The Playground Lessons

When I was a kid the grown ups let me know when I behaved improperly and the messages were always very clear and compelling. That didn’t mean that I never did whatever-it-was again, but it did mean that I knew the rules and did whatever-it-was less and less often. I saw other kids learning that same hard way, too. “Betcha grown ups don’t get in trouble that way,” I thought, because, well, they’re grown ups.

Wrong.

Some didn’t learn their lessons,

like the huge community of Trumpist liars who never quite got the message that it isn’t okay to lie.

like the self-certain conspiracy theory followers who use their self-righteousness to bully others, even though they were taught on the playground not to bully.

like the rule benders who victimize others with their barely legal discrimination and hateful suppression.

like the shameful cowards who don’t stand up for what they know is right and don’t stand against what they know is wrong.

There are lots more, of course, but the point is that becoming an adult doesn’t guarantee anyone will leave childhood wrongdoing behind, even though we all know that it should. Some carry around their brattiness like a badge of honor all their lives and hone their skills with pride. They refuse to learn their lessons and you can see that any day in Congress and hear it constantly from the mouths of political blatherers. They all wear adult bodies, but inside some are just bratty kids from the playground.

Go tell their moms on them. Then they’ll be in trouble.

The Government Lesson

President Ronald Reagan famously and repeatedly said, “Government isn’t the solution to the problem; government is the problem.” That was an odd thing to say for a guy wanting to run government.

Surely, Reagan found a useful campaign tool in making government a boogie man. He gave people something to blame for their problems. He stoked the fires of discontent for his own benefit and left the resulting carnage to others. We are living in that carnage right now.

In contrast, President Biden now has our vaccination program humming along at over 2 million poked arms per day. We’re rapidly on our way to beating this horrible virus and restoring our more normal lives, all because government is the solution.

There are some things that even rugged American individualists cannot do on their own. That’s why we have government. Government is why we’re able to roll up our shirtsleeves and get vaccinated. That’s why Biden is decisively proving Reagan wrong. Because it turns out that government wasn’t the problem; Reagan was.

The Texas Lesson

Governor Greg Abbott issued an imperial proclamation that mask wearing is no longer required and all businesses in Texas are free to open fully as of today. That’s more than odd, given that it’s obvious that we have not defeated the coronavirus pandemic.

Worse, there are multiple mutant strains of the virus that are accelerating infections across the nation. They are more efficient in their transmission, meaning that we infect one another with even less exposure than from the original coronavirus. Worse yet, they are more serious and perhaps more deadly to humans. Surely, Governor Abbott knows this. So, why would he put Texans at mortal risk? I think I know.

Abbott knows that eliminating the mask mandate and opening up the state for full interpersonal viral transmission will result in massive numbers of Texans becoming gravely ill and many will die. I’m guessing that will affect fewer Democrat voters, as they are likely to wear a mask, Abbott proclamation or not. His order, then, will result in fewer Republican voters, thus helping purple Texas go Democrat for years to come. I think Abbott is a Democrat in Republican clothing.

Well done, Governor Machiavelli!

Carrots, Sticks and George Washington


George Washington’s Farewell Address was delivered to Congress in 1796. He offered profound wisdom to our young nation and his words have value that is undiminished by time. Indeed, it reads as though Washington had a telescope to see into the 21st century and address our challenges of today. His address is wordy in its 18th century style, but it is accessible with a little concentration and it is your reading assignment this week (click here to download the PDF).

Washington had great aspirations for the country he served selflessly through war and for years after that when he would have preferred to be in retirement on his farm.  Here is a piece of his hopes for this nation:

”  .  .  .  I shall carry it with me to my grave, as a strong incitement to unceasing vows that heaven may continue to you the choicest tokens of its beneficence; that your union and brotherly affection may be perpetual; that the free Constitution, which is the work of your hands, may be sacredly maintained; that its administration in every department may be stamped with wisdom and virtue; that, in fine, the happiness of the people of these States, under the auspices of liberty, may be made complete by so careful a preservation and so prudent a use of this blessing as will acquire to them the glory of recommending it to the applause, the affection, and adoption of every nation which is yet a stranger to it.”

The question now is focused on how we are doing in maintaining our brotherly affection, maintaining a free Constitution, ensuring that every department of government is “stamped with wisdom and virtue,” and that we have the happiness and liberty sufficient to recommend democracy like ours to other nations.

There are many Americans now wanting to bring our democracy and our Constitution crashing down and they are doing so while mouthing their perversely impassioned cries of democracy and liberty. We have politicians and blatherers spouting embarrassingly flagrant and witless lies to enrage our citizens against one another and our country. So much for our brotherly affection. And we have abandoned allies and supplicated to tyrants, hardly providing a recommendation of democracy to others.

It’s possible that we’ve back-slid on the path to Washington’s aspirations for us, so our focus needs to be on restoring the pursuit of those lofty goals. Right now it appears that we’ll need both carrots and sticks to begin to move in the right direction.

