Thinking About Long Term Ramifications

First, a heads up.

I talked with a woman who is involved with supply at our local hospital. I offered supplies I have on hand, including a handful of masks and a couple of large boxes of vinyl exam gloves. She said that they are in the process of setting up a receiving station for donations and will be posting on their website what their needs are expected to be. It’s not too big of a leap to expect that all 6,146 hospitals in the country will need that kind of help. So, call your local hospital or clinic or look at their website and find out what they need. You just might have it.

As this woman told me,

“We can see the train is coming fast and we’re still laying tracks.”

If they are going to be able to help others – perhaps even you – they need our help NOW. Pick up the phone.

Everyone is stressed both by the immediate changes in our lives due to the coronavirus and by the unknown that seems to be all around us. It certainly is waiting for us up ahead.

I’ve been thinking about possible longer term ramifications of this pandemic on levels beyond our day-to-day lives. There are a lot of areas to explore and right now I want to have a look at how some might exploit this upheaval-by-pandemic for their own benefit and to the detriment of us.

First to come to mind is Donald Trump. Given that his sole focus is on what is good for himself, I can easily imagine him using this national emergency to cancel the general election in November and make himself king. Congress and the courts are going to have to grow a spine in order to stop such an outright theft of America and I have my doubts about whether they’re up to it. Trump-Republican legislators have shown conclusive proof that aren’t capable of the task and we have to wonder if the Trump-stuffed Supreme Court would would have the courage to decide against him. Trump has toyed with this idea of never leaving office and that was before there was a pandemic he could use as an excuse.

Next on the list is Russia. I don’t know what Vladimir Putin might try, but he’s all about self-enrichment and restoring his country to USSR status on the world stage (read: ego puffing). His methodology doesn’t much include growing Russia or the welfare of his people, but instead he’s all about taking down other countries. It’s the classic inferiority-complex bully tactic – making someone else less-than in order to be on top. Perhaps he’ll have Russian tanks invade neighboring countries while we’re weak. There’s nothing new about Russia doing that sort of thing. Maybe he’ll extort European countries by withholding Russian gas and oil next winter. I’m not clear what he might do to take down western democracies including the U.S., other than stealing elections using his cyber thugs, but I bet he is.

China is entirely about world domination and the U.S. is both its biggest obstacle and its easiest tool. They will come out of the pandemic months before the U.S. with a billion and a half workers who are healthy, hungry and subservient to their manipulative, diabolical government. China has issued government subsidies to help Chinese companies under-price American goods and they took over 3.7 million jobs from the U.S. just since 2001. Plus they’re holding $1.1 trillion of U.S. debt, about a quarter of our total foreign debt. That’s a lot of leverage. Would they crack down on Hong Kong or swallow Taiwan during America’s time of weakness? As with Russia, I’m not clear what they might do to harm others for their benefit, including harming the U.S., but I’m confident President Xi is.

What about North Korea? The coming months might be just the time when Kim will make a move on South Korea to annex it, to create “One Korea,” knowing that the U.S. is only hobbling along in a weakened state and can’t or won’t do much about it.

Here are the key questions:

  1. Who in our government is thinking about such things? Given the bumbling, reactionary, transactional nature of this administration, is anyone thinking strategically and beyond next Thursday?
  2. Are there plans on the shelf to deal with these threats and are they up to date? If not, who will do something about that and when?
  3. Will anyone pull the trigger on these plans if one outcome of doing so is unfavorable to Trump’s personal welfare (e.g. no Trump Tower-Moscow)?

Now, a Long Term Ramifications Mini-Feature

There’s something about we human beings that, whatever the issue, we typically don’t really get it until it’s relatable to us personally.

So it was for Pharaoh enduring the plagues, Exodus tells us. He wasn’t motivated until the 10th plague, the slaying of the firstborn, which took his own son. Then it was personal enough for him. That’s when he got it.

That same inability to get it without feeling a personal impact is with us today.

