Indictment


Clarification

In the midst of my joy over the beginning of accountability for wrongs done in association with January 6, I wrote last Wednesday, “O’ happy day!” And it was a happy day by reason of accountability. Let’s be clear, though, that this indictment of a former president is not one dimensional. Another dimension is fear.

I fear several things about this indictment. I fear that prosecuting Trump will galvanize hotheads to do stupid, destructive things, perhaps to attempt to use chaos and violence to take down our government, our freedoms and our rights. That’s been done more than once before.

I fear that a lone gunman, perhaps many lone gunmen, will kill and injure innocent people, including those who uphold our laws. They did that on January 6, so we know they won’t hesitate to attack cops.

And I fear that an extreme Trump supporter will slip into the jury and prevent justice from being done.

Another dimension to this indictment is the clarity that this is a profoundly proud moment for democracy.

This is how we declare to ourselves that there is no rule of one person, but that we are a nation of laws. This is how we say to those on the far right that while they proclaim that they are the true Americans, our rule of law flag is planted in the bedrock of justice and is what real Americans support. There is no need for anyone to like that or to agree. There simply is an absolute requirement for everyone to obey the law, not the rule of Trump.

Jack Smith and the members of his DOJ army are operating in a shooting gallery. They know that even as they stand for justice that they are at the center of the bulls eye of angry people. The death threats they’ve received haven’t stopped them and they remain willing to risk their lives for our Constitution and for We The People. So we stand with Jack Smith and his army because these heroes are standing for us.

Trump Supporters

There are millions of Trump supporters who are not dissuaded from their loyalty to him, even in the face of his well over 30,000 lies, his bumbling, our national debt exploding on his watch, his intentional estrangement of our allies, two impeachments and multiple felony indictments. That support seems curious to many of us so I’ve put some thought as to why they continue to follow and support him. Here’s a shopping list, pretty much off the top of my head.

  1. Many of these people are aggrieved for various disappointments felt as betrayals, a feeling of having been blown off, left behind by a government that simply doesn’t care about them. They aren’t entirely wrong about that. Think: offshoring of jobs encouraged by decades of government programs and policies that hollowed out whole towns. Because of that, they easily fall in line behind a defiant strongman, the “deep state” slayer. Leaving that line feels to them like going without a protector.
  2. Following and supporting Trump feels good, like they’re sticking it to the man who’s been sticking it to them for so long. Trump constantly models a middle finger for these folks and in that way they feel powerful.
  3. Leaving Trump would require people to admit:
    1. They were wrong to follow him. Nobody likes to say, “I was wrong.” Fonzie couldn’t say that at all.
    2. They were duped. Nobody likes to admit they were fooled.
    3. That the rule of law means more than the rule of Trump and that maybe intentional cruelty isn’t such a good idea.
  4. Conviction on felony charges would show Trump to be un-American, even anti-American. At that point, his followers would have to admit that following Trump made them un-American, a total betrayal to how they see themselves. That’s a nearly impossible trick to pull off.

The psychologists can craft a better, more  substantial list, but you get the picture. Leaving the support of Trump involves real loss for his staunch supporters and the various pains that go with doing that. It’s much easier and less painful to stay where they are and write yet another check payable to Trump.

So, cut these folks some slack in your comfortable judgement of them. They’re in a tough spot, albeit of their own making.

Focus instead on reaching those whose minds have not been enslaved and provide motivation to them to show up and vote.

BTW: Something is upside-down. Instead of we voters supporting candidates and elected officials, shouldn’t they be supporting and championing us?

Action Imperative

No vote is more urgent and important right now than Ohio Issue 1 in the election on August 8. The minority rule Republicans in the Ohio legislature have crafted a democracy killer of a bill. it’s a product of their brutality, as they seek to silence and dis-empower the majority of Ohio citizens. You know – the ones who believe in majority rule, aka democracy?