President Biden hit the ground running, even in the face of the refusal of Trump administration operatives to help in the transition, even in the face of their withholding critical information, even in the face of a complete lack of prior structure to tackle our national challenges and even in the face of their denials of Biden’s achievement and authority.

We are at last on a path to get the pandemic under control and stop killing thousands of Americans daily. We are on a path to restore economic security for our people and we’ve rejoined the global fight for our planet. We are in hopes of soon having the infrastructure program we’ve declared as critical for over three decades and which will benefit all of us in many ways. And we have begun to mend international fences with our allies and put tyrannical opponents on notice. All of that will go a long way to taming the fiery beast of American anger. Perhaps that will narrow our national divisiveness and make us safer here and around the world at the same time.

All are good things, but those carrots alone won’t be enough. It’s hard to picture Michigan Militia toughs suddenly becoming placid and deciding not to kidnap the governor or storm the state capitol with assault weapons, chanting like goosestepping morons about their freedom. The Proud Boys and Oath Keepers won’t miraculously stop calling for a new civil war and threatening to once again attack Congress. Even now they’re threatening to kill Democrats. They are bent on violating Washington’s hope for us, “that [our] union and brotherly affection may be perpetual.” Preventing their violence and chaos will take more than carrots; it will take some sticks.

We need an ongoing and very robust domestic intelligence gathering engine and powerful national policing to crack down on the violent hard heads before they harm more Americans and before they bring down American democracy. That’s the tricky part, because in doing so we risk becoming a police state, compromising the very liberty Washington recommended to us and celebrated. That will be a huge challenge for a very long time.

E Pluribus Unum


Perhaps you heard that in the face of the Texas winter nightmare Republican Governor Greg Abbott blamed the breakdowns and suffering on the Green New Deal. Of course, the GND is only an idea; nothing has been done to create its physical reality, so Abbott’s pronouncements were most perplexing. Besides, the wind and solar renewables that have been in Texas for years kept working as the fossil fuel plants shut down. His gubernatorial leadership seemed rather QAnon-ish and unhelpful.

Former Republican Texas Governor and former head of the Department of Energy Rick Perry said that “Texans would be without electricity for longer than three days to keep the federal government out of their business.” He also said that the current disaster shows that we have to double down on burning natural gas.

Perry made these claims even as climate scientists explained that the jet stream was altered by global warming and that the resulting redirection drove the frigid air that far south, all the way to Texas and northern Mexico. It’s incontrovertible that burning more gas won’t prevent the next arctic blast and it’s unlikely Texans want to experience yet more days without power. Like Governor Abbott, former Governor Perry’s comments were detached from reality and notably unhelpful at a time when help was needed.

“Don’t mess with Texas” is an attitude of fierce independence and pride in the Lone Star state and those politicians have used that attitude as their political tool. But the experts have made it clear that this stand-alone bravado and a mania for deregulation are key drivers of the Texas lack of preparedness for cold weather and the suffering it spawned this month.

In the face of our obvious interdependence, neither Texas nor, indeed, any part our country can go it alone in facing our deepest, most difficult challenges. It’s time to get over our self-puffing swagger, our self-serving pronouncements and leave the failed policies and attitudes behind.

We cannot “burn natural gas” our way out of our power and climate messes. We cannot “deny medical care” our way to health. We cannot “austerity” ourselves out of poverty. We cannot bootstrap ourselves out of natural disasters. We cannot suppress our way to security. We cannot hate our way into patriotism. It’s time – really, long past time – to deal with reality.

One reality is that everyone likes the idea of small government and low taxes. The companion reality is that we like that first reality only until the moment when disaster hits and we have to pull together. It’s called government. The Commons. It’s how we band together to do the things we cannot do alone. It’s why impoverishing government ultimately doesn’t work for us.

Philosopher and heavyweight boxer Mike Tyson said, “Everybody has a plan until they get punched in the mouth.” That’s when the old plan shows its weaknesses and we realize that we are in a fight for our lives and that we’re in it together. That’s when we drop the pretenses and get about doing what we should have been doing all along.

Like aggressively fighting Covid-19.
Like rebuilding our infrastructure before everything falls apart.
Like admitting that we really need some things to be regulated.
Like standing up to bullies.
Like ending our ongoing un-civil war.
Like educating all of our young.
Like preparing for a tomorrow that is going to look very different from our yesterday.
Like acknowledging that not everything is a zero-sum game.
.

That means that we must be an E Pluribus Unum, because without it we are self-defeating. Just ask anyone on our Gulf Coast who has dealt with frequent and ever-more powerful hurricanes, or any former homeowner in the burned out wreckage of California, or survivors of the I-35W bridge collapse in Minneapolis in 2007 or most any Texan right now,

Our being composed of such large numbers of people today make the E Pluribus Unum part difficult, because we humans are more comfortable in small numbers. But we’ve solved that puzzle before, once at our beginning and at other times since then, and we can do it again.

All we have to do is to deal with reality like an E Pluribus Unum.

American Idolatry at CPAC

People are bowing before a golden image of Trump at CPAC. It is the ultimate graven image of our time, today’s Biblical-political tale of debauchery and willful human debasement. That kind of idol worship over the last 4 years got us January 6. And now these people have their real Golden Calf to worship. The irony for Evangelicals is just too crazy.