Mark and Heaven Frilot of Kenner, LA weren’t much moved by claims from our medical community of the coming and rapidly spreading pandemic and many in their town scoffed at warnings, believing them to be just political ploy. They did that right up to the moment when Mark wound up in the hospital and was diagnosed with COVID-19. He hasn’t been able to breathe on his own since then and friends and colleagues are wondering if contact with him has caused them to be infected. Heaven and her neighbors aren’t scoffing at the virus now, but it had to come up close and personal for them to really get it.

As the author of the report about Mark and Heaven Frilot writes, “Crises are political only until they are personal.” And people scoffing and refusing to believe the experts until they themselves are touched by this disease will inevitably be cavalier or worse about transmission. Their flip disregard will make it spread faster and farther. This age of disbelief in science, learning, experts and provable fact is fertile ground for enormous suffering and unnecessary death. And that’s a very long term ramification.

Finally, from the “I wish I were making this up” file  .  .  .

At his press conference on Monday, March 23 President Trump explained that George Washington kept two desks and implied that one was used to run his personal business, the other for Presidential duties. He compared himself to Washington and whined that nobody complained about what Washington did.

Then he reminded everyone for the umpteenth time that he has refused the presidential salary and whined yet again that no one has thanked him for doing that.

In other words, in a time of worldwide sickness and death and economic hardship, a time of disruption and fear when all in this nation are looking for leadership, someone to trust to have their welfare in his heart, someone with clarity to lead us out of this darkness, instead it’s all about Trump and how he’s a poor victim.

Yes, many of our governors and mayors are stepping up and providing wonderful leadership, but there are some things only the federal government can do. We need reason to have confidence that they’re being done to the very best of our ability as a nation. We’re still looking for that.

Leadership is a peculiar thing and it’s most necessary in times of crisis. If it doesn’t show up soon, what are the long term ramifications of that?

Fact Checking And What It Means

In his presser of March 19 Donald Trump said things that are factually untrue. Sad to say, they have enormous impact. For example,

From STAT:

Trump ”  .  .  .  said a new drug for Covid-19, yet to be proved safe and effective, was now ‘approved or very close to approved.’ Another, also not approved for coronavirus, would be ‘available almost immediately,’ in part because using it is ‘not going to kill anybody.’

“Then, minutes later, the commissioner of the Food and Drug Administration, Stephen Hahn, took the dais in the White House briefing room and delicately walked back each one of Trump’s statements.”

So much for treatments for our COVID-19 sufferers.

Trump announced from that same podium that millions of hospital masks are on the way. When asked for specifics he barked, “We aren’t a shipping clerk.” He’s probably right about his mean-spirited shipping clerk blurt, because hospitals and clinics aren’t receiving shipments of masks. And they aren’t just running out of masks, they’re begging people to sew masks for them at home. Because of that, our healthcare workers are at heightened risk of becoming hospital patients themselves. So much for millions of hospital masks on the way. That’s the kind of harmful impact Trump’s lies have in this crisis.

Here’s the big one: He said that we knew nothing about COVID-19 until very recently because the Chinese hid the information.

FACT: The Chinese did hide information, which is why we didn’t hear about it in November 2019.

FACT: A World Health Organization epidemiologist sent warnings about COVID-19 on January 9; the CDC got the word out on January 6; the Canadians announced the coming of this pandemic in December 2019.

Everyone knew this was coming.

The result of this administration and President Fantasyland ignoring the international warnings and all the data is that WE ARE TWO MONTHS BEHIND IN TAKING ACTION. Whatever we’re doing in March could have been done in January and hospitals would have masks by now, and doctors might even have test kits.*

Well in advance of the arrival of this disease we knew plenty and increasingly knew more about it. We knew it was potentially deadly, that it spread from person to person in much the same manner as the flu and that if we didn’t take strong, positive action that very bad things would happen. And we knew that we had to protect our healthcare workers or it would become a double whammy of them becoming yet more sick people and fewer healthcare workers available to provide care.

We knew that significant respiratory ailments were part of the symptom package of this disease, so we knew we would need way more masks, respirators, ventilators, oxygen generating equipment and hospital beds. And we would need hundreds of millions of test kits. But as late as last Friday we were still getting magical thinking from President Fantasyland that this disease would suddenly, magically disappear. And the fictions keep on coming.