That bill would change the citizen ballot initiative process to require a 60% majority in order to pass a citizen ballot issue. A super majority. No more simple majority wins, the way we all were taught contests were supposed to be won. That would make it nearly impossible for citizens to stop the tyrannical minority Republican legislature. Voting for that bill is the equivalent of voters tightening a noose around their own necks. It would be volunteering to be electorally neutered, to have their democracy – rule by the people – killed.

This is anything but hyperbolic. Just one example: The Christian nationalists are all about forcing their views onto everyone else. Passing this bill would be a major stop toward the theocracy they hallucinate we’re supposed to be.

If you live in Ohio or know someone of voting age in Ohio or have ever been in Ohio and can remember the first name of someone you briefly met there, call, text or email them and urge them to

VOTE NO

on Tuesday.

I’m Sorry


I’m sorry that Republican legislators are so angry and that they hate the Constitution, our laws and America itself so terribly that they are calling for angry, radical people to make violence on our citizens and on our nation.

I’m sorry that angry people are threatening to kill Merrick Garland’s wife and children and Jack Smith and his wife.

I’m sorry that Republicans are stuck in a spin cycle of whataboutism, and can’t get out. They can no longer make a declarative statement about just one issue, like the indictment. They instead have to justify the unjustifiable with phantom comparisons to Democrats, as though some other wrongdoing justifies this one.

I’m sorry that no matter what happens, Republicans are poor victims of Democrats, elites, gays, educators, hordes of would-be immigrants who are stealing our jobs and all the rest of the mean-spirited idiocy. So many poor baby Republican victims.

I’m sorry that Hillary had all those emails on her private server and that when it was searched for classified information by the Trump Bogeyman Super Snoopers they couldn’t find any. They only found documents which were classified after they were removed. They determined that Hillary had broken no law, but Trump and his angry hordes still chanted to lock her up. They still do.

I’m sorry that Trump made his DOJ continue an investigation into the Clinton Foundation for the duration of most of his administration, even though his investigators neither believed there was any there there, nor did they ever find any. (This sounds like weaponization – let’s have Jim Jordan check it out.) Nevertheless, Trump trumpeted lies about the Foundation. He still does, as do his sycophants.

I’m sorry that Trump and every Republican who has blurted an opinion about the indictment of Trump blames Biden for “weaponizing” the DOJ against poor, suffering Trump, this is in spite of the fact – yes, fact – that only Trump used the DOJ in that way – ref: one paragraph up. Their false blurting is in spite of the fact that Biden has strictly kept hands off what the DOJ does. It is in spite of the fact that Special Prosecutor Jack Smith is independent even of Merrick Garland’s purview, as well as of Biden’s. And it is in spite of the fact that Trump has not been indicted by Biden or the DOJ. He’s been indicted by a grand jury of south Florida citizens.

I’m sorry that Joseph Goebbels was right about how The Big Lie works, that all that is required to get people to believe lies and propaganda and to do horrible things is to bellow it out, over and over until the weak of mind believe. In the present case, that has led 88% of Republican primary voters (the hair-on-fire, pitchforks and torches crowd) to believe that the indictment of Trump was politically motivated. They believe the lies to be truth.

I’m sorry that whatever lawyers Trump can manage to hang onto will make pretrial motions with baseless, bogus accusations, like “prosecutorial misconduct,” solely for the purpose of bogging down the trial. Then it will get postponed by Trump suck up judge Aileen Cannon because it will then conflict with the 2024 election. You fill in the blanks illustrating what will happen next.

I’m sorry this guy stands with Trump.

Most of All, I’m Sorry

that so many Americans hate America and want to tear it down, and that there aren’t yet armies of Americans in the streets demonstrating for democracy, people who love America and want to protect and defend it and the Constitution.

But there could be. There’s still time.

.  .  .  that at the 2023 Tony Awards on. Sunday actor Denée Benton announced the Excellence in Theatre Education Award from Carnegie Mellon University, saying,

“While I am certain that the current grand wizard, I’m sorry, excuse me, governor of my home state [of Florida] will be changing the name of this following town immediately .  .  .  Plantation, Florida.” [emphasis mine]

Brilliant.