This time for sure!

Said Mark Twain, “History doesn’t repeat itself but it often rhymes.” Here it is again in perfect verse.

I don’t anticipate divine intervention to halt the CPAC worship perversion, but there was that one time at the foot of Mt. Sinai  .  .  .

To the attendees at CPAC

You booed the woman calling for wearing face masks and shouted “Freedom!” in protest of her outrageous proposal to suppress virus transmission. What was she thinking?

Hold tight to your liberty to refuse to wear a mask. Breathe, cough and sneeze to the point of hypoxia in your asymptomatic self-certainty. Exercise your freedom by sharing your disease with your family and friends.

Just keep your cooties the hell away from me and everyone else who knows they have the freedom to not be infected by you. Freedom!

And no, I won’t visit you in the hospital when that respirator is shoved down your throat. Neither will anyone else. You’ll have the freedom to die alone.

You Have The Power


Arguably, even in the presence of moral outrages, assaults on democracy, compromise of our national security and even more, our most grievous shame of the past four years is our refusing fair treatment of people fleeing terrorism and the imprisonment of innocent children. Literally ripping babies – infants – from their mothers’ arms. We did that. It was done in our name.

We’ve begun to claw back some dignity by reuniting over 100 kids with their parents, yet there is so much more work to be done. Indeed, the prior administration literally had no reunification plan, no effort to create identification documentation, no thought whatsoever for these imprisoned people except to let them rot in concentration camps.

My friend Lee Goodman has been a champion for these people and has a report which you’ll find below. He calls us to action. If you listen well, you’ll hear thousands of men, women and children calling us to action as well. You have the power to answer.

Here is Lee’s report.

We worked hard and finally convinced the Trump administration to close the children’s detention centers at Carrizo Springs, Texas and Homestead, Florida in 2019. Earlier this week, Carrizo Springs reopened, and the Biden administration announced that Homestead will shortly reopen under a new name ˗ Biscayne. Carrizo Springs will be operated by the same company that ran it before. We do not yet know who will operate Biscayne.

President Biden is on record as opposing child detention and for-profit prisons. Dr. Jill Biden has pledged to help reunify immigrant children who were separated from their families. Vice-President Kamala Harris visited Homestead while campaigning, and she expressed her disapproval of child detention.

We don’t yet know what the administration has in mind. The Biden administration has taken a number of very positive steps on immigration. It is not continuing the Trump administration policy of deliberate cruelty in order to punish immigrants and discourage people from trying to come to our country. It is possible that these detention centers will be used to house children for just a few hours or a couple of days, until they can be united with their families.

But recent history makes us very concerned. Under Trump, children were unnecessarily held for many months. The hardship for the children and their families was enormous.

We are in contact with government officials and a number of groups we have worked with in the past, trying to find out what is planned for these detention centers. We will be watching closely, and we are preparing to make our voices heard if necessary, within the public safety restrictions of COVID. As before, we believe:

Our government should not separate children from their families.
Detention should be minimized, and reunification should take place quickly.
For-profit corporations should not be making money by imprisoning children.
Independent observers should be allowed to monitor conditions.
The federal government should make information about the children at the facilities available to the public.
Detention facilities should be overseen by state child welfare agencies.
.

Right now, I urge you to contact your Representative (find your representative using the search in the top right corner of the website) and Senators (find your senators using either pull-down on the top left of the website) and let them know how you feel about the detention of migrant children. The Congress is responsible for the children in detention. It enacts the laws that set the policy for our country, authorizes the money to carry out those policies, and exercises oversight of the federal agencies that implement immigration policy.

Lessons From a Senate Committee Hearing


The Merrick Garland confirmation hearing yielded a couple of unanticipated lessons, one of which we might have expected, but it arrived in a surprisingly moving and impactful way. The other was a fresh take on what happened on January 6.

Judge Garland responded to a question from Sen. Cory Booker (D-NJ) about why he wanted to be the United States Attorney General. Here’s what Judge Garland said – I watched it live – as reported in the Washington Post:

“I come from a family where my grandparents fled antisemitism and persecution,” Garland said. And then he stopped. He sat in silence for more than a few beats. And when he resumed, his voice cracked. “The country took us in and protected us. And I feel an obligation to the country, to pay back.”

“This is the highest, best use of my one set of skills,” Garland said. “And so I want very much to be the kind of attorney general you’re saying I could be.”

Does that work for you? Is that the kind of fiercely held attitude of service and integrity you want the chief enforcer of our laws to have? I think we can feel safe in entrusting our Constitution to this guy. And won’t that be refreshing?

One other thing was also prompted by Sen. Booker. He invoked the Bible, Micah 6:8: ”  .  .  .  to do justly, and to love mercy and to walk humbly with thy God.” Booker used that to frame a question for Judge Garland, but I got to thinking about those words and juxtaposing them with the cross carrying, Bible thumping, hate spewing, Jesus intoning violent people who attacked the Capitol Building and everyone in it or guarding it on January 6.