We’ve had the data from China and South Korea for a month and a half and from Italy since February. We know how this disease is passed, how fast this virus spreads and we know what these countries have done to tame it and the effects those actions have had. We’re not flying blind, except for the willful ignorance of this President and our federal government. And it’s not just the White House making things worse.

The House passed a bill on March 14 to help people affected by this disease with both cost coverage for testing (if the test kits ever show up) and for treatment (if that ever arrives) and economic help to offset reduced incomes. The Senate knew this bill was on the way, but Mitch McConnell put the Senate in recess so they couldn’t even have a look at it until 4 days later. In other words, they wasted half a week in protecting Americans.

The result of all of that is that thousands of people are infected and some will die who might never have contracted the disease at all, had we taken proper precautions early on.

Trump has spent his life in self-promotion and is using COVID-19 to do more of that. He is now calling himself a “wartime president,” perhaps for the cachet he think it bestows upon him. He always deflects and blames others, so he’s calling this a “foreign virus” and the “Chinese virus,” which are handy names to use so that people blame the Chinese and not him for the rapid spread of this disease.

Indeed, he always invokes an enemy, like caravans and Muslims and the press and immigrants and Democrats and Nancy Pelosi and more. That keeps his followers from focusing on his ineptitude and culpability and engenders undeserved sympathy. And now all his victim-hood, flights of fancy, finger pointing, magical thinking, and outright lying are producing only four things:  a more devastated economy; more fear; more sick Americans; and more dead Americans.

One of the key reasons people voted for Trump in 2016 is that he wasn’t a politician. This was at a time when the Congressional approval rating was just 13% (it’s only 21% now). We’d had it, or, in Bernie-speak, we were sick and tired of politics as usual. So, we brought in a circus barker. And we sure didn’t get a politician.

A politician would have known to get in front of this disease before it became a pandemic that would destroy political careers. In the process of covering his own ass, a politician in charge during this crisis would have covered ours.

But no such luck for us. We’re stuck with brainless magical thinking and quarantining ourselves, with millions laid off and disaster at the doorstep of every hospital in the country.

So, if this sounds like an angry post, you damn well know why.

P.S. #1: 20 – 25% of Americans don’t trust experts. What do you suppose that will mean for our national fight for heath measures to stop COVID-19 when these people are fed a continuous stream of hateful, anti-expert lies by the President?

Q. Why doesn’t President Trump order the construction and supply of massive numbers of COVID-19 test kits?

A. Because we’d find out how dramatically worse our situation is, how many more people are sick and his numbers won’t look good. Always remember: It’s all about Trump looking good. The hell with sick people and their needs.

Brats and Beer

On March 8 I gave a heads up about what we can expect from Republicans in the upcoming general election campaign. I wrote,

The Democratic nominee can expect filth, lies, false associations, fear mongering, muck making, more lies, voter suppression, plus nonstop lies.

And it has already begun.

Do you remember the six (yes, SIX!) House investigations of Hillary Clinton over the Benghazi incident? And the other four? We wasted millions of dollars investigating an evil Republican fantasy. Every one of those gratuitous hearings found Hillary guilty of nothing – NOTHING! What the dishonest Republicans managed to do was to keep a very sad incident before the public for years, sliming Clinton with implied guilt. We don’t know if or how many voters were turned against Clinton by that wretched performance of deceit, but the Republicans are doing it again.

Ron Johnson (R-WI) is the Chairman of the Senate Homeland Security and Governmental Affairs Committee, which has been investigating Joe and Hunter Biden and their connections to Ukraine for months. They have been doing that in spite of the fact that the proper agencies have investigated and found absolutely nothing untoward was done by either Biden – NOTHING! But the Republican smear campaign is already rolling and in high gear.

What is clear as can be is that the Republican toadies for Trump want to keep the Biden-Ukraine connection in the public eye until, say, November 4 with the goal of smearing Joe Biden as they did Hillary. As abhorrent as that is, there is good news embedded in it.

Ron Johnson is running for re-election this fall. The good people of Wisconsin don’t like dishonesty and are already less than crazy about him (approval rating of 28%). They may very well send him packing. In Wisconsin, after all, they know when the beer has gone flat and the bratwurst is rotten.