The Central Cause


“The central cause of January 6th was one man, former President Donald Trump, who many others followed. None of the events of January 6th would have happened without him.”

So declares the Executive Summary of The United States House Select Committee to Investigate the January 6th Attack on the United States Capitol. Yes, that’s the full name of the Committee and yes, the 161 pages of this Executive Summary, plus over 40 pages of footnotes, are an introduction to the full report. That will be released today and it will be a weight lifting appliance, over 1,000 pages long.

The good news is that this opening report is most readable and is remarkable for its clarity (here’s a link – see for yourself), giving the promise of similar accessibility of the full report. The bad news is the collection of despicable and dangerous people and actions it details, actions that caused the death of five people, injured 140 police officers, were a death threat to all in Congress and to the Vice President, vandalized the citadel of our democracy and nearly ended this brave experiment in self-government.

The Committee is referring the disgraced, twice-impeached former President, Donald J. Trump, to the United States Department of Justice – i.e. recommending indicting and prosecuting him – for:

  1. Obstructing an official proceeding
  2. Conspiring to defraud the United States
  3. Conspiring to make false statements
  4. Inciting insurrection

These charges are well fleshed out in the Executive Summary.

Any non-lawyer can compile a long list of Trump’s illegal actions over the past 6 horrendous years, but the Committee constrained its investigation to solely those related to his actions and those of his co-conspirators attendant to the events of January 6. Of course, these are forehead slappers for anyone who has paid attention and who is not in mindless thrall to this would-be authoritarian. pharaoh, king, monarch, fuhrer, emperor, god – choose your own label.

There are so many outrageous things detailed in this summary. Here’s just one.

John Eastman, Trump’s lawyer who crafted a multi-point, devious plan to subvert the will of the people and the Constitution, told Trump that his plan, if executed by Trump, would violate the law. Trump ignored that inconvenient fact. That surprises nobody.

Neither is anyone surprised by his cruelty toward Mike Pence or his reveling in the riot and its carnage for hours, watching it on TV from the White House dining room. Nor is anyone surprised at his ongoing lies and vitriol and grift.

As I watched the violence unfolding on that awful day I could not stop myself from yelling at the TV, “Where’s the National Guard? Where the hell is the National Guard?” Unsurprisingly, Trump never ordered them to deploy and come to the aid of the besieged Capitol Police and Metropolitan Police. Those officers were bravely trying to do the impossible and were getting severely beaten for their efforts. And they got no help.

There has been talk since the the attack that Trump ordered the DC National Guard to stand down. The preliminary report doesn’t speak to that. Perhaps the full report will.

Gov. Larry Hogan (R-MD) tried to get authorization to send the Maryland National Guard to reinforce those officers. He was refused. Perhaps the full report will speak to that, too. I assure you that the police officers who were there that day can speak to that.

When the committee comes to me for my recommendations to prevent another such episode of destruction I will have a ready answer: Install easily accessible fire hoses at strategic locations around the Capitol Building, including doors and first floor windows. Half a dozen fire hoses spraying the insurrectionists on that cold January day would have kept them out of the building and would have put down the riot.

There has been criticism claiming there were intelligence failures, but intelligence that predicted this attack was reported. Our agencies detected the planning for this attack, but they shared it – get this – with the White House and Secret Service. That’s where that kind of information is supposed to go, but this time the recipients of the information, especially the key recipient of the information, had no interest in taking action to prevent the attack. Indeed, he and they were all guns blazing to incite and expand the attack.

There is far more in this Executive Summary and I urge you to read it. You’ll learn much about so many bad guys and felons. These people are insurrectionists. They are traitors to the oath to which they swore and to our country. They are still in Congress and they walk free. So does Trump.

Outrageous, but fixable.

Meanwhile, great thanks goes to every member of the January 6th Committee for their courage, for their insistence upon finding truth, for speaking truth, for grace and clarity in their presentations, for their even-handedness, for their work to wade through over 1,100 interviews and over 1,000,000 pages of documents and for their uncompromised integrity. How very refreshing that is for all of us and o’ the joy of the beginning of a return to justice! That’s good news.