As these people ransacked the building, as they went hunting for Nancy Pelosi and Mike Pence in order to murder them in the name of their false patriotism, as they befouled the halls of Congress, what was their score in doing justly?

As they murdered several people, and injured 140 Capitol Police and DC cops, as they brutalized one cop trapped in a doorway and bludgeoned another with the staffs of American flags and baseball bats as he lay prone and defenseless on the steps of the Capitol, how were they doing in loving mercy?

Booker didn’t mention the walking humbly part, but did you see or hear any humility on the part of the hate-filled, raging insurrectionist mob that day?

It’s a most stark and shocking comparison between a humble man who longs to give back to the country that took in and protected his grandparents when they had nowhere else to go, and the hateful thugs who want to tear down every good thing this country stands for.

Every now and then Congressional hearings bring us something truly valuable. In these hearings we found a good man, this in a time when we dearly need good people.

Unavoidable Footnote

Sen. Ron Johnson (R-QAnon) used his five minutes in this hearing to make vacuous claims, like saying that the rioters carrying Trump flags and invoking his name were Antifa provocateurs and far left subversives. Claim after claim was not just false, but outrageously, cartoonishly false.

I believe Johnson to be reasonably intelligent, which eliminates his using ignorance as his excuse for saying such things. That leaves us only one other explanation: he lied. Now, why would he do that, especially in such a brazen and evil cartoon character manner?

I think it’s time for the Commissioner to shine the Bat Signal onto the clouds and summon Batman and Robin to clean up the pandering.

Trump’s Future, Dead Politician and Curmudgeon Corner


The Future of Trump

Memo to DC, Georgia, Pennsylvania, Arizona, Michigan, New York State, New York City, SDNY, the Justice Department and all the women he raped:

Indict the crook for inciting a riot, election interference, bank fraud, wire fraud, tax fraud, insurance fraud, money laundering, incitement to insurrection and sedition, bribery and the rest.

Indict Jr. and Giuliani for incitement to riot, insurrection and sedition.

To the women Trump assaulted, abused and violated: full steam ahead, all guns blazing.

Memo to broadcast and cable news organizations:

Continue to refuse to give that circus sideshow barker any air time. You made the mistake of giving him free, almost constant advertising in 2016, including wall-to-wall broadcasting of his campaign rallies, obsessing over his tweets and televising his every public word for five years. Don’t do it again. Ever.

Memo to all:

Bow your head and join with me in the Accountability Prayer:

Constitutional Fathers, we pray that He-Who-Should-Have-Been-Convicted will spend the rest of his life defending against civil lawsuits and criminal indictments. We pray that he is relocated permanently to federal and state penitentiaries. May he there make new acquaintances with the kinds of people he has diminished, insulted and discriminated against for decades, that he may learn the error of his ways through their traditional teaching methods. Amen.

Dead Politician Walking

Memo to Senator Ted Cruz (R-TX):

Perhaps your four years of being a Trump suck-up have combined with your lifelong self-absorption and self-righteousness to cause you to believe that you can jawbone the entire state of Texas into submission. From your various mea culpas it appears that you think you can blame your behavior on your daughters and spin your way out of this. But here’s the thing.

Texans are cold now, desperate for water and sanitation and electricity and Covid-19 vaccinations and they are semi-homeless due to bursting water pipes. They were lied to by their state government, even as the loss of power, heat, water and the rest rolled on, but they didn’t lose their sense or suddenly become stupid. They can identify the difference between you actually caring about them, doing whatever you can for them, and your complete abandonment of them. You went on vacation to Cancun in their hour of greatest need.

They see you for what you are, which is why you are now officially a dead politician walking.

Impeachment Final

The supreme rule, the imperative of imperatives for Republican representatives and senators was, with just a few exceptions, the protection and preservation of one’s own ass. Refusing to act out of integrity was an integral part of the process.

It’s an easy swipe to make at these legislators, but the unavoidable predicate is that We the People put them in Congress. To paraphrase the snake story, we knew what they were when we voted them into office.

Curmudgeon Corner

Flint, Michigan water poisoned thousands of children and adults with lead as a result of the actions of the local dictator appointed by former Governor Rick Snyder, who now faces criminal indictment. There isn’t a lot that can be done for those kids medically.

Other than some immediate liberal outrage and hand wringing, the poisoning happened and kept on happening both there and elsewhere, but our nation as a whole isn’t paying attention. Do you suppose things might have worked out better if this had started in Bloomfield Hills instead of in Flint? I mean, those Flint kids aren’t White.

Same issue for our schools in non-White areas. Mold, 12 year old text books with pages missing, leaking roofs, mice and rats and the rest of the low income education wretchedness goes on and on and never gets fixed. Meanwhile, in White areas the schools and text books are just fine and the roofs don’t leak. Really, if we gave a damn about non-White kids, would we tolerate this?

A large percentage of the people in this country cheered as Trump imposed his Muslim ban. In a First Amendment smack down, the Supreme Court declared that religious discrimination was legal. But, hey, it was against Muslims, so no problem.