Eulogy

The Senate of the United States has officially declared the Rule of Law to be dead. The declaration of death was ensured by an almost perfect party line vote.* The Secretary of the Senate has recorded the death certificate into the formal Senate historical record so that future generations will know the truth of what was done in order to help them to understand what caused their dire circumstances.

Mourners noted that the succumbing of the Rule of Law to the terminal illness of cowardice had long been predicted because of the absence of what should have been protecting it. Many had suspected rigor mortis at the upper levels of government for quite some time.

In an impressive impersonation of a potted plant, Chief Justice John Roberts presided over the impeachment trial of Donald Trump, where the final battle for the Rule of Law took place. His black robes gave an air of dignity to the mostly tawdry affair.

Sadly, it was clear from the start that the black robes of the nation’s chief jurist, absent any action on his part to preserve and protect, weren’t up to the task of ensuring that the Rule of Law would endure. The task was made far more difficult by the efforts of the counsels for the defense to mask truth and even rewrite the Constitution. They went so far as to prevent pertinent evidence from being presented and declared that the President is above the law and is officially allowed to do whatever he wants to do. One Republican senator was overheard declaring to colleagues, “We don’ need no stinking laws on the President.”

Said one observer, “The Rule of Law had a long and fine run. It did what it was supposed to do most of the time and it has served us well. It seems, though, that the Senate has decided that we no longer need it and that we should revert to the divine right of kings and dictators. No telling how we’ll adjust to a Kim Jong Un type of autocrat.”

In lieu of flowers, mourners are invited to make contributions to Democratic candidates for the November election. They are further encouraged to secure promises from candidates that, once elected, they will resurrect the Rule of Law and restore it to its proper stature and function in our democracy, should our democracy still exist then.

  • * Note to Mitt Romney: The nation turned its lonely eyes to you, but try as you did, the job of saving the Rule of Law was too big for one man. Nevertheless, we honor you for your integrity and courage to do what is right. Perhaps in some distant future others will hear your call. For now, though, know that millions of Americans stand with you in the face of the threats and hatred thrown at you by people who just don’t understand.

Profiles in Cowardice

Alan Dershowitz has never seen an opportunity for attention that he didn’t covet. He hasn’t exhausted his reservoir of outrageousness, nor fully plumbed the hollowness of his integrity; however, he may have come close last week.

As a member of Donald Trump’s impeachment defense team, Dershowitz proclaimed the absence of Constitutional guardrails limiting a president, a concept that isn’t just outside the mainstream; it bears no resemblance to the Constitution at all.

Alan Dershowitz told the world that if a president believed that his/her reelection was in the best interests of the country that they could do whatever they wanted to do in order to ensure their reelection – including the soliciting of foreign interference in our election – and it would not be impeachable!

Apparently, in DershowitzLand there aren’t any limits on what presidents can do, so perhaps they really could shoot someone on 5th Avenue and not be subject to prosecution or impeachment.

This is the same nonsense as Richard Nixon telling David Frost, “Well, when the President does it, that means that it is not illegal.” That’s Kim Jong Un murdering anyone he’s a little cross with today. That’s Vladimir Putin killing political rivals in Red Square. And Idi Amin, Pol Pot, Slobodan Milošević, Josef Stalin and all the other murderous, genocidal, ethnic cleansing maniacs getting away with what they do because there are no guardrails. That’s Trump saying, “Then, I have an Article II, where I have the right to do whatever I want as president.”

Dershowitz is telling us that Trump is correct and 53 Republican senators are refusing to say “NO!” If this craziness comes to pass, they will have invited dictatorial brutality into America. Not today and maybe not tomorrow, but not too many tomorrows from now. Can the very despotism that the Founders rebelled against be far away?

I can’t handle the ache it would cause to fully refute Dershowitz’s stupid, idiotic, unpatriotic befouling of the Constitution. The point for now is the cowardice he displays by sucking up to this president with his outlandish behavior.

Professor Dershowitz is not alone in his Constitution demolition efforts. His un-American words were compounded by defense attorney Patrick Philbin’s argument that, “American politicians can accept damaging information on their opponents from a foreign country.” Yes, he’s telling us that it’s okay for foreign governments to contaminate our elections and that America is for sale to the highest bidder.