More Good News

Today is the winter solstice, the day when the sun is in it’s southernmost location in our sky, resulting in our shortest hours of daylight and our longest hours of night. The reason that’s good news is because tomorrow is the day when daylight begins to grow longer by a few seconds per day, accelerating to 2.5 minutes more per day by March 20.

That’s good news, indeed!

Meanwhile, it will be nasty, potentially killing cold in most of the country. It started a couple of days ago in parts of the lower 48 and if it hasn’t visited your door yet, it’s going to soon. Give a warm coat and hat to a homeless person – they don’t have central heating – and practice safe winter.

A Different Take


The Atlantic’s Jonathan V. Last Thinks Mike Pence Is an American Hero

You read that right.

Pence was on the wrong side of nearly every issue, like reproductive rights, gay rights, failing to prevent an Indiana HIV outbreak from becoming far worse and more. His public religiosity didn’t extend to caring about those who got hurt by his policies. And he sucked up to Trump and his malfeasance for four years plus two campaigns.

All he did on January 6 was to obey the rules of the Constitution to do his clerical job. He could have spoken up at least a month before the insurrection and that might have saved lives, but he refused to do that.

We all know that he was under great pressure from Trump, who didn’t “want to be Pence’s friend anymore” if Pence wouldn’t lie and cheat Trump back into the White House. Pence didn’t knuckle under. That one time. I guess they aren’t friends now.

Sorry, Mr. Last, but this guy’s no hero. His tombstone might read, “At long least I got one right – in the last minute.” The sub-text will be all the things he got so terribly wrong for such a very long time.

Similarly, we learned from the June 23 public hearing of the January 6 House Select Committee proceedings that DOJ men of integrity had prevented Trump from invoking the Department in his efforts to steal the 2020 election. But, like Pence, they didn’t speak up when it could have prevented the injury, death and destruction of the January 6 insurrection.

What If  .  .  .

.  .  .  the January 6 insurrectionists and seditionists had started a large bonfire just a short way from the gallows intended to be used to hang Mike Pence?  What if they had brought with them a poster size version of the United States Constitution? What if they had ripped one page at a time from it and fed it into the flames of that bonfire? Would that have been worse than what they actually did?

They were bashing the Capitol Building, defecating on its marble floor, ransacking offices, bear spraying cops and viciously mauling every person and every thing that stood for our Constitution and our country. They tried to overturn the democratically determined will of We The People. They tried to paralyze the very government that is outlined in the Constitution. They sought to establish authoritarianism in place of democracy. They wanted and still want government by vigilante.

They were motivated and led by Republican officials, the likes of which have been working to overturn and end our democracy since at least 1960 and probably since FDR. The Republican Party may as well have burned the Constitution back then.

So, what if the insurrectionists, the seditionists, had lit a bonfire and burned the Constitution? They as much as did that, as they tried their best to end America. And vacuously, ignorantly, they claimed they are the patriots. That was no 1776 event. It was a Benedict Arnold betrayal.

One More Time

We’ve known all along that Trump knew he lost the election fairly and we’ve learned through testimony to the January 6 House Select Committee that he was told that by an army of his own people. They begged him to tell the insurrectionists to stand down, but he didn’t listen to any of them, not even his own daughter. He sat watching and enjoying the destruction. And there is exactly one reason why.

Trump was desperate to remain president because he knew that as soon as he was an ordinary citizen once again that he would no longer have the protection against prosecution that accompanies that office. He knew that prosecutions for election tampering, money laundering, conspiracy to commit a dozen crimes and so much more would come down on his head and he would spend the rest of his life in prison. That’s why he was and is willing to do anything, bray any unpatriotic lie and more just to stay in office.

Plus, of course, he would have to admit publicly that he’s a loser.