QAnon supplies news to many Republicans, which is how they know that Jews funded by George Soros are operating a laser from space, the very laser that started the California wildfires last year. But we don’t care about the harm these pea brains cause with their idiotic conspiracy theories because, after all, they’re only hurting Jews.

There are still children in cages at Tornillo and there are concentration camps just across the Rio Grande packed with refugees fleeing terrorism. They are effectively imprisoned by our Catch-22 immigration system. These prisoners have faded to almost nothingness for most Americans, so there they stay, out of sight, out of mind. But, no worries; they’re just Hispanics.

I propose that we get over our hypocrisy and admit that this nation only cares about White Christians. The rest are only of value as they serve their betters. I mean, somebody has to pick the lettuce and do the landscaping and pick up the garbage and clean other people’s houses and those White Christians won’t do that work.

For decades we’ve allowed minority rule to serve power hungry White Christians, AKA Republicans. Doubt that? The majority of the popular vote has gone to the Democrat in all but one of the last 8 presidential elections, but we still moved Republicans into the White House. That was accomplished thanks to the Electoral College, a vestigial remnant of government having surrendered to low population slave states to give them outsized power. It was then and it still is a racist practice, but it serves White Christians well.

The same can be said for the filibuster, another racism leftover that was created for and historically was employed by Senate segregationists. They used it to oppose civil rights legislation and other racial equity issues. Now the minority Republicans use it to oppose anything Democrats like or that hints at moving toward racial equality. That’s all done by power hungry White Christians for the benefit of White Christians.

Right now thirty-three Republican state legislatures are finding ever more outrageous ways to prevent non-Whites from voting. We elect extremists to Congress who effectively poison the air with racial dog whistles. We tolerate all of that.

According to a recent American Enterprise Institute survey, 56 percent of Republicans believe “the traditional American way of life is disappearing so fast that we may have to use force to save it.” Thirty-nine percent backed an even stronger statement: “If elected leaders will not protect America, the people must do it themselves even if it requires taking violent actions.”

These are White Christians who are fearful their superiority might be slipping. You can see clearly what they’re willing to do to keep their superiority. Too bad for everyone else. And for the Constitution.

If we were actually against these injustices we’d be outraged and would take action, but we aren’t and we don’t. So, let’s just get over that “liberty and justice for all” business and the self-congratulatory “land of the free and home of the brave” declaration, because we really don’t mean it. We really don’t care. Perhaps it’s time to wordsmith the Pledge of Allegiance into something that approximates the truth.

Or we can at long last do something about our perversions of integrity.

Imagine That Little Chat


No Surprise

It was a shock, but no surprise. We have been cultivating Rule by Mob for decades. Incrementally, the extremists, the angry, hateful ones, have infiltrated our society and our government, first with a toe hold of buffoons in Congress, then with more zealots spouting patriotic sounding phrases, the true meanings of which are anything but patriotic. They puffed with each step of power grabbing, strutting like self-important peacocks. All they needed was a megalomaniac cult leader to manipulate and channel their rage.

We now have 140 representatives and forty-three senators* who are so broken, so beholden to their dear leader that they have made themselves shockingly blind to the obvious. The result is a disempowered Congress, an even greater public distrust in government and a giant step toward autocracy and fascism.

Because of Republican cowardice the January 6 assault on the Capitol, the insurrection, the sedition has now become a training exercise for more assaults, mob rule and the end of democracy. These cowards dishonored 245 years of patriots and patriotism.

And they did it on our watch.

Impeachment – the Trial

To be fair, Trump’s attorneys had no way to defend him with facts or with law, since all the facts and all the law were against him. They had nothing substantive to work with. That left them only distraction, disingenuous arguments about process that had already been settled, attempts at smearing Democrats and whataboutisms. So, with great passion and righteous indignation attorneys van der Veen, Schoen and Castor claimed what follows. See if you can identify the theme. Editorial comments are in italics.

A lot of Democrats didn’t like Trump.

Something about Antifa.

It was whataboutism. The political left was not on trial. Plus, Antifa is a political idea, not an organization. It’s like they blamed the insurrection on grumpy.

Congressional Democrats refused Trump due process.

This was said literally as attorney Schoen was defending Trump in the exact venue of his due process, precisely as proscribed in the Constitution.

Elizabeth Warren and some other Democrats used the word “fight.”

There was nothing offered to suggest that any of the Democrats’ use of the word “fight” had anything to do with themselves or with Trump inciting riot, violence, insurrection and sedition. Besides, the Democrats were not on trial. Trump was.

Some bad things happened at some BLM protests.

BLM was not on trial. Trump was.

Some Democrats objected to the counting of electoral college votes in 2017.

There have been times when Democrats have had questions about election integrity.

Jerry Nadler opposed the impeachment of Bill Clinton.

Trump has First Amendment rights that the House Managers sought to refuse him. Castor presented an in depth recitation of case law about freedom of speech.

The First Amendment does NOT protect Trump or anyone else from prosecution for incitement to riot. It is akin to the denial of freedom of speech to falsely yell “FIRE!” in a crowded theater. Castor’s argument had no applicability to the proceedings..