Patrick Philbin is just as cowardly and just as guilty as Alan Dershowitz in claiming idiotic views of the Constitution that would have gotten them both laughed off the Senate floor just a generation ago. Adam Schiff called this craziness, “The normalization of lawlessness.” Schiff is right.

And let’s recognize what the Republican senators are doing as they sit in quiet cowardice, shooing the Constitution off a cliff with their refusal to acknowledge truth and stand up to this lawless president.

I still can’t get my head wrapped around the fact that there had to be a debate over whether there would be witnesses and documentary evidence presented in this trial. Why was this ever a question? How do these senators manage to look in a mirror, knowing they have sold their souls for a handful of beans?

On the other hand, the beans really are magic. They ward off Trump calling these senators mean names and lets them keep their seats in Congress. Yes, that does mean that for each of them, their seat in Congress is more important to them than democracy and their oath to protect and defend the Constitution. Tough beans for the rest of us.

Of course, this is all about Trump and his base, as exemplified by Rex Huppke’s “humor-ish” piece (that’s what he calls it) in the Chicago Tribune.

“As a staunch supporter of President Donald Trump, I demand that Republican senators in charge of the upcoming impeachment trial swiftly acquit the commander in chief before any more truth leaks out.”

“The last thing we need is to see a great president, who we Trump supporters have built up to be an avatar of American strength and decency, get knocked down by stupid things like facts.”

This is supposed to be a caricature of Trump supporters. Clearly, though, our Republican senators are acting as though these are their marching orders.

A minimum of 75% of Americans wanted witnesses and documentary evidence brought before the Senate in Trump’s impeachment trial. 51 senators rejected it.

Q. How could the Senate refuse the wishes of three-quarters of the American people?

A. The same way they refuse the wishes of 92% of the American people who want gun safety legislation.

Add these cowardly senators to Dershowitz and Philbin and we are left with three profiles in cowardice and precious little to protect us from a dictator the Founders feared.

Hitting Back

From the Wall Street Journal:

The U.S. carried out airstrikes against an Iranian-backed Shiite militia group in Iraq and Syria. The Pentagon said the strikes targeted three of the Kataib Hezbollah militia’s locations in Iraq and two in Syria, and were in response to an attack on Friday in which more than 30 rockets were fired at an Iraqi military base near Kirkuk. That incident killed a U.S. contractor and wounded four U.S. troops.

We all get that: they hit us, so we hit back. We’ve known that dynamic and that it’s okay since we were little kids. It’s Human Being 101. Everybody thinks themselves an innocent victim and therefore justified in”hitting back.” But when I read that piece I couldn’t help but wonder about the predictability of the consequences and whether there might be better ways.

History consistently shows us that “hit back” behavior frequently leads to escalated “hit back” from the other side. After all, in their eyes their initial hitting wasn’t the beginning, but, rather, a “hit back” for some slight or wrong they believe was visited upon them. We’ve seen this movie before and we know how it ends. And we know that it always starts again.

Diplomacy has been our primary tool to avoid violent conflict and it has worked quite well countless times. However, right now we’re a bit limited in what we can do in this realm, as our State Department has been gutted of many of its most senior and capable people by the present administration. That’s compounded by a president who is incapable of thinking strategically and who dismisses anything that isn’t some international version of children fighting on the playground. He’s even played “I dare you” over nuclear weapons. That doesn’t sound like a good way to resolve conflict.

So, we’re hamstrung by the human desire to hit back, the lack of alternative critical resources and a leader whose tool bag contains only the knee-jerk reaction to punch others in the nose harder.

We could hope for Congressional action to limit the administration’s war powers, but that’s unlikely in our present political environment. We can just wait for the election in November and then vote cooler heads to both the White House and to Congress, but they won’t have any power for over a year. That’s a lot of time for a tantrum prone president to cause a lot of violence, this as he’s spurred Iran to crank up its atomic bomb manufacturing and North Korea is set to test its intercontinental ballistic missiles to show the world what tough guys they are.