.  .  . delegates to a convention of the Texas Republican Party today approved platform planks rejecting “the certified results of the 2020 Presidential election, and [holding] that acting President Joseph Robinette Biden Jr. was not legitimately elected by the people of the United States”; requiring students “to learn about the dignity of the preborn human,” including that life begins at fertilization; treating homosexuality as “an abnormal lifestyle choice”; locking the number of Supreme Court justices at 9; getting rid of the constitutional power to levy income taxes; abolishing the Federal Reserve; rejecting the Equal Rights Amendment; returning Christianity to schools and government; ending all gun safety measures; abolishing the Department of Education; arming teachers; requiring colleges to teach “free-market liberty principles”; defending capital punishment; dictating the ways in which the events at the Alamo are remembered; protecting Confederate monuments; ending gay marriage; withdrawing from the United Nations and the World Health Organization; and calling for a vote “for the people of Texas to determine whether or not the State of Texas should reassert its status as an independent nation.”

That’s pretty much the horrific bleeding edge of the GOP today and what they want to do to America. So, right now, this minute, mark your calendar to vote – November 8, 2022 and November 5, 2024 – unless you want what’s in that paragraph above.

Biden’s To-Do List – The Short Form

This list of President Joe Biden’s To-Dos starting in the afternoon of January 20, 2021 is offered in no particular order of importance except for the COVID-19 section, which is urgent. Be clear that these items are solely about recovering from Trump destruction. The obvious point here is that this is only a partial list. Please provide your additions in the Comments section below.

Provide strong, clear leadership for scientific, tough minded practices to deal with the pandemic and end it:

– Restore public faith and confidence in national leadership by consistently telling the public the truth. No denials of reality, no anti-science fantasies, no demonizing of those with differing views.

– Fully fund nationwide testing and contact tracing and authorize lock downs where they are needed.

– Restore full status to the CDC.

– Restore funding for the WHO.

– Provide dependable financial support for workers displaced by the pandemic. No more leaving Americans on the brink of disaster because action was delayed by Congress and the president until the last second.

– Apologize to Dr. Anthony Fauci and the people of the CDC.

– Provide funding for schools to create and fully implement the dramatic evolution in teaching made necessary by COVID-19.

– Create childcare for children of working parents for whom school was their resource before COVID-19.

– Restore COVID-19 funding to public schools from the private schools to which it was diverted by Betsy DeVos.

Rejoin JCPOA – the Iran no-nuclear agreement – if it can be resurrected.

Withdraw support for Israel to annex West Bank areas.

Rejoin the Trans-Pacific Partnership – “TPP” – so that we don’t cede half the planet to the Chinese.

Start rebuilding infrastructure. Do you remember those “shovel ready” projects Congress refused to fund during the Obama administration? Trump has done none of it.

End the attack on the Postal Service and initiate legislation to remove the 75 year pension funding requirement that hamstrings that service.

Unwind Trump and Bush era tax cuts for the wealthy and create sensible tax reform.

Immediately remove all “acting” officials and replace them with qualified, Senate approved people

Enact laws to prohibit federal “goon squads” from showing up in any state or city unannounced, unrequested, unidentified, unwanted, unconstitutional and unlawful:

– Require all federal policing individuals and vehicles to be fully badged and tagged for easy identification when used for crowd control or for protection of federal property. This is not intended to apply to undercover agents.

– Require federal officers to declare a clear statement of cause when apprehending protesters; e.g., “You’re under arrest for ___________ .”

– Require all federal officers to fully Marandize those they apprehend.

– Prohibit federal policing individuals from all actions other than directly protecting federal property while on federal property.

– Make it mandatory to secure a request and agreement from an appropriate state and/or local official for the deployment of federal personnel and equipment in any state or city for any purpose except when a state and/or city itself is violating the Constitution or acting illegally (Think: Little Rock Central High School in 1957; University of Alabama in 1963).

Biden’s Attorney General action list:

– Prosecute William Barr for whatever comes to mind.

– Investigate all Trump Department heads, including Betsy DeVos, Sonny Purdue and all the rest for featherbedding and other illegal behavior.