Democrats hate Trump.

The House Managers were intellectually dishonest.

Some Democrats have spoken of punching people and have joked about the death of opponents.

Some law professors and the House Managers were mean to Trump’s attorneys.

Righteous indignation was expressed with great energy.

Jamie Raskin is a hypocrite.

The House Managers manipulated information and tried to trick the jurors.

This is just a sampler of the things said by Trump’s attorneys. Have you spotted the theme?

There was exactly one count of impeachment against Trump: that he incited an insurrection that violated the Capitol Building, the Constitution, the Congress and killed a lot of people. That was the only thing in question.

So the theme of all of the defense counsels’ arguments is that nothing offered in Trump’s defense addressed this one and only question. Which is to say, Trump’s lawyers presented no defense whatsoever. Zip. Nada. Bupkis. All they brought were various forms of distraction, and tragically, treasonously, that was enough. In the Through the Looking Glass America of the past several decades, that has been the through line of Republican politics. It has resulted in minority rule.

In an effort to support the unity that President Biden seeks to bring to our country, I offer a positive response to these defense counsels. Rather than diminishing these fraudulent men and their pitiful, disingenuous presentation, let us embrace them in an appreciation of their thankless, impossible task and simply hope that they got a fat retainer from Trump up front. Otherwise, they’ll be just like most of Trump’s other attorneys: unintentionally pro-bono bozos.

The damage has been done. Now it’s up to us to figure out how to carry on with some version of democracy, how to sustain the republic bestowed upon us by the Founders. Come to think of it, imagine having a conversation with Thomas Jefferson or Benjamin Franklin or any of them. Imagine that you’re bringing them up to date on what we’ve done with the country they birthed at such great peril to themselves and with such great hope. Go ahead; imagine that little chat.

Impeachment – Second Chance to Get This Right

Since the beginning of his candidacy in 2015 the disgraced former president stoked violence against those who opposed him, including a continuation of his cavorting in the swamp of racism. He urged violence on protesters at his rallies, even guaranteeing legal fees for those who violently attacked protesters.

He began dog whistles to mob violence long before the November 3 election by claiming the only way he could lose is if the “election is rigged.” He went on to whine about fraud in nearly every public statement for months, but it was fraud that did not and does not exist. That was made abundantly clear by the judicial rejection of the over 60 lawsuits he brought.

He warned ominously that if he didn’t win he and his followers would be cheated. He fired off flare after flare of victimization of his followers to ignite their rage. He threatened them with loss of “their country” if they didn’t act forcefully. He told his followers there would be a big protest in DC on January 6, to be there, that “It will be wild” because “something” was going to happen. It was an only slightly vague message of “We’re going to show our muscle and take over the country.”

Of course, he didn’t explicitly say that last. Recall that Michael Cohen testified before Congress that Trump speaks in code like a Mafia don. So, he didn’t tell his rabid followers to go to the Capitol Building, trash it and find legislators, especially Nancy Pelosi and Mike Pence, and kill them. Instead, he called them to DC, promising a big event. He wailed about fraud and how his followers had been cheated for so long. He told them to march to the Capitol Building and “fight like hell or you won’t have a country any more.”

After months of inciting rage, he set his angry mob loose, directing them to the Capitol Building to fight like hell. And they did.

When such a thing is done in a Central American or Eastern European country it’s called an attempted coup.

Everyone knows all of that, including the Republican Senators and Representatives who could have been killed if Trump’s mob had found them. That leads to the next questions for Republican Senators who are yet to vote on the charge identified as House Resolution 232-197, Impeachment of Donald John Trump for High Crimes and Misdemeanors, Incitement of Insurrection:

What is your resistance to convicting this traitor on the charge of inciting a murderous riot and insurrection – sedition? Recall that you witnessed it, so there’s no question about guilt. (Hint: There is nothing conservative in allowing someone to get away with sedition.)

Seven people are dead due to Trump’s treachery and hundreds are injured. Do you not care because it wasn’t you who got beaten by the weaponized staffs of American flags?

Is this all about you and your political career, such that the “preserve, protect and defend” part of your oath of office is secondary to the demands of your radical base and your selfish prospects for re-election?*

Republican Senator, maybe you’re a believer in an afterlife. Based on many of your past actions you just might be concerned about significant heat following your demise. You still have a little time to do what is right before the very worst thing happens. It’s worth considering. All that’s at stake for you is eternity.

So,

In this impeachment trial, what will you do? (Hint: There is nothing conservative about letting traitors get away with it.**)

2017, Charlottesville, VA

White supremacists and neo-Nazis amassed in a rally of hate, where counter-protester Heather Heyer was killed – run over by an automobile driven by one of those white supremacists. The President of the United States told us there were “very fine people on both sides” and expressed nothing for Heather Heyer. He faced no consequences for coddling hate groups.