I don’t think escalating war technology will allow us both to continue “hit back” behavior and to survive. We need some better answers right now.

Finally,

Have a look at what contributing opinion writer Kent Greenfield, writing for the Louisville Courier Journal, has to say about Sen. Mitch McConnell and the upcoming impeachment trial in the Senate. Give consideration to how McConnell’s declarations about that process might impact his re-election and overall control of the Senate in 2021. Bear in mind that McConnell is the manipulator who blocked the nomination of Merrick Garland to the Supreme Court in order to spite President Obama and to bend the court further to the right. That and his present promise to violate his oaths and much more are what has powered McConnell past Ted Cruz to be the country’s most disliked senator. That’s quite an accomplishment.

The FOIA triggered disclosure of Mike Pompeo’s involvement with the sliming of Ambassador Marie Yovanovich was only the first end-around of the subpoena stonewalling of the Donald Trump administration. More FOIA requests will be granted and it’s safe to say there will be smoke and perhaps at last a raging fire to see. In addition, yet another court case has slapped the wrist of our king wannabe president, this time declaring officially how idiotic his claims of “absolute immunity” are.

All of this is good news for our democracy, but it isn’t enough. In the absence of full Congressional oversight – that’s Congress asserting its stature and full powers as a co-equal branch of government – executive overreach will continue to corrode our country. We need Congress to put on its Big Boy and Big Girl pants, and right now that means only one thing. The explanation of that requires a short story.

For the decades of the cold war Republicans wrapped themselves in the red, white and blue of the stars and bars and stood in lock-step against Soviet aggression. Now, though, they seem to have stopped at a pawn shop and traded in the American flag for a cloak of Russian Federation white, blue and red.

They act as though they no longer believe in the rule of law. Think: supporting the stonewalling of subpoenas; tolerating obviously criminal actions; attacking U.S. military officers, Gold Star families and distinguished foreign service officers.

Far worse, though, is their mouthing of the disinformation of former KGB officer and murderer, Vladimir Putin. He is working tirelessly to destabilize democracies around the world. He’s spew-vomiting Russian disinformation in the United States, including trying to get Ukraine blamed for the illegal Russian hacks of the DNC and Hillary Clinton email servers in 2016. Amazingly, the Republicans are brainlessly mouthing Putin’s disinformation. They are knowingly doing Putin’s work for him.

As Paul Krugman explained it, “.  .  .  by and large Trump, unlike previous presidents, is backed by a party that sees and hears no evil whatever he does.” That’s because Republicans fear Trump and his MAGA hat wearing followers, so they say and do astonishingly stupid things to stay off Trump’s angry Twitter feed.  And that has caused the Republican sell out of America.

That’s why it’s critical that the GOP put on its Big Boy and Big Girl pants and head back to that pawn shop to get their American flag back.

You can help to make that happen.

We need two dozen Republican senators to wake up and smell the Constitution. Every senator already knows the truth and 30 of the 53 despise Trump. What’s needed is for them to do the right thing. That’s where you come in.

If you have a Republican senator, call his/her office and tell them to vote to remove Donald Trump from office. Here’s an analysis of who the critical senators are.

You can find your own senators here; just use the pull-down at the top left of the linked page to find their contact information.

THEN CALL THEM; don’t email, because voice contact is more powerfully received.

    • Tell them not to support a president who violates the Constitution by trying to get a foreign nation to interfere in our election.
    • Tell them Trump acts solely for his own benefit and sells out our national security in the process.
    • Tell them that you know that they know.

Then tell them what you want them to do. And let them know that you can see their votes.

If either Joe Manchin (D-WV) or Jon Tester (D-MT) is your senator, call them. They’re both under heavy pressure from the right in their states and they need to hear your support for doing the right thing.

To quote Herb Brooks, head coach of the 1980 Olympic Gold Medal winning U.S. Hockey team, “This is your time. Now, go out there and take it!”

Send your senators back to that pawn shop for their American flags. This is your time. Now, go make those calls. Do it now.

What’s At Stake

We’re a hotly divided country, entrenched in our certainties. Whether we say it or not, we see compromise as a dirty thing.