– Indict Trump for his obvious criminal behavior, including many violations of the Emoluments clause, extortion in the Ukraine scandal, multiple counts of obstruction of justice, abuse of power and all the rest.

– Prosecute everyone responsible for the actions of the federal “goon squads,” actions that include kidnapping, beating, shooting, tear gassing and flash banging peaceful protesters in Washington DC and in Portland, OR.

– Review Trump’s commutation of the sentence of Roger Stone for illegality, specifically because the commutation was part of covering up Trump’s illegal behavior. Restore punishment for Stone if possible.

Review Trump’s federal judge appointments for conflicts, ineptitude and anything else that can be used to remove those who don’t belong. This is solely about bad appointments, not their political views.

Create law that will prohibit a future Attorney General from becoming the president’s Roy Cohn; i.e. the president’s attorney instead of ours.

Remove the conspiracy theorists from top positions in the Pentagon.

Challenge the DOJ memo claiming that a sitting president can’t be prosecuted for crimes while in office.

Apologize to our 16 intelligence agencies for 4 years of Trump’s insults, undermining, devaluing and for his jamming unqualified cronies into positions of power in these organizations.

Remove all former lobbyists from the Executive Branch and create law that prohibits former lobbyists from participating in any part of government where the industry they lobbied for is involved.

Replace the Trump/Barr suck up district attorneys and set these offices free to prosecute Giuliani, Lev & Igor, Trump family members and, of course, Trump himself.

Undo foreign policy unforced errors, including:

– Mend fences with allies, including NATO member nations, South Korea, Australia, Israel, Mexico – who else?

– Apologize to Angela Merkel, Justin Trudeau, Emmanuel Macron, the Kurds, Volodomyr Zelensky and the leaders and the people of all the “shit hole countries” for Trump’s insults, rudeness and harm.

– Apologize to Duško Marković, former President of Montenegro, for Trump shoving him aside for a NATO photo op in 2017.

– Apologize to our present and former State Department professionals, including Lt. Col. Vindman, Ambassador Marie Yovanovitch, Dr. Fiona Hill, Gordon Sondland, Mr. Kent, Ambassador William Taylor, and all those who put their careers on the line to tell the truth at the impeachment hearings. Honor them publicly.

– Give a firm, face-planted stiff arm to Xi, Duerte, Putin, Erdoğan and Kim. Make our opposition to their tyranny clear.

– Rebuild our Department of State. Lure back the wonderful people who were forced out or quit out of conscience. Trump’s actions are a George W. Bush déjà vu nightmare and they harm us internationally.

– Examine support for the Kurds and do what must be done to reverse our betrayal of this ally.

Restore Lt. Col. Vindman to active status, rank and post if he desires it. Restore his brother to his former post if he desires it.

Levy stronger and more painful sanctions on Russia for invading the Ukraine, their meddling in our 2016 election, their 2020 election meddling, attempting to steal vaccine research and offering/paying bounties to Taliban fighters to kill Americans.

Create and quickly implement a U.S. war on climate warming:

– Rejoin the Paris Climate Accord.

– Join the international agreement to combat deforestation.

– Establish federal incentives for installation of renewable energy.

– Establish federal incentives for clean energy innovation.

– Establish a path for re-education of coal miners – no, they won’t all become coders. Then end the use of “beautiful, clean” coal for energy production.

– Establish emission control policies, such as fuel mileage requirements.

Lead fundamental police policy change.

Install Supreme Court Justices who aren’t conservative – create balance.

Formalize the elimination of state sponsored voter suppression. Reverse the abuses of the past.

Create gun law reform, like 100% background checks and limits on the size of personal arsenals. Make illegal high capacity magazines, assault weapons and bump stocks and repeal the right of concealed carry, etc. These measures are overwhelmingly supported by the American people.

Do comprehensive immigration reform – finally!

– Enshrine DACA into law so that the next Republican hate monger can’t undo it with an Executive Order.

– Establish clear criteria for immigrating into the U.S. that is actually Constitutional.