January 6, 2021, Washington, DC

White supremacists and neo-Nazis amassed in a rally of hate at the Capitol Building, where seven people died. The President of the United States told us that the insurrectionists were patriots. These are the very same people who vandalized the Capitol Building, symbol of our country, and threatened to kill congresspeople and the Vice President. They killed one cop and injured 140 more. Trump expressed nothing for the dead and injured cops. He said he is proud of the rioters and that they are very special. He has been impeached, but the Republicans in the Senate are threatening to refuse to convict him for his obvious crime.

Refusing to hold wrongdoers accountable inevitably leads to far worse behavior and ever-more dangerous outcomes. History is replete with examples of this and if we fail in our duty now there will be a worse megalomaniac in our future and we will not be able to prevent the death of our democracy at the hands of an enraged mob, incited by one who hates what we say we hold dear. We ignore the lesson of history at our inevitable peril.

White Privilege


The trial in the Senate of the Disgraced Awful Former Terrible President (“DAFT-P”) is underway and the attorneys for the DAFT-P have done a fine snow job to this point. They had to do that, because neither the law nor the facts are on their side. All they had were a distraction dance and a weepy story about sailing.

Yesterday’s session was to argue whether the trial itself is constitutional, now that the F part of DAFT-P is most decidedly accurate. By now you know that the trial will proceed.

The end result appears to be a foregone conclusion. That is specifically because of Republican cowardice in the face of the extremist voters in their primaries. Said another way, these Republicans are afraid of their constituents. I very much want them to prove me wrong, but I don’t think they will. Meanwhile, there are some very talented lawyers working this case and this trial is history in the making, as well as a living civics class. I urge you to watch the proceedings.

And keep an eye on the Republican efforts in Arizona, Pennsylvania, Michigan and Wisconsin to recall their election results and turn over their paper ballots to Republican legislators for them do a partisan recount. DAFT-P’s evil fraudulent election Big Lie is not dead.

Fun Fact: Mitch McConnell voted that a trial of DAFT-P is unconstitutional because he is no longer president so he cannot be removed from office. McConnell himself is the person who prevented the impeachment of DAFT-P from reaching the Senate until after the inauguration when DAFT-P was no longer in office. Pretty slick, Mitch.

Reminds me of McConnell refusing to give a hearing to Judge Merrick Garland for a seat on the Supreme Court, saying that no justice had ever been seated during a president’s last year in office. That proved to be one of those “alternate facts” that isn’t factual at all. Mitch the Manipulator, consistently putting the “hum” into humbug.

After George Floyd was murdered by cops the world took to the streets in protest. It seems that at last there is some recognition by Whites that perhaps it’s time for people “of color” to be treated properly, treated fairly, treated as well as Whites are treated.

I think my heart is in the right place about race, so I took to heart that call to change and had a look at whether I might have been and still am a lucky guy with white privilege. Here’s a short inventory.

I’ve never been pulled over by a cop and hassled for driving while White.

I didn’t have to give my kids “the talk”.

I’ve never had a problem getting a taxi ride in any city I’ve visited.

There hasn’t been a single incident of someone coming toward me on a sidewalk and crossing to the other side of the street to avoid me.

No one has ever expressed surprise at my eloquence or intelligence.

Neither I nor my children have been shot by police while playing in a park with a toy gun.

Nobody has ever asked to touch my hair because they’ve never before touched hair like mine.

Not even one cop has put a knee on my neck.

No cop has fired bullets into my house or arrested me on suspicion of intent to steal as I was about to enter my own house.

I’ve never been the last hired or the first fired.

I know where all of my ancestors came from and most of their names 3 generations back. None of them was enslaved.

I’ve never been followed in a retail store.

I got a mortgage easily and was able to buy a house wherever I chose.

Nobody suspected that the only reason I was hired was because of my race.

No vigilantes have followed me or tried to gun me down.

I’ve never been asked to speak for my entire race.

I’ve never been handcuffed and slammed onto the hood of a police cruiser.

I just go about my life pretty much as I please.

Long, long ago I wondered why everyone didn’t do the same and couldn’t they live as they wanted like I did? Turns out the answer, of course, was and is no.

The January 6 white supremacists didn’t worry about police shooting them the way police had assaulted Blacks in our cities last summer as they marched for Black Lives Matter. Yes, there was some violence and vandalism during some of those marches.

But there was nonstop violence and vandalism on January 6, yet there was no SWAT team and there were no riot police to confront and brutalize the nearly all White mob, as had happened in Kenosha and Portland and elsewhere last summer. No National Guard showed up firing rubber bullets like they did in Lafayette Park, even as those horrific things were done in and to the Capitol Building and a noose for the Vice President hung outside it. None of the insurrectionists was zip-tied and thrown into a police meat wagon, as BLM protesters had been.

And no White teenagers crossed state lines to kill the January 6 rioters. Not even one.

Now, why do you suppose those differences exist?

How It Works


In the first Star Wars movie there is a scene with Darth Vader and the officers of the Imperial star ship. The commander says,

 

“The Imperial Senate will no longer be of any concern to us. I have just received word that the Emperor has dissolved the council permanently. The last remnants of the old republic have been swept away  .  .  .  Fear will keep the local systems in line.”