On the other hand, we all know right from wrong and there isn’t a lot of disagreement about it, once we get past our rationalizations.

The House Intelligence Committee hearings are exposing obvious wrongdoing by Donald Trump. It isn’t just that the witnesses are offering plain-to-see facts of his guilt; Trump famously preened as he bragged about his criminal behavior. So, the hearings aren’t about questions of guilt. Rather, the hearings are about what is truly bedrock in America.

Here is the oath of office to which every member of Congress swore:

I do solemnly swear (or affirm) that I will support and defend the Constitution of the United States against all enemies, foreign and domestic; that I will bear true faith and allegiance to the same; that I take this obligation freely, without any mental reservation or purpose of evasion; and that I will well and faithfully discharge the duties of the office on which I am about to enter: So help me God.

Note that no person is named, other than the person being sworn in. The members don’t swear allegiance to a king. They don’t swear allegiance to a president. They swear allegiance to the Constitution of the United States. The United States is alone among the nations in this kind of oath and it declares for all to see that we are a nation of laws and not a nation of men.

That concept is being sorely tested in this era of Trump. Clearly, Trump is all about Trump and uses anything and anyone around him for self-aggrandizement. He demands loyalty to him. The test of our time is what or who our members of Congress will protect and defend. What is at stake is the rule of law and the Constitution itself.

If Trump is allowed to get away with his obvious criminal behavior, we will have established a new bedrock for this nation, a bedrock of personality, not of law; of high office for personal benefit, not for the benefit of the nation.

These hearings, then, are about deciding what kind of nation we will be. President Trump has no voice in this. We The People have an indirect voice by telling our members of Congress where we stand, what we want, how we see things. However, only the members of Congress have a vote.

Members of the House have the first vote. They alone will decide whether to impeach the President. The issue is whether the Republican members will look at the facts and vote accordingly, or whether they will cave to political pressure and vote to protect the President. In that way they will decide whether we are a nation of laws or a nation of a man.

If the House impeaches the President, the Senate will decide whether to convict the President such that he will “.  .  .  be removed from Office on Impeachment for, and Conviction of, Treason, Bribery, or other high Crimes and Misdemeanors.”

Again, there isn’t a doubt about Trump’s guilt. However, there is grave doubt whether the members of the Senate have the courage to act in accordance with their solemn oath of office. They know and we know the truth. The question will be whether knowing that will be enough to cause them to do the right thing.

Everything – the Constitution and the rule of law and our very republic – depends on what they do.

Surely, our Republican Members of Congress see that Trump is guilty of many offenses and crimes. Right now the issues are extortion, bribery, withholding of funds in violation of the direction of Congress and multiple counts of obstruction of justice. Then there’s witness tampering, campaign finance violations, profiting from the Presidency (emoluments), collusion, advocating political and police violence, abuse of power, persecuting political opponents, violating immigrants’ rights and more.

So, Trump’s unfitness for office and his criminality are plain to see. What holds Republicans back from the obvious right path is fear of backlash from their extreme constituents. So, their choice is to do the right thing, which will require that they dare to lose their position and power, or to destroy the rule of law and sell out our country.

That’s what’s at stake.

Pounding and Flip-Flopping

It’s a fundamental courtroom practice:

If the facts are on your side, pound on the facts.

If they aren’t on your side, pound on the law.

If the law isn’t on your side, pound on the table.

The House Judiciary Committee met last week to debate issuing a citation of contempt of Congress to Attorney General William Barr for his failure to produce an unredacted version of the Mueller Report and the underlying evidentiary materials, as well as for his failure to appear before the committee. Of course, the debate was bifurcated along party lines and what I found most interesting is what the Republicans did to make their case against contempt citations.

They brought up all manner of what they decried are unfair or unethical issues, including Hillary Clinton’s emails, FBI leadership, FBI spying and investigating (isn’t that what they’re supposed to do?), Barr’s courage to obey a law that actually doesn’t apply to the contempt of Congress issue, the Steele Dossier (none of which has been disproven), Christopher Steele’s having talked with Russians, various officials lying under oath, James Comey’s perfidy and other real or fantasy offenses.

