evangelicals is just too crazy.

This time for sure!

Said Mark Twain, “History doesn’t repeat itself but it often rhymes.” Here it is again in perfect verse.

I don’t anticipate divine intervention to halt the CPAC worship perversion, but there was that one time at the foot of Mt. Sinai  .  .  .

To the attendees at CPAC

You booed the woman calling for wearing face masks and shouted “Freedom!” in protest of her outrageous proposal to suppress virus transmission. What was she thinking?

Hold tight to your liberty to refuse to wear a mask. Breathe, cough and sneeze to the point of hypoxia in your asymptomatic self-certainty. Exercise your freedom by sharing your disease with your family and friends.

Just keep your cooties the hell away from me and everyone else who knows they have the freedom to not be infected by you. Freedom!

And no, I won’t visit you in the hospital when that respirator is shoved down your throat. Neither will anyone else. You’ll have the freedom to die alone.