That’s pretty much how Hitler did it. He didn’t actually make the Reichstag go away. He just neutered it into becoming a lap dog by means of The Enabling Act of 1933, which the council members passed due to fear for their lives.

It’s pretty much the same in Putin’s Russia, Erdoğan’s Turkey, Xi’s China and Duterte’s Phillippines. Eliminating legislative oversight is what authoritarians do to hoard all power for themselves. Most often it’s done with thug tactics. Just ask Putin opponent Alexei Navalny about his experience with Putin’s nerve poison. The message is always to do what the leader wants or be killed.

Shift to January 6, 2021, Washington, DC. It was a violent mob dispatched by Trump, a riot of Jesus-bannered, cross carrying thugs, including the Proud Boys, Oath Keepers, neo-Nazis, white supremacists and other militia hoodlums. They were there to overthrow the government – to eliminate Congress – so that Trump could take over the country.

Does that sound so extreme as to be preposterous? If so, you need to pay closer attention, because that’s exactly what those thugs said they were there to do, all at Trump’s bidding. They were there to murder any House or Senate members they found. They brought a noose to lynch Mike Pence. Those aren’t things people do in order to preserve their government.

Capitol Officer Brian Sicknick

And killing Capitol Police Officer Brian Sicknick isn’t what people do to protect and defend the Constitution.

Sicknick died defending 535 members of Congress and the symbol of America that is the Capitol Building. He was killed by Bible-thumping American terrorists, who most certainly weren’t promoting law and order or doing what Jesus would do.

Both before and since the insurrection, members of Congress have received death threats* to themselves and to their family members. As that is happening, Trump and 140 Representatives, 45 Senators, right-wing blatherers and all of those extreme hate groups are continuing to promote the Big Lie to overthrow the will of the people; i.e. to put a stake through the heart of democracy.

For any remaining skeptics: If not to overthrow the will of the people and democracy, what do you think that election fraud Big Lie is about? Surely, you don’t think those rioters are play acting when they attempt kill those in Congress. Surely, you don’t think they believe in democracy when they attempt to trash the votes of millions of Americans.

This is how democracies die. A cult leader exhorts fanatics, the thugs terrorize all opposition and incrementally people surrender to death threats and violence. And that’s advanced when 199 of our legislators give a standing ovation to the Qanon conspiracy nut case spewing fascist hatred. Yes, fascism can happen here in America.

I’ve exhorted readers to see what Vice President Wallace had to say about fascism in America. If you believe in democracy and have not yet read his essay, please read it now.

These violent, angry thugs won’t simply melt away if Trump disappears or if this current insurrection fails – and no, it isn’t over yet. You can expect acts of terrorism, including mass shootings and bombings and perhaps political assassinations over the coming years, as highly armed, angry, hateful, bigoted, self-righteous thugs continue their war against America.

Note that violence is only being conducted by right wing fanatics. Any attempt at “whataboutism,” any attack on the center or left to somehow justify this terrorism isn’t only a false equivalency; it’s a religiously bigoted threat to the life and safety of every American and it is an assault on our democracy.

There have been ongoing efforts to bridge our massive national divide. The truth is that I haven’t a clue how to make piece with the guys wearing Auschwitz t-shirts or the Naples, FL supermarket owner who claims 400,000 deaths are a lie and that the pandemic is “total hogwash.”** Perhaps worse, I don’t feel compelled to make peace with them.

Their baseless certainties represent the kind of reality denial that drives American terrorists to violence. Besides, the supermarket guy is allowing his mask-free store to be a super spreader center for Covid-19 infection. That’s another act of American violence.

I’m all for our learning to talk with one another constructively, to make peace, perhaps to have a truth and reconciliation commission. But that can only happen after violence is no longer a threat and democracy is secure. Reference: South Africa.

Now it’s time for all of us to stand and be counted in support of the FBI and whatever resources they need to stop the barbarians, including identifying the January 6 criminals. It’s imperative that we eliminate the clear and present danger that these home grown killers and desecrators are.

The terrorists have already breached the gates of democracy and are buoyed by their treasonous actions because they see January 6 as a victory for themselves. If we are to continue our bold experiment in self-rule, we better get some victories notched against the barbarians damned fast.

* For spewers of death threats, we all know that your anonymous threatening brands you a coward. It’s the act of people with such low self-esteem and sense of impotence that it’s the only thing they can find to help them feel powerful. With that in mind, I offer you a wish:

I wish you a pony in your back yard and a new bike to replace the one you ruined. I wish you unicorns crossing your path and pink, heart-shaped candies on Valentine’s Day.

Then, when you’re feeling all sweet from the candy, my real wish is for you to call or write those you threatened. Apologize to them and beg for forgiveness as an act of contrition. It will be your first step back into the embrace of democracy.

** That isn’t a hypothetical example; it’s what the guy said.

In fact, many people are claiming that Covid-19 is a hoax, even as they see death all around and see our over-maxed hospitals with exhausted, weeping staff and even as these deniers themselves gasp their last breath. I don’t understand that and have asked for an explanation, but none has been offered, so I’m asking again. If you can explain that, please do so in the Comments section below to help us all to understand.