NONE OF THAT HAS ANYTHING TO DO WITH WILLIAM BARR FAILING TO RESPOND TO CONGRESSIONAL SUBPOENAS. IT’S ALL WHATABOUTISM.

That’s what people do when they don’t have a leg to stand on.

Don’t let their passion or the intensity of their fatuous bloviating or the panoply of unrelated issues distract you. This is solely about obeying the law. That sounds very conservative, don’t you think? How come the Republicans don’t like it? Try this.

The Republican members of the House Judiciary Committee likely feel duty bound to protect the Republican administration, regardless of what some individuals in that administration have done. That’s one of the more odious parts of party politics and it’s one of the things that causes voters’ blood to boil or drives them to simply tune out, believing, “They’re all crooks.”

Here’s what’s at stake in this subpoena/contempt citation case:

The important thing: The oversight function of Congress is impossible to conduct without the necessary information. The purpose of a subpoena is to elicit that information from reluctant witnesses. Which is to say, it doesn’t matter whether the president or his lapdog attorney general like it; Barr has to obey the subpoena and the law in order for our system to work.

The critical thing: What is at stake is the rule of law itself! If Barr and Trump get away with refusing subpoenas, then our rule of law is finished. So is justice in America, because it will be clear that obeying the law no longer matters. Say hello to tyranny.

Here’s the current reality:

Those Republican committee members don’t have the facts on their side. Barr has plainly and obviously stonewalled his subpoenas. That’s a punishable no-no. So they can’t pound on the facts.

Those committee members also don’t have the law on their side. The law is clear that citizens must obey a subpoena. So, those representatives can’t pound on the law.

All they have left is pounding on the table. And that’s what they did during the House Judiciary Committee contempt citation hearings and what they’re doing still.

You can expect the same behavior from Republican senators if a resolution of impeachment arrives in their chamber. That’s pretty much what we saw during the blizzard of filibusters the Republicans mounted to fight anything Obama promoted. They didn’t have the facts and they didn’t have the law, so they pounded on the table.

Critical note to Democrats: if positions were reversed, we’d see the same behavior from Congressional Democrats, although they’d probably smile more and be ever-so empathetic. Nevertheless, forget about feeling smug and disdainful about the other guys. This is party politics S.O.P.

Impeachment update  .  .  .

In 2017 I had the simple clarity that Trump should be impeached because he is a criminal, that he’s obviously guilty of violating the Emoluments Clause, obstruction of justice and possibly of treason for conspiracy with the Russians and for his refusal to take any action to prevent ongoing attacks by Russia. Then I considered what a President Pence might do and I wasn’t so sure that impeachment was best.

The first thing Pence would do is pull a Gerald Ford and pardon Trump and his entire crime family for felonies they have or may have committed. It’s unthinkable that they might get away with their self-aggrandizing criminality, so I changed my mind on impeachment. Now, though, there’s another worry.

Trump has started a march to war with Iran. Separating out his wag-the-dog gambit, starting that war will result in a lot of people dying and suffering and it likely will be a war that will last for many years, just like those in Iraq and Afghanistan, because there’s no way out. It appears that the only way to prevent that is to remove Trump from office before he can fire the first shot. That calls for impeachment, so back we go.

One price of doing that, though, is the probability of angering a lot of Americans who will see Trump as a victim and will vote in a Congress that might continue to dismantle the things we care about, a Congress which will deny climate warming. They will continue the assault on Roe v. Wade, on voting rights and will enact yet more wealth inequality measures. All of that and more are existential threats to liberal democracy and to our entire planet. That price is so large that it augers for leaving Trump in office until the end of his term in order to prevent a backlash Congress, even knowing that he will issue anticipatory pardons to all his co-conspirators.

Yes, I realize that I’m flip-flopping on the issue of impeachment and I don’t like it any more than you do.

This impeachment business is more complicated and has more consequences than I want it to have. I believe in the rule of law and apologize not one bit for being a Boy Scout about my horror over the assault on our moral character that we continue to endure.  But frustrating as it would be to refrain from stopping the subversive criminal in the Oval Office, preempting Trump with impeachment might do more harm than good. Clearly, this is a hold your nose moment in American history.
